Belmont and Thornfield Gating Order Confirmation
Highways Act 1980 Section 129A
On 2 July 2010 the council of the city of Salford made the above-mentioned Order under Section 129A of the Highways Act 1980.
The Order which comes into effect on 19 July 2010 restricts the public right of way over the highways specified in the schedule below at all times.
The right of way will not be restricted for use by the occupiers of premises adjoining or adjacent to the relevant highways. Occupiers will retain their right of way by access to keys to the lockable gates.
The alternative route for members of the public will be to use the pavement at the front of the properties.
A copy of the Order together with a plan outlining the restrictions may by inspected at the Legal Section, Civic Centre, Chorley Road, Swinton, M27 5DA, between 9.00am and 5.00pm Monday to Friday inclusive. (L/CW/GTO/17/1356).
If you wish to question the validity of the Order or any of the provisions contained in it on the grounds that it is not within the powers conferred by the Highways Act 1980 or on the grounds that any requirement of that Act, or of any instrument made under it has not been complied with in relation to the Order you may within 6 weeks from 19 July 2010 apply to the High Court for this purpose.
Schedule
Alleyway to the rear of 1-23 and 2-28 Belmont Street and 3-27 Thornfield Street, Salford.
This Order is made by the council of the city of Salford ("the council") under Section 129A of the Highways Act 1980 ("the 1980 Act") because the relevant highway described in article 1 below ("the Highway") satisfies the conditions set out in section 129A(3) of the 1980 Act in that:
- premises adjoining or adjacent to the highway are affected by crime or anti-social behaviour
- the existence of the highway is facilitating the persistent commission of criminal offence or anti-social behaviour
- it is in all the circumstances expedient to make the Order for the purposes of reducing crime or anti-social behaviour.
By this order
The public right of way over the land as specified in the schedule below and shown by a continuous bold line on the map contained in this Order shall be restricted at all times with effect from 19 July 2010.
- Gates will be erected at each end of the Highways so as to restrict the public right of way.
- The gates will be locked at all times. The right of way will not be restricted for use by the occupiers of premises adjoining or adjacent to the said highway. Occupiers will retain their right of way by access to keys to the lockable gates.
- The following provisions shall apply for the protection of any statutory undertakers, namely that access will be available to the lockable gates for the purpose of carrying on their undertaking via a keyholding / provision service.
The alternative route for members of the public will be to use the pavement at the front of the properties.
