Bradburn Road, Cromwell Road and Station Road

Salford City Council proposes to make the following Order under the Road Traffic Regulation Act 1984. The title and effect of the Order is as follows:

No Waiting at Any Time on:

Bradburn Road

  • both sides, from the north western extended kerbline of Cromwell Road for a distance of 15 metres in a north westerly direction

Cromwell Road

  • north west side, from the north western extended kerbline of Station Road to a point 15 metres south west from the extended south western kerbline of Bradburn Road; and
  • southeast side, from the north western extended kerbline of Station Road for a distance of 24 metres in a south westerly direction.

Station Road

  • both sides, from its junction with Liverpool Road to a point 15 metres south west from its junction with Cromwell Road.

No Stopping outside the Irlam and Cadishead College on Monday to Friday between 8am to 5pm on:

Station Road

  • NW side from 30.2m south west from the central reservation between Liverpool Road and Station Road for distance of 25.56 metres in a south westerly direction.

Existing Orders are to be amended so as to be consistent with the proposals. Statement of reasons

There have been complaints by the local community about the inconsiderate parking which is taking place on Cromwell Road. This is mostly by drivers who are visiting the school and also those who are using Irlam Railway Station. It has therefore been proposed to introduce double yellow lines on the north side of Cromwell Road between junctions with Station Road and Bradburn Road.

It is necessary to introduce new waiting restrictions on the north side of Cromwell Road between Station Road and Bradburn Road to prevent vehicles parking. This will create a safer environment for all road users. The proposed double yellow lines will increase visibility for both junctions as well as for the car park and garages located on the north side of Cromwell Road between junctions Bradburn Road and Station Road.

Additionally the School Keep Clear on Station Road has been reviewed as vehicles are often parking on the restrictions.

City of Salford (Bradburn Road, Cromwell Road and Station Road) (Prohibition of Waiting, School Keep Clear and Amendment) Order 2023

Salford City Council in exercise of its powers under Sections 1(1), 2(1) to (3) and 4(2), 32 (1) and 35(1) of the Road Traffic Regulation Act 1984 ("the Act"), and Part IV of Schedule 9 to the Act and of all other enabling powers and after consultation with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act, hereby makes the following Order:

Interpretation

In this Order:

  • “disabled person’s badge” has the same meaning as in The Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000;
  • “disabled person’s vehicle” means a vehicle lawfully displaying a disabled person’s badge being a vehicle which, immediately before or after any period of waiting allowed by virtue of a provision of a kind required by the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000 to be included in an order under the Act, has been or is to be used for carrying disabled persons as passengers;
  • “parking disc” means a disc, issued by a local authority, 125 millimetres square, coloured blue and capable of showing the quarter hour period during which a period of waiting begins, which has not ceased to be valid.
  • “School Entrance” means the length of road specified in Schedule 3 to this Order with a road marking to diagram 1027.1 and a sign to Schedule 4, Part 3, Item 10 that has been placed on the road in accordance with the Traffic Signs Regulations and General Directions 2016

For the purpose of this Order a vehicle shall be regarded as displaying:

  • a disabled person’s badge in the relevant position if:
    • the badge is exhibited on the dashboard or facia of the vehicle, or
    • where the vehicle is not fitted with a dashboard or facia, the badge is exhibited in a conspicuous position on the vehicle,
    • so that the front of the badge is clearly legible from the outside of the vehicle;
  • a parking disc in the relevant position if:
    • the disc is exhibited on the dashboard or facia of the vehicle; or
    • where the vehicle does not have a dashboard or facia, the disc is exhibited in a conspicuous position on the vehicle,
    • so that, when marked to show the quarter-hour period during which a period of waiting began, that period is clearly legible from the outside of the vehicle.

The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

Amendment existing orders

The Orders specified in Schedule 1 to this Order are amended to the extent as specified in Schedule 1 to this Order. 

No waiting at any time

  • Save as provided in Article 4 of this Order no person shall, except upon the direction or with the permission of a constable in uniform, a civil enforcement officer or a traffic warden, cause or permit any vehicle to wait at any time on the lengths of road specified Schedule 2 to this Order.

Exemption from prohibition – general exemptions

Nothing in Article 3 of this Order shall prevent any person to cause or permit any vehicle to wait on the lengths of road referred to in that Article for so long as may be necessary to enable:

  • a person to board or alight from the vehicle;
  • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in connection with any of the following operations, namely:
    • building, industrial or demolition operations;
    • the removal of any obstruction to traffic;
    • the maintenance, improvement or reconstruction of the said length of road; or
    • the laying, erection, alteration or repair, in or on land adjacent to the said length of road, of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus defined in the Communications Act 2003;
  • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in the service of a local authority or a water authority in pursuance of statutory powers or duties;
  • the vehicle to be used for the purpose of delivering or collecting postal packets as defined in the Postal Services Act 2000;
  • the vehicle to take in petrol, oil, water or air from any garage situated on or adjacent to the said side of length of road;
  • the vehicle to wait at or near to any premises situated on or adjacent to the said length of road for so long as such waiting by that vehicle is reasonably necessary in connection with any funeral;
  • the vehicle to be used for fire brigade, ambulance or police purposes; or
  • goods to be loaded on to or unloaded from the vehicle.

Exemption for disabled persons’ vehicles

Nothing in Article 3 of this Order shall prevent any person to cause or permit a disabled person's vehicle which displays in the relevant position a disabled person's badge, and a parking disc (on which the driver or other person in charge of the vehicle, has marked the time at which the period of waiting began) to wait on the length of road referred to in that Article for a period not exceeding three hours (not being a period separated by an interval of less than one hour from a previous period of waiting by the same vehicle on the same length of road on the same day).

No stopping outside school entrance

Save as provided in Article 6 of this Order, no person shall, except upon the direction or with the permission of a constable in uniform or a civil enforcement officer, cause or permit any vehicle to stop between the hours of 8am and 5pm on Monday to Friday inclusive on the school entrances and outside the schools specified in Schedule 3 to this Order.

General exemptions

Nothing in Article 5 of this Order shall prevent any person from causing or permitting any vehicle to stop on the school entrance specified in that Article so far as such stopping is reasonably necessary for the vehicle to be used for the following purposes:

  • the removal of any obstruction to traffic;
  • police, fire brigade or ambulance purposes
  • in pursuance of statutory powers or duties
  • the maintenance, improvement or reconstruction of the length of road comprised of the school entrance or the laying, erection, alteration or repair in or adjacent to the said school entrance or of any sewer, main, pipe or apparatus for the supply of gas, water, electricity or any telecommunication apparatus as defined in the Communications Act 2003.

Schedule 1 - Amendment to Existing Orders

Order - Extent of Amendment by the deletion of the following lengths of road from the Schedules to the Orders as specified below:

  • Salford City Council (Cromwell Road, Cadishead) (Prohibition and Restriction of Waiting) Order 2013 - In its entirety
  • Salford City Council (Station Road, Irlam) (Introduction of School Keep Clear Markings) Order 2013 - In its entirety
  • The Lancashire County Council (Various Side Streets, Irlam) (Prohibition of Waiting) Order, 1966 - Station Road from its junction with Liverpool Road for a distance of 45 feet in a south-westerly direction

Schedule 2 - No Waiting at Any Time

Bradburn Road

  • both sides, from the north western extended kerbline of Cromwell Road for a distance of 15 metres in a north westerly direction

Cromwell Road

  • north west side, from the north western extended kerbline of Station Road to a point 15 metres south west from the extended south western kerbline of Bradburn Road.
  • Southeast side, from the north western extended kerbline of Station Road for a distance of 24 metres in a south westerly direction.

Station Road

  • Both sides, from its junction with Liverpool Road to a point 15 metres south west from its junction with Cromwell Road.

Schedule 3

Station Road

  • North west side, from a point 30.2 metres south west from the central reservation between Liverpool Road and Station Road for a distance of 25.56 metres in a south westerly direction - Irlam and Cadishead College (also known as Irlam and Cadishead Academy)
