Closure due to crime and security
Until recently crime and security issues have not been valid reasons to close a highway, but recently new legislation has been introduced under sections 118B and 119B of the Highways Act 1980.
This legislation provides the Secretary of State with discretion to designate areas to enable the highway authority to make stopping up or diversion orders to prevent or reduce crime, which would otherwise disrupt the life of the community.
These powers should be particularly helpful in areas such as housing estates which are the subject to high levels of crime which are undermining attempts to address wider problems within the neighbourhood.
Special extinguishment and diversion orders within such designated areas will need to meet further specific conditions and considerations set out in the legislation and summarised as:
- A highway authority may only make an order in an area which has been designated by the Secretary of State by order
- The premises adjoining, or adjacent to the highway, are affected by high levels of crime
- That the existence of the highway is facilitating the persistent commission of criminal offences

ObjectionsProposed closures are subject to consultation and objections may be received from interested parties opposing such proposals.
Objections to the closure may be received from:
- Various bodies who may oppose the closure proposal (Ramblers Association etc)
- Utility companies (eg United Utilities) who have apparatus in the road that may require diversion, etc. The applicant will have to pay for this work if the closure is granted
