Industrial and commercial chimneys/furnaces
The Clean Air Act 1993 provides controls for the emission of dark smoke from chimneys, the installation of chimneys and the height of chimneys. Brief details are given below:
- Salford is in a smoke to control area and it is an offence to emit dark smoke from a domestic chimney or use a non approved appliance for burning wood fuel or oil.
- It is an offence to use, sell for use in a smoke control area any unauthorised fuel.
- It is an offence to emit dark smoke from chimneys, or from the burning of trade or industrial waste. Dark smoke emitted during certain conditions may be exempt from a prosecution.
- Installation of furnaces over 16.12 kW must be notified to the Council that they can be operated without smoke. See attached form
- Furnaces which a) use burn pulverised fuel, or b) burn at a rate of 45.4 kg or more an hour any other solid matter, or (c) burn at a rate equivalent to 366.4 kW or more any liquid or gaseous matter, require Council approval of chimney height. See attached application form
Smoke, which may not be dark, can also cause a nuisance to your neighbours and is an offence under the Environment Protection Act 1990. A notice can be served and you may also be fined if further instances occur.
