Trade waste collection
Commercial waste is governed by various legislation, the most important being the Environmental Protection Act 1990 and the Packaging and Waste Regulations 1997. Traders who do not make the necessary provisions and breach their duty of care in respect of their handling of waste may commit an offence under Section 34 of the Environmental Protection Act 1990, for which the maximum penalty upon conviction in a magistrates' court is £5,000 or an unlimited fine upon conviction at a crown court.
You are required, by law, to produce copies of your current Duty of Care Waste Transfer notes, when asked by an authorised officer from Salford City Council, to prove that you are disposing of your waste in a responsible manner. This is either declaring it as trade waste at a civic amenity site and paying the relevant disposal fees (governed by the disposal authority) or using a registered waste carrier who will provide you with a copy of your waste transfer note.
The requirements of Sections 34 & 47 of the Environmental Protection Act 1990 place a Duty of Care on all producers of commercial waste in that they must ensure all such waste is stored and disposed of in a proper and safe manner. This in most circumstances, involves arranging a contract with a registered waste carrier, such as Salford City Council. This will ensure the supply of a proper storage container and the legitimate disposal of your trade waste. If you are disposing of your own trade waste at a civic amenity site then you MUST keep copies of your waste transfer note for a minimum of two years.
In addition, under section 33 of the Environmental Protection Act 1990, it is unlawful to deposit commercial waste except in accordance with a trade waste agreement or waste management licence. The maximum penalty on conviction at the magistrates' court is a fine of £50,000 and/or 5 years imprisonment. There are substantially higher penalties at the crown court.

In order to minimise illegal dumping, black refuse sacks are not removed from commercial premises within Salford. For the majority of the small businesses the pre-paid sack service offers the most effective and flexible solution to disposing of commercial waste where there is no storage space for a bin. If you wish to purchase these blue sacks (which are sold in rolls of 50) please contact our Commercial Contracts Officer who will discuss your individual waste requirements with you and bring the relevant paperwork to complete. The correct payment will also be collected and the sacks delivered at the same time This service is more flexible as we will automatically remove any quantity of pre-paid sacks left out on the day of collection.
Commercial waste collection service is not covered by business rates and we are obliged by law to make a separate charge for collection. For more information please contact us - see details at the bottom of this page or email beverley.lydiate@salford.gov.uk.
Increased waste disposal charges will mean increased costs that will be passed onto the producer of the waste. Salford City Council would advise all customers to look at minimising their waste costs through recycling or reducing the amount of waste they create. For further information contact beverley.lydiate@salford.gov.uk.
REMEMBER - as the producer of the waste this tax is passed DIRECTLY to your company.
REDUCE WHAT YOU PRODUCE!!
Waste minimisation and recycling
Producing waste is not an efficient use of resources. All businesses need to assess their waste in order to comply with government targets and progressive landfill taxations. Waste minimisation is not merely recycling - it means reducing waste at source and not creating it in the first place. As part of the council's commitment of environmental awareness we would be pleased to advise on how to recycle your trade waste. Contact details are at the bottom of the page.
For further information please see Envirowise and/or Reduce The Use.
The various range of container sizes offered by Salford City Council helps keep your waste disposal costs to a minimum by selecting the correct size container best suited to the amount of waste you produce "you only pay for what you waste".
