Salfor City Council (Howe Street, Salford 7) Gating Order 2011

Notice is hereby given that the council of city of Salford propose to make an order under Section 129A of the Highways Act 1980, a draft of which is set out below.

When the order comes into effect the public right of way over the highways specified in the schedule below are shown on the plan annexed to the draft order shall be restricted at all times.

The right of way will not be restricted for use by the occupiers of premises adjoining or adjacent to the relevant highways. Occupiers will retain their right of way by access to keys to the lockable gates.

A copy of the proposed order together with a plan outlining the restrictions and evidence supporting the need for the order may be inspected at the Legal Section, Civic Centre, Chorley Road, Swinton, M27 5DA, between 8.30am and 5.00pm from Monday to Friday inclusive.

Any representations or objections to the order may be sent in writing to the Strategic Director of Customer and Support Services C/o. The Litigation Team, Civic Centre, Chorley Road, Swinton, M27 5DA, by 12 January 2012 (quoting reference L/HLW/ES/GTO/1540).

Draft Order

The order is made by the council of the city of Salford ("the council") under section 129A of the Highways Act 1980 ("the 1980 Act") because the relevant highway described in article 1 below ("the highway") satisfies the conditions set out in section 129A(3) of the 1980 Act in that:

  1. premises adjoining or adjacent to the highway are affected by crime or anti social behaviour;
  2. the existence of the highway is facilitating the persistent commission of criminal offences or anti-social behaviour; and
  3. it is in all circumstances expedient to make the order for the purposes of reducing crime or anti-social behaviour.

By this order:

  1. The public right of way over the highway situated at the rear of Howe Street, Salford 7 as specified in the schedule below and shown shaded in black on the map contained this order shall be restricted at all times with effect from the sealing of this order.
  2. Gates will be erected at each end of the highway so as to restrict the public right of way. The gates will be locked at all times. The right of way will not be restricted for use by the occupiers of premises adjoining or adjacent to the said Highway. Occupiers will retain their right of way by access to keys to the lockable gates.
  3. The following provisions shall apply for the protection of any statutory undertakers, namely that access will be available to the highway by the lockable gates for the purposes of carrying on thier undertaking via a keyholding/provision service.
  4. The alternative routes for pedestrians and vehicles are as follows:
    1. Lower Broughton Road, Hope Street and Great Clowes Street and vice versa.
    2. Lower Broughton Road, Howe Street and Great Clowes Street and vice versa.
  5. Barriers will be installed, operated and maintained at the ends of the Highway. The council's Environment and Community Safety directorate, Housing Crime Reduction Team is responsible for maintaining the barriers. Their contact number is: 0161 686 5850.

Any reference in this order to any enactment shall be construed as a reference to that enactment or any reference to that enactment or any stautory modification of re-enactment thereof.

Any reference in this order to any road, street or other location shall be construed as including reference to any subsequent name.

Schedule

Alleyway to the rear of 2-24 Howe Street, Salford, 2a-18 Hope Street, Salford and between 313 and 315 Great Clowes Street, Salford and between 436 and 442A Lower Broughton Road, Salford.

A total closure area of 615m2.
