Note in lieu: what is it?
A note that may be issued to the child’s parents and school when, following a statutory assessment, the local education authority decide not to make a statement.
The note should describe the child’s special educational needs, explain why the local education authority does not think it necessary to make a statement and make recommendations about appropriate provision for the child. All the advice received during the assessment should be attached to the note sent to the parents and, with their consent, should also be sent to the child’s school.
The final eight weeks
Within the final eight weeks, you have 15 days to reply to the local education authority about the proposed statement. You can:
- Say which school you would prefer
- Give your views about what the proposed statement says
- Ask for a meeting to discuss what the local education authority has said
By the end of this eight week period you should have your child’s final statement.
You have a right of appeal to the Special Educational Needs Tribunal if you disagree with the local education authorities decisions.
