Buying on credit
If you have bought goods or had work done and you are paying on credit you may have additional rights.
- If the credit was arranged for you by the trader, this includes the use of credit cards, then the finance company are equally liable with the trader for any justified problems.
- This rule applies even if you have only paid a deposit by credit card as long as the total amount is over £100 and the payment was made to the trader.
- If the type of credit is Hire Purchase, the finance company is actually the owner of the goods and must be contacted immediately.
- Use the same process as described in How to Resolve Your Problem to pursue your complaint.
- Do not stop your payments, this can put you in a breach on contract position and can make things more difficult.
- Equal Liability still applies even if you have finished paying the agreement.
- If all your negotiations fail you can still use the County Court and sue both the trader and/or the finance company.
