What is a statutory nuisance?
Statutory nuisance could be noise, smoke, fumes, gas, dust, steam, odours, light, deposits and accumulations of refuse and material, and other escapes from your premises.
However, they are only classified as statutory nuisances if they affect the health of people in your area or if they interfere with a person's legitimate use of land. This particularly applies to nuisance to neighbours in their homes and gardens.
How would I know if a nuisance exists?
You are likely to have had complaints or the local Environmental Health Officer may have received complaints.
You can find out whether you or your company might cause a nuisance to neighbours or is doing so already. Noise, odours and other emissions can usually be checked by making observations at or near the boundary of the site during different operating conditions and at different times of the day. It will also help to make an occasional walk over the site to check for waste and any evidence of vermin.
