Edison Road and Turing Avenue

Salford City Council proposes to make the following Orders under the Road Traffic Regulation Act 1984. The title and effects of the Orders are as follows: 

City of Salford (Edison Road and Turing Avenue) (Prohibition of Waiting) Order 2023

Proposed No Waiting At Any Time on:

Edison Road

  • North east side, from 20m north west from the extended north western kerbline of Turing Avenue to a point 13m south east from the extended south eastern kerbline of Turing Avenue

Turing Avenue

  • Both sides from its junction with Edison Road for 9m north easterly direction
  • Both sides, from a point 30m north east from the north Eastern extended kerbline of Edison Road for a distance of 24m (including cul-de-sac end)

No Stopping on School Entrance Markings Monday to Friday, 8am and 5pm on:

Edison Road

  • South west side, from 5m south east from the extended south eastern kerbline of Turing Avenue to the back of the footway of School Road, for 57m

City of Salford (Various Roads, Eccles) (20 Mph Speed Limit) Order 2023

The proposed Order shall prohibit any person driving any motor vehicle at a speed exceeding 20mph on the following lengths of road; Adamson Road, Ashford Avenue, Ashridge Drive, Bell Terrace, Edison Road, Shaftesbury Avenue, Shirley Avenue, Stratford Avenue and Turing Avenue.

Statement of Reasons for the following Orders:

  • City Of Salford (Various Roads) (20 Mph Speed Limit) Order 2023

A new housing development off Edison Road (old Tennis Courts) requires ‘No Waiting at Any Time’ Traffic Regulation Order.

The new housing development requires ‘No Waiting at Any Time’ restrictions at new junction Edison Road – Turing Avenue. Additionally, the turning head has to be protected by double yellow lines, to ensure safe access is provided for the off-street parking facility as well as turning area for larger vehicles.

‘School Keep Clear’ road markings will be implemented on Edison Road, opposite Turing Avenue.

The new road; Turing Avenue, will be also added to the existing 20mph speed limit zone operating in the area for consistency.

City of Salford (Edison Road and Turing Avenue) (Prohibition of Waiting) Order 2023

Salford City Council in exercise of its powers under Sections 1(1), 2(1) to (3) and 4(2) of the Road Traffic Regulation Act 1984 ("the Act") to the Act, and of all other enabling powers and after consultation with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act, hereby makes the following Order:

Interpretation

In this Order:

  • “disabled person’s badge” has the same meaning as in The Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000;
  • “disabled person’s vehicle” means a vehicle lawfully displaying a disabled person’s badge being a vehicle which, immediately before or after any period of waiting allowed by virtue of a provision of a kind required by the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000 to be included in an order under the Act, has been or is to be used for carrying disabled persons as passengers;
  • “delivering” and “collecting” in relation to postal packets includes checking the goods for the purposes of their delivery or collection:
  • “parking disc” means a disc, issued by a local authority, 125 millimetres square, coloured blue and capable of showing the quarter hour period during which a period of waiting begins, which has not ceased to be valid.

For the purpose of this Order a vehicle shall be regarded as displaying:

  • a disabled person’s badge in the relevant position if:
    • the badge is exhibited on the dashboard or facia of the vehicle, or
    • where the vehicle is not fitted with a dashboard or facia, the badge is exhibited in a conspicuous position on the vehicle,
    • so that the front of the badge is clearly legible from the outside of the vehicle;
  • a parking disc in the relevant position if:
    • the disc is exhibited on the dashboard or facia of the vehicle; or
    • where the vehicle does not have a dashboard or facia, the disc is exhibited in a conspicuous position on the vehicle,
    • so that, when marked to show the quarter-hour period during which a period of waiting began, that period is clearly legible from the outside of the vehicle.

The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

No waiting at any time

Save as provided in Article 3 of this Order no person shall, except upon the direction or with the permission of a constable in uniform, a civil enforcement officer cause or permit any vehicle to wait at any time on the lengths of road specified the Schedule to this Order.

Exemptions from prohibitions and restrictions - general exemptions

Nothing in Article 2 of this Order shall prevent any person from causing or permitting any vehicle to wait on the lengths of road referred to in that Article for so long as may be necessary to enable:

  • a person to board or alight from the vehicle;
  • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in connection with any of the following operations, namely:
    • building, industrial or demolition operations;
    • the removal of any obstruction to traffic;
    • the maintenance, improvement or reconstruction of the said side of length of road; or
    • the laying, erection, alteration or repair, in or on land adjacent to the said lengths of road, of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus defined in the Communication Act 2003;
  • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in the service of a local authority or a water authority in pursuance of statutory powers or duties;
  • the vehicle to be used for the purpose of delivering or collecting postal packets as defined in the Postal Services Act 2000;
  • the vehicle to take in petrol, oil, water or air from any garage situated on or adjacent to the said side of length of road;
  • the vehicle to wait at or near to any premises situated on or adjacent to the said lengths of road for so long as such waiting by that vehicle is reasonably necessary in connection with any funeral;
  • the vehicle to be used for fire brigade, ambulance or police purposes.

Exemption for disabled persons’ vehicles

Nothing in Article 2 of this Order shall prevent any person to cause or permit a Disabled Person's Vehicle which displays in the relevant position a Disabled Person's Badge, and a Parking Disc (on which the driver or other person in charge of the vehicle, has marked the time at which the period of waiting began) to wait on the length of road referred to in that Article for a period not exceeding three hours (not being a period separated by an interval of less than one hour from a previous period of waiting by the same vehicle on the same length of road on the same day).

Schedule - No Waiting at any Time

Edison Road

  • north east side, from a point 20 metres north west from the extended north western kerbline of Turing Avenue to a point 13 metres south east from the extended south eastern kerbline of Turing Avenue.

Turing Avenue

  • both sides, from its junction with Edison Road for a distance of 9 metres in a north easterly direction.
  • both sides, from a point 30 metres north east from the north eastern extended kerbline of Edison Road for a distance of 24 metres (including cul-de-sac end)

City of Salford (Edison Road, Salford) (School Keep Clear Markings) Order 2023

Salford City Council (hereinafter referred to as "the Council") in exercise of the powers of the said Council under Section 1(1), 2(1) to (3), 3(2), 4(1) and 4(2) of the Road Traffic Regulation Act  1984 (“ the Act”) and of all other enabling powers and after consultation with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act ,hereby make the following Order:

In this Order:

“School Entrance” means the length of road specified in the Schedule to this Order with a road marking  to diagram 1027.1 and a sign to Schedule 4, Part 3, Item 10 that has been placed on the road in accordance with the Traffic Signs Regulations and General Directions 2016

The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

No stopping outside school entrance

Save as provided in Article 3 of this Order, no person shall, except upon the direction or with the permission of a constable in uniform or a civil enforcement officer, cause or permit any vehicle to stop between the hours of 8am and 5pm on Monday to Friday inclusive on the school entrances specified in the Schedule to this Order outside the schools specified in the Schedule to this Order.

Exemption from prohibition – general exemptions

Nothing in Article 2 of this Order shall apply:

  • so as to prevent a vehicle from stopping on the school entrance referred to in that Article for so long as may be necessary to enable the vehicle to be used in connection with:
    • any building operation or demolition;
    • the removal of any obstruction to traffic;
    • the maintenance, improvement or reconstruction of the road comprising or including that carriageway; or
  • to a vehicle being used for fire brigade, ambulance or police purposes;
  • to a vehicle being used in the service of a local authority or of a water authority in pursuance of statutory powers or duties;
  • to a vehicle waiting when the person in control of the vehicle:
    • is required by law to stop;
    • is obliged to stop in order to avoid an accident; or
    • is prevented from proceeding by circumstances outside their control.

City of Salford (Various Roads, Eccles) (20 Mph Speed Limit) Order 2023

Salford City Council in exercise of its powers under Sections 82 and 84 of the Road Traffic Regulation Act 1984 (hereinafter called "the Act") and of all other enabling powers and Part IV of Schedule 9 to the Act and of all other enabling powers and after consultation with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act, hereby makes the following Order:

Interpretation

In this Order:

  • "Special Forces" means those units of the armed forces of the Crown the maintenance of whose capabilities is the responsibility of the Director of Special Forces, or which are for the time being subject to the operational command of that Director.

The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

20mph speed limit zone

  • The roads specified in the Schedule to this Order shall cease to be restricted roads for the purposes of section 81 of this Act.
  • No person shall drive any motor vehicle at a speed exceeding 20 miles per hour on the length of roads specified in the Schedule to this Order.
  • No speed limit imposed by this Order applies to the vehicles falling within Regulation 3(4) of the Road Traffic Exemptions (Special Forces) (Variation and Amendment) Regulations 2011 when used in accordance with Regulation 3(5) of those Regulations.
