Salford City Council proposes to make the following order under the Road Traffic Regulations Act 1984.

The City of Salford (Wet Earth Green, Roving Bridge Rise, Kilcoby Avenue and Giants Set Grove) (Prohibition of Waiting) Order 2023

The effect of the proposed order will be to introduce the following provisions:

No Waiting At Any Time on:

Wet Earth Green

  • South from a point 12m south west from the south westerly extended kerbline of Topgate Brow south westerly for 24m
  • North then east side, from 12m south west of the south-westerly extended kerbline of Topgate Brow, for 10m in a south westerly and then 10m in a northerly direction
  • North then west side, from 36m south west of the south-westerly extended kerbline of Topgate Brow, for 10m in a north-easterly direction and then 10m northerly
  • North and west side, from a point 11 metres northeast from the north easterly extended kerbline of Topgate Brow north easterly around the bend for 16m
  • South and east side from 11m north east from the north easterly extended kerbline of Topgate brow north easterly around the bend for 25m
  • North side, from 35m south west from the south westerly extended kerbline of Bolbury Crescent south westerly for 26m.
  • South then east side from 35m south west of the south-westerly extended kerbline of Bolbury Crescent, for 10m south-westerly and then 10m southerly.
  • South then west side from 61m south west of the south-westerly extended kerbline of Bolbury Crescent, for 10m north-easterly and then 10m southerly.
  • North and west side from 88m south west from the south westerly extended kerbline of Bolbury Crescent south westerly around the bend for 26m
  • South and east from 88m south west from the south westerly extended kerbline of Bolbury Crescent in a south westerly direction around the bend for 18m

Kilcoby Avenue 

  • North side from 10m south west from the south westerly extended kerbline of Roving Bridge Rise to a point 10m southeast of the south easterly extended kerbline of Roving Bridge Rise

Roving Bridge Rise

  • Both sides from the extended northern kerbline of Kilcoby Avenue for a distance of 10m northerly.

Giants Seat Grove

  • Both sides, from its cul-de-sac end in a north easterly direction for 23m including the turning head on the south west side.

City of Salford (Wet Earth Green, Roving Bridge Rise, Kilcoby Avenue and Giants Seat Grove) (Prohibition of Waiting) Order 2023

Salford City Council in exercise of its powers under Sections 1(1), 2(1) to (3) and 4(2) of the Road Traffic Regulation Act 1984 ("the Act"), and of all other enabling powers and after consultation with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act, hereby makes the following Order:

Interpretation

In this Order:

  • “Disabled Person’s Badge” has the same meaning as in The Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000;
  • “Disabled Person’s Vehicle” means a vehicle lawfully displaying a disabled person’s badge being a vehicle which, immediately before or after any period of waiting allowed by virtue of a provision of a kind required by the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000 to be included in an order under the Act, has been or is to be used for carrying disabled persons as passengers;
  • “Parking Disc” means a disc, issued by a local authority, 125 millimetres square, coloured blue and capable of showing the quarter hour period during which a period of waiting begins, which has not ceased to be valid.

For the purpose of this Order a vehicle shall be regarded as displaying:

  • Disabled Person’s Badge in the relevant position if:
    • the badge is exhibited on the dashboard or facia of the vehicle, or
    • where the vehicle is not fitted with a dashboard or facia, the badge is exhibited in a conspicuous position on the vehicle,
    • so that the front of the badge is clearly legible from the outside of the vehicle;
  • a Parking Disc in the relevant position if:
    • the disc is exhibited on the dashboard or facia of the vehicle; or
    • where the vehicle does not have a dashboard or facia, the disc is exhibited in a conspicuous position on the vehicle,
    • so that, when marked to show the quarter-hour period during which a period of waiting began, that period is clearly legible from the outside of the vehicle.
  • The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

No waiting at any time

  • Save as provided in Article 3 of this Order no person shall, except upon the direction or with the permission of a constable in uniform or a civil enforcement office, cause or permit any vehicle to wait at any time on the lengths of road specified in the Schedule to this Order.

Exemption from prohibition – general exemptions

Nothing in Article 2 of this Order shall prevent any person to cause or permit any vehicle to wait on the length of road referred to in that Article for so long as may be necessary to enable:

  • a person to board or alight from the vehicle;
  • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in connection with any of the following operations, namely:
    • building, industrial or demolition operations;
    • the removal of any obstruction to traffic;
    • the maintenance, improvement or reconstruction of the said length of road;  or
    • the laying, erection, alteration or repair, in or on land adjacent to the said length of road, of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus defined in the Telecommunications Act 1984;
  • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in the service of a local authority or a water authority in pursuance of statutory powers or duties;
  • the vehicle to be used for the purpose of delivering or collecting postal packets as defined in the Postal Services Act 2000;
  • the vehicle to take in petrol, oil, water or air from any garage situated on or adjacent to the said side of length of road;
  • the vehicle to wait at or near to any premises situated on or adjacent to the said length of road for so long as such waiting by that vehicle is reasonably necessary in connection with any funeral;
  • the vehicle to be used for fire brigade, ambulance or police purposes; or
  • goods to be loaded on to or unloaded from the vehicle.

Exemption for disabled persons’ vehicles

Nothing in Article 2 of this Order shall prevent any person to cause or permit a Disabled Person's Vehicle which displays in the relevant position a Disabled Person's Badge, and a Parking Disc (on which the driver or other person in charge of the vehicle, has marked the time at which the period of waiting began) to wait on the length of road referred to in that Article for a period not exceeding three hours (not being a period separated by an interval of less than one hour from a previous period of waiting by the same vehicle on the same length of road on the same day).

Schedule – no waiting at any time

Wet Earth Green

  • South, from a point 12 metres southwest from the south westerly extended kerbline of Topgate Brow in a south westerly direction for 24 metres.
  • North then east side, from a point 12 metres southwest of the south-westerly extended kerbline of Topgate Brow, for a distance of 10 metres in south westerly direction and then 10 metres in a northerly direction
  • North then West side, from a point 36m south west of the south-westerly extended kerbline of Topgate Brow, for a distance of 10 metres in a north-easterly direction and then 10 metres in a northerly direction.
  • North and west side, from a point 11 metres northeast from the north easterly extended kerbline of Topgate Brow in a north easterly direction around the bend for 16 metres.
  • South and east side, from a point 11 metres northeast from the north easterly extended kerbline of Topgate brow in a north easterly direction around the bend for 25 metres
  • North side, from a point 35 metres southwest from the south westerly extended kerbline of Bolbury Crescent in a south westerly direction for 26 metres.
  • South then east side, from a point 35m south west of the south-westerly extended kerbline of Bolbury Crescent, for a distance of 10 metres in a south-westerly direction and then 10 metres in a southerly direction.
  • South then west side, from a point 61m south west of the south-westerly extended kerbline of Bolbury Crescent, for a distance of 10 metres in a north-easterly direction and then 10 metres in a southerly direction.
  • North and west side,from a point 88 metres southwest from the south westerly extended kerbline of Bolbury Crescent in a south westerly direction around the bend for 26 metres.
  • South and east, from a point 88 metres southwest from the south westerly extended kerbline of Bolbury Crescent in a south westerly direction around the bend for 18 metres.

Kilcoby Avenue

  • North side, from a point 10 metres southwest from the south westerly extended kerbline of Roving Bridge Rise to a point 10 metres southeast of the south easterly extended kerbline of Roving Bridge Rise

Roving Bridge Rise                                

  • Both sides, from the extended northern kerbline of Kilcoby Avenue for a distance of 10 metres in a northerly direction.

Giants Seat Grove                                  

  • Both sides, from its cul-de-sac end in a north easterly direction for 23 metres including the turning head on the southwest side.

Statement of Reasons

The City of Salford (Wet Earth Green, Roving Bridge, Kilcoby Avenue and Giants Set Grove) (Prohibition of Waiting) Order 2022

It has been proposed to introduce a permanent Traffic Regulation Order for a series of No Waiting At Any Time parking restrictions on Wet Earth Green, Roving Bridge Rise, Kilcoby Avenue & Giants Seat Grove in the Pendlebury and Clifton ward. The area is a residential estate with minimal waiting restrictions throughout the estate and it is part of a 20mph zone. Vehicles are parking close to the junctions and bends compromising visibility and access for service vehicles. This creates a road safety concern for both pedestrians and motorists negotiating the area. 

The proposals are required in the interests of road safety to prevent obstructive and inconsiderate parking assisting in providing adequate visibility and room for service vehicles to manoeuvre in safety. The proposals will keep the junctions, bends and turning heads clear and allow safe access and egress of the vehicles.
