Licensing changes, effective 7 February 2005
Legislation enacted in the Licensing Act 2003 and affecting certain types of licensing came into effect in February 2005.
If you hold, or intend to hold any of the following licences new licensing laws are applicable from 24 November 2005 in respect of:
- Alcohol (on and off licences)
- Public entertainment (annual or occasional)
- Theatre
- Cinema
- Late night refreshment
- Registered members' clubs
The legislation changes the previous laws about the type of licences needed to provide any of the above functions. Under the arrangements:
The city council, as the 'licensing authority', deals with all applications.
A premises licence is required for any place which offers entertainment, refreshment at night and/or alcohol.
A personal licence is required for anyone who wants to sell or supply alcohol for consumption on or off their premises.
The police have greater power to deal with problem premises and be able to close premises, which are the focus of disorder.
The abolition of 'permitted hours' (hours to be authorised by the licensing authority)
Any premises that sell hot food or drink between 11pm and 5am needs a late night refreshment licence.
The city council must carry out its functions under the legislation with a view to promoting the 'licensing objectives'. The licensing objectives are:
- Prevention of crime and disorder
- Prevention of public nuisance
- Public safety
- Prevention of harm to children
The licensing authority has published a Licensing Policy Statement which is the document by which applications under the Act are considered.
