Conditions of Hire
The contact of Hire shall permit the Hirer to use the main hall, kitchen and cloakroom at the Premises or such rooms as may be agreed. The Hirer shall not use any of the equipment in the premises unless specific permissions is given on the letter of acceptance by the Director of Community & Social Services
1. The premises shall only be used for social, recreational and educational functions.
2. Where the premises do not have an Entertainments Licence for public music, singing or
Dancing events, if required the Hirer should obtain a licence via the Head of Law and Administration, Common Law Section, 214 Chorley Road, Swinton
3. No intoxicating liquors will be allowed on the premises without the permission of the Director of Community & Social Services. Again the appropriate licence must be obtained by the Hirer.
4. The Hirer shall indemnify the Council against all claims, demands, actions or proceedings inspect of the death or injury of any person which shall occur during the period of hire or prior or subsequent thereto if in relation to or by any reason of hiring. Provided always that this indemnity shall not apply in the event of any negligence on the part of the Council, its agent or servants or of any defects in the premises of an Act of God or the Queen's enemies.
5. The Hirer shall repay to the Council on demand, the cost of re-instating or replacing any part of the centre or any property in or upon the centre which shall be damaged, destroyed, stolen, or removed during the period of hire or prior or subsequent thereto if in relation to or by reason of the hiring. The amount of the cost shall be certified by the
Council's Head of Finance whose certificate shall be final. Unless the Hirer can show before the commencement of the period of hiring that any property of the Council in the centre is damaged, such property shall be deemed to have been damaged at the commencement of the period of hire.
6. The Hirer is responsible for the effective supervision of the arrangements and activities in the premises during the period of hire and for the prevention of
disorderly behaviour so as to ensure that no nuisance or annoyance arises to the occupiers, of adjoining premises. There shall not be brought on to the premises, anything of an inflammable, dangerous or noxious character.
7. Authorised representatives of the council have the right to terminate a function (after informing the Hirer of his intention), if in the opinion of the Council's representative, an outbreak of trouble occurs and which appears likely to escalate beyond the control of Hirers.
8. The Council reserves the right to cancel any reservation in the event of the centre being required as a Polling Station in connection with a local or parliamentary election.
10. No nails or fastening shall be driven into the wall, floor, ceiling or partition or any part of the building without permission of the Community Centre Co-ordinators.
11. The Hirers must ensure that all persons leave the premises within 15 minutes of the termination of the function and the premises are to be left in a reasonable tidy and orderly condition at the end of the function.
12. The Hirer is responsible for acting in emergencies and should be familiar with the instructions provided for action in the event of fire.
13. The Council reserves the right (1) to refuse any application as it may deem fit and (2) to cancel any letting on giving seven days' notice, in writing, under the hand of the Director of Community & Social Services to the Hirer: upon any such cancellation, the Council will refund to the Hirer any monies paid in respect of the letting so cancelled, but will not be responsible for any expenditure whatsoever, in relation to the letting which the Hirer may have incurred or be liable to pay,
14. The Hirer is responsible for any equipment they leave in the centre and should ensure is both in good repair and stored safely. Items no longer required, deemed beyond repair of unsafely stores should be removed by the Hirer upon request by the Office In Charge.
