Salford City Council proposes to make the following Orders under the Road Traffic Regulation Act 1984. The title and effects of the Orders is as follows:

No Waiting At Any Time:

Chapel Street

  • North from east of Adelphi Street to west of A6042 Trinity Way.
  • South from east of Oldfield Road, to west of Islington Way.
  • South from east Islington Way for 20.3m east.
  • South 38.5m east of Islington Way for 31.1m east.
  • South from 88.5m east of Islington Way to west of A6042 Trinity Way.

Islington Way

  • West from south of Chapel Street for 8m south west.
  • West from 38.3m south west of Chapel Street to north of Barrow Street.

Limited Waiting Parking Place (Operational Monday to Sunday, maximum stay two hours, no return within two hours):

  • West from 26.1m south of Islington Way, for a distance of 12.2m. The width of each bay is 2.44m, and length of 6m.
  • East from 23m south of Chapel Street, for 4.8m. The width of each bay is 2.4m, and length of 6m.

Limited Waiting Parking Place (Operational Monday to Saturday, 8am to 7pm, maximum stay 30 minutes, no return within two hours):

North Star Drive

  • South from 36.3m east of Rocket Way, for 30.3m in east direction with a width of 2.6m throughout.

Limited Waiting Parking Place (Operational, Monday to Friday, 10.30am to 2.30pm, maximum stay two hours, no return within two hours):

  • East from 31.9m south of North Star Drive, for 6.5m in south of 2m throughout.
  • East from 42.4m S of North Star Drive, for 28.7m in south width of 2m throughout.

Parking Place reserved for Electric Vehicle Charging Only (Operational Monday to Sunday, at all times, maximum stay four hours, no return within four hours):

Islington Way

  • East 4 from 27.8m south west of Chapel Street, for 14.4m in south west direction. The width of each bay is 3.6m, and length of 6m.

Parking Place reserved for Loading and Unloading by Goods Vehicles Only (Operational Monday to Sunday, at all times):

Islington Way

  • West from 8m south of Islington Way, for 13.8m in south direction, with a maximum width of 3m.

No Stopping on School Entrance Markings (Operational Monday to Friday, 8am to 5pm):

Islington Way

  • West 4.4m south of Barrow Street, for 31.5m in a south direction.

Existing Orders are to be amended to be consistent with the above proposals. Statement of Reasons

The City of Salford (Chapel Street, Islington Way, North Star Drive) (Prohibition of Waiting, Prohibition of Loading, Loading/Unloading Bay, Limited Waiting Bays, Electric Vehicle Charging Bays, School Keep Clear) Traffic Regulation Order and Revocation 2023

A planning application has been approved to construct a new part 7 storey and part 8 storey building that will be mixed residential and commercial use referred to as Plot E6. This is the continuation of the recent ongoing regeneration of the Chapel Street area with the adjacent Plot E7 and E8 developments. Due to these changes there have been new patterns of parking and loading demands in the area, and therefore the existing traffic orders are no longer fit for purpose. This has resulted in some motorists exploiting loopholes in historic traffic orders along Chapel Street to park on the footway without being subject to parking enforcement.

The proposals are being introduced on the grounds of highway safety, preventing damage to the kerbs and footways due to illegal footway parking, preserving the amenities of the area and facilitating the expeditious passage of traffic.

The above proposals will provide a safe and accessible road for all road users.

The City of Salford (Chapel Street, Islington Way, North Star Drive) (Prohibition Of Waiting, Prohibition Of Loading, Loading/Unloading Bay, Limited Waiting Bays, Electric Vehicle Charging Bays, School Keep Clear) Traffic Regulation Order And Revocation 2023

Salford City Council in exercise of its powers under Sections 1(1), 2(1) to (3) and 4(2), 32 (1) and 35 (1)  and of the Road Traffic Regulation Act 1984 ("the Act"), and part VI of Schedule 9 of the Act of all other enabling powers and after consultation with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act, hereby makes the following Order:

Interpretation

In this Order:

  • “disabled person’s badge” has the same meaning as in The Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000;
  • “disabled person’s vehicle” means a vehicle lawfully displaying a disabled person’s badge being a vehicle which, immediately before or after any period of waiting allowed by virtue of a provision of a kind required by the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000 to be included in an order under the Act, has been or is to be used for carrying disabled persons as passengers;
  • “delivering” and “collecting” in relation to postal packets includes checking the goods for the purposes of their delivery or collection;
  • "driver" in relation to a vehicle waiting in a loading  parking place means the   driving the vehicle at the time it was left in the loading parking place.
  • "goods" means goods of any kind whether animate or inanimate and includes postal packets of any description and "delivering and collecting" in relation to any goods includes checking the goods for the purpose of their delivery or collection.
  • "goods vehicle" means a motor vehicle constructed or adapted for use for the carriage of goods or burden of any description or a trailer so constructed or adapted;
  • “limited waiting parking place” means the area of road specified in Schedule 7 to this Order to be used as a parking place and unless otherwise so specified bounded on one side by the edge of the carriageway and on the other side by a road marking complying with Diagram 1028.4 of Schedule 7, Part 4, of the Traffic Signs Regulations and General Directions 2016;
  • "loading parking place" means the areas of road specified in Schedules 4 and 5 to this Order to be used as a parking place for the purpose of loading and unloading of goods and, unless otherwise so specified, bounded on one side by the edge of the carriageway and on the other by a road marking complying with Diagram 1028.4 in Schedule 7, Part 4 to the Traffic Signs Regulations and General Directions 2016;
  • “parking disc” means a disc, issued by a local authority, 125 millimetres square, coloured blue and capable of showing the quarter hour period during which a period of waiting begins, which has not ceased to be valid.
  • “owner” in relation to a vehicle means the person by whom such a vehicle is kept and used;
  • "trailer" means any vehicle other than a motor vehicle;
  • "school entrance" means the length of road in the City of Manchester specified in Schedule 10 to this Order which is marked with the road marking complying with Diagram 1027.1 in Schedule 6 to the Traffic Signs Regulations and General Directions 2002.
  • ‘driver’ in relation to a vehicle waiting in an electric vehicle recharging parking place means the person driving the vehicle at the time when it was left in the electric vehicle recharging parking place;
  • ‘electric vehicle’ means a vehicle in which the electrical motive power is derived from an internal electrical storage battery that can be plugged into mains electricity for the purpose of recharging the said battery and shall include any vehicle that is so powered in part by such a battery, including plug-in hybrid and extended-range electric vehicles;
  • ‘electric vehicle recharging point’ means equipment situated adjacent to an electric vehicle recharging ticket parking place that supplies electric energy for recharging the battery of electric vehicles via connection to an electric cable;
  • ‘electric vehicle recharging parking place’ means the area of road designated as such by Article 52 of this Order and as specified in Schedule 11 to this Order;
  • ‘recharging’ in relation to an electric vehicle means an electric vehicle which is connected by electric cable to an electric vehicle recharging point situated adjacent to an electric vehicle recharging ticket parking place specified in Schedule 11 to this Order for the purpose of recharging the battery of the electric vehicle;

For the purpose of this Order a vehicle shall be regarded as displaying:

  • a disabled person’s badge in the relevant position if:
    • the badge is exhibited on the dashboard or facia of the vehicle, or
    • where the vehicle is not fitted with a dashboard or facia, the badge is exhibited in a conspicuous position on the vehicle,
    • so that the front of the badge is clearly legible from the outside of the vehicle;
  • a parking disc in the relevant position if:
    • the disc is exhibited on the dashboard or facia of the vehicle; or
    • where the vehicle does not have a dashboard or facia, the disc is exhibited in a conspicuous position on the vehicle,
    • so that, when marked to show the quarter-hour period during which a period of waiting began, that period is clearly legible from the outside of the vehicle.

The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

Amendment to the existing order

  • The Orders specified in Schedule 1 to this Order are amended to the extent as specified in Schedule 1 to this Order.

No waiting at any time

  • Save as provided in Article 5 of this Order no person shall, except upon the direction or with the permission of a constable in uniform or a civil enforcement officer cause or permit any vehicle to wait at any time on the lengths of road specified the Schedule 2 to this Order.

No loading at any time

  • Nothing in Article 5 of this Order shall permit any person to cause or permit a vehicle to wait to enable goods to be loaded on to or from the vehicle at any time in the lengths of road specified in Schedule 3 to this Order

Exemptions from prohibitions and restrictions - general exemptions

Nothing in Article 4 and 5 of this Order shall prevent any person from causing or permitting any vehicle to wait on the lengths of road referred to in that Article for so long as may be necessary to enable:

  • a person to board or alight from the vehicle;
  • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in connection with any of the following operations, namely:
    • building, industrial or demolition operations;
    • the removal of any obstruction to traffic;
    • the maintenance, improvement or reconstruction of the said side of length of road; or
    • the laying, erection, alteration or repair, in or on land adjacent to the said lengths of road, of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus defined in the Communication Act 2003;
  • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in the service of a local authority or a water authority in pursuance of statutory powers or duties;
  • the vehicle to be used for the purpose of delivering or collecting postal packets as defined in the Postal Services Act 2000;
  • the vehicle to take in petrol, oil, water or air from any garage situated on or adjacent to the said side of length of road;
  • the vehicle to wait at or near to any premises situated on or adjacent to the said lengths of road for so long as such waiting by that vehicle is reasonably necessary in connection with any funeral;
  • the vehicle to be used for fire brigade, ambulance or police purposes; or
  • goods to be loaded on to or unloaded from the vehicle

Exemption for loading and unloading 

Nothing in Article 3 of this Order shall prevent any person from causing or permitting any vehicle to wait in any length of road specified in Schedule 2 to this Order for so long as may be necessary to enable goods to be loaded on to or unloaded from the vehicle provided always that no such vehicle may wait for the purpose of loading and unloading:

  • at any time in the lengths of road specified in Schedule 3 to this Order

Exemption for disabled persons’ vehicles

Nothing in Article 3 of this Order shall prevent any person to cause or permit a disabled person's vehicle which displays in the relevant position a disabled person's badge, and a parking disc (on which the driver or other person in charge of the vehicle, has marked the time at which the period of waiting began) to wait on the length of road referred to in that Article for a period not exceeding three hours (not being a period separated by an interval of less than one hour from a previous period of waiting by the same vehicle on the same length of road on the same day) provided always that no such vehicle shall so wait.

  •  at any time in the lengths of road specified in Schedule 3 to this Order

Authorisation and use of loading parking places

  • Each area of road specified in Schedules 4 and 5 to this Order is authorised to be used, subject to the following provisions of this Order, as a loading parking place for use by such classes of vehicles, in such positions, on such days and during such hours and within such time limits as is specified in Schedules 4 and 5 to this Order.
  • Save as provided in Article 18 of this Order where in Schedules 4 and 5 to this Order a loading parking place is described as being available for use by such classes of vehicle or in a specified position the driver of the vehicle is only entitled to wait in the length of road specified in Schedules 4 and 5 to this Order if it is:
    • of the specified class; and
    • it is waiting for the purpose of continuous loading and unloading in connection with any trade or business situated in the road in which the said parking place is located; and
    • is in position wholly within the limits of the loading parking place.
  • The use of a loading parking place otherwise than in accordance with the provisions of this Order is a parking contravention.

Conditions of use of loading parking place

  • The driver of a vehicle shall not use a loading parking place so as to unreasonably prevent access to any premises adjoining the road or the use of the road by any other person, or so as to be a nuisance.
  • The driver of a motor vehicle using a loading parking place shall stop the engine as soon as the vehicle is in position in the parking place and shall not start the engine again except when about to change the position of the vehicle in or to depart from that parking place.
  • No person shall use the vehicle whilst it is in a loading parking place in connection with the sale of any article to persons in or near the loading parking place or in connection with the selling or offering for hire of his skill or services.

Removal of vehicle from loading parking place

  • When a vehicle is left in a loading parking place in contravention of the provisions of this Order, a person authorised in that behalf by the Council may remove the vehicle or arrange for it to be removed from the loading parking place: provided that when a vehicle is waiting in a loading parking place in contravention of the provisions of Article 10 (c) of this Order, a person authorised in that behalf may alter or cause to be altered the position of the vehicle in order that it shall comply with that provision.
  • Any person removing the vehicle or altering its position by virtue of the proceeding Article of this Order, may do so by towing or driving the vehicle or in such other manner as he may think fit and take such measures in relation to the vehicle as he may think necessary to enable him to remove it or alter its position as the case may be.
  • When a person removes or makes arrangements for the removal of a vehicle from a loading parking place by virtue of Article 14 of this Order, he shall make such arrangements as may be reasonably necessary for the safe custody of the vehicle.
  • Any person authorised in that behalf by the council may in the case of emergency move or cause to be moved to any place he thinks fit any vehicle left in a loading parking place.

Exemptions

Notwithstanding the foregoing provisions of this Order, any vehicle may wait in any part of the loading parking place, if the use has not been suspended and:

  • the vehicle is waiting only for so long as may be necessary to enable a person to board or alight from the vehicle;
  • the vehicle is waiting owing to the driver being prevented from proceeding by circumstances beyond his control or to such waiting being necessary in order to avoid an accident.
  • the vehicle is being used for fire brigade, ambulance or police purposes or is being used in the service of a local authority in pursuance of statutory powers or duties.
  • the vehicle is waiting only for so long as may be necessary to enable it to be used in connection with the removal of any obstruction to traffic or
  • the vehicle is waiting:
    • while postal packets addressed to premises adjacent to the loading parking place in which the vehicle is waiting are being unloaded from the vehicle or having been unloaded therefrom are being delivered or
    • while postal packets are being collected or loading on the vehicle from premises or posting boxes adjacent to the loading parking place in which the vehicle is waiting or having been so collected are being loaded thereon;
  • in connection with any building operation or demolition in or adjacent to the loading parking place, the maintenance, cleansing, improvement or reconstruction of the roads authorised to be used as loading parking places or the laying, erection, alteration or repair in or adjacent to any of the said loading parking places of any sewer or of any main pipe or apparatus for the supply of gas, water, electricity or of any telecommunications apparatus as defined in the Communications Act 2003.

Suspensions 

Any person authorised by the council, or a constable in uniform may suspend, subject to such conditions or exceptions as he considers appropriate, the use of a loading parking place or any part thereof, whenever he considers such suspension reasonably necessary:

  • for the purpose of facilitating the movement of traffic or promoting its safety.
  • for the convenience of the occupiers of premises adjacent to the loading parking place on the occasion of:
    • the removal of furniture from one building to another; or
    • at times of weddings or funerals;
  • for any special occasion, except for wedding and funerals, or on any occasion on which it is likely by reason of some special attraction that any street would be thronged or obstructed;
  • for any of the purposes specified in Article 18 (f) of this Order.
  • Any person suspending the use of a loading parking place or any part therefore in accordance with the provisions of Article 19 of this Order, shall thereupon place or cause to be placed in or adjacent to the loading parking place or any part thereof, use of which is suspended, a traffic sign indicating that waiting by vehicles is not permitted.
  • No person shall cause or permit a vehicle to be left in a loading parking place or any part thereof, as the case may be during such period as there is in or adjacent to the loading parking place a traffic sign placed in pursuance of Article 20 of this Order.

Authorisation of disabled persons parking place

  • Each area of road specified in Schedule 6 to this Order is authorised to be used, subject to the following provisions of this Order, as a disabled person’s parking place for use by such classes of vehicles, in such positions, on such days and during such hours as are specified in relation to that part of road in Schedule 6 to this Order.
  • Save as provided in Article 32 to this Order where in Schedule 6 to this Order a disabled person’s parking place is described as available for use by such classes of vehicle or in a specified position, the driver of the vehicle is only entitled to wait in the length of road specified in Schedule 6 to this Order if it is:
    • of the specified class; and
    • it is in a position wholly within the limits of the parking place.
  • The use of a disabled persons parking place otherwise than in accordance with the provisions of this Order is a parking contravention.

Conditions of use of disabled person’s parking place

  • The driver of a vehicle shall not use a disabled person’s parking place so as to unreasonably prevent access to any premises adjoining the road, or the use of the road by any other person, or so as to be a nuisance.
  • The driver of a motor vehicle using a disabled person’s parking place shall stop the engine as soon as the vehicle is in position in the parking place and shall not start the engine except when about to change the position of the vehicle in or to depart from the parking place.
  • No person shall use the vehicle whilst it is in a disabled person’s parking place in connection with the sale of any article to persons in or near the parking place or in connection with the selling or offering for hire of his skill or services.

Removal of vehicle from disabled person’s parking place

  • When a vehicle is left in a disabled person’s parking place in contravention of any of the provisions of Article 23 of this Order a person authorised in that behalf may remove the vehicle or arrange for it to be removed from that parking place: Provided that when a vehicle is waiting in a disabled person’s parking place in contravention of the provisions of Article 23(b) of this Order, a person authorised in that behalf may alter or cause to be altered the position of the vehicle in order that its position shall comply with that provision.
  • Any person removing the vehicle or altering its position by virtue of the last preceding Article of this Order may do so by towing or driving the vehicle or in such other manner as he may think necessary and may take such measures in relation to the vehicle as he may think necessary to enable him to remove it or alter its position as the case may be.
  • When a person removes or makes arrangements for the removal of a vehicle from a disabled person’s parking place by virtue of Article 28 of this Order he shall make such arrangements as may be reasonably necessary for the safe custody of the vehicle.

Exemptions

  • Nothing in this Order shall prevent any person to cause or permit any vehicle to wait in a disabled person’s parking place for so long as may be necessary in connection with any building operation or demolition in or adjacent to the said parking place, the removal of any obstruction to traffic, the maintenance, cleansing, improvement or reconstruction of the part of road authorised to be used as parking place or the laying, erection, alteration or repair in or adjacent to the said parking place of any sewer or of any main pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus as defined in the Communications Act 2003.

Suspensions

Any person authorised by the council, or a constable in uniform may suspend, subject to such conditions or exceptions as he considers appropriate, the use of a disabled person’s parking place or any part thereof, whenever he considers such suspension reasonably necessary:

  • for the purpose of facilitating the movement of traffic or promoting its safety.
  • for the convenience of the occupiers of premises adjacent to the disabled person’s parking place on the occasion of:
    • the removal of furniture from one building to another; or
    • at times of weddings or funerals
  • for any special occasion, except for wedding and funerals, or on any occasion on which it is likely by reason of some special attraction that any street would be thronged or obstructed;
  • for any of the purposes specified in Article 31 of this Order.
  • Any person suspending the use of a disabled person’s parking place or any part therefore in accordance with the provisions of Article 32 of this Order, shall thereupon place or cause to be placed in or adjacent to the disabled person’s parking place or any part thereof, use of which is suspended, a traffic sign indicating that waiting by vehicles is not permitted.
  • No person shall cause or permit a vehicle to be left in a disabled person’s parking place or any part thereof, as the case may be during such period as there is in or adjacent to the disabled person’s parking place a traffic sign placed in pursuance of Article 32 of this Order.

Authorisation and use of limited waiting parking places

  • Each area of road specified in Schedules 7, 8 and 9 to this Order is authorised to be used as a Limited Waiting Parking Place for use by such classes of vehicles, in such positions on such days and during such hours and within such time limits as is specified in Schedule 7, 8 and 9 to this Order.
  • Save as provided in Article 45 of this Order where in Schedules 7, 8 and 9 to this Order a Limited Waiting Parking Place is described as available for vehicles of a specified class or in a specified position the Driver of a vehicle is only entitled to wait in the length of road specified in Schedules 7, 8 and 9 to this Order:
    • if it is of the specified class; and
    • is in position wholly within the limits of the limited waiting parking place.
  • The use of a Limited Waiting Parking Place otherwise than in accordance with the provisions of Article 36 of this Order is a parking contravention.

Conditions of use of limited waiting parking place

  • The Driver of a vehicle shall not use a Limited Waiting Parking place so as to unreasonably prevent access to any premises adjoining the road or the use of the road by any other person, or so as to be a nuisance.
  • The Driver of a motor vehicle using a Limited Waiting Parking Place shall stop the engine as soon as the vehicle is in position in the said parking place and shall not start the engine again except when about to change the position of the vehicle in or to depart from the said parking place.
  • No person shall use the vehicle whilst it is in a Limited Waiting Parking Place in connection with the sale of any article to persons or near the said parking place or in connection with the selling or offering for hire of his skill or services.
  • When a vehicle is left in a Limited Waiting Parking Place in contravention of the provisions of this Order, a person authorised in that behalf by the council may remove the vehicle or arrange for it to be removed from the said parking place: provided that when a vehicle is waiting in the parking place in contravention of the provisions of Article 36(b) of this Order, a person authorised in that behalf may alter or cause to be altered the position of the vehicle in order that it shall comply with that provision.
  • Any person removing the vehicle or altering its position by virtue of the preceding Article of this Order, may do so by towing or driving the vehicle or in such other manner as he may think fit and take such measures in relation to the vehicle as he may think necessary to enable him to remove it or alter its position as the case may be.
  • When a person removes or makes arrangements for the removal of a vehicle from a Limited Waiting Parking Place by virtue of Article 41 of this Order, he shall make such arrangements as may be reasonably necessary for the safe custody of the vehicle.
  • Any person authorised in that behalf by the council may in the case of emergency move or cause to be moved to any place he thinks fit any vehicle left in a Limited Waiting Parking Place.

Exemptions – general

Notwithstanding the foregoing provisions of this Order, any vehicle may wait in any part of the Limited Waiting Parking Place, if the use has not been suspended and:

  • the vehicle is waiting only for so long as may be necessary to enable a person to board or alight from the vehicle;
  • the vehicle is waiting owing to the Driver being prevented from proceeding by circumstances beyond his control or to such waiting being necessary in order to avoid an accident;
  • the vehicle is being used for fire brigade, ambulance or police purposes or is being used in the service of a local authority in pursuance of statutory powers or duties;
  • the vehicle is waiting only for so long as may be necessary to enable it to be used in connection with the removal of any obstruction to traffic or
  • the vehicle is waiting:
    • while postal packets addressed to premises adjacent to the said parking place in which the vehicle is waiting are being unloaded from the vehicle or having been unloaded therefrom are being delivered; or
    • while postal packets are being collected for loading on the vehicle from premises or posting  boxes adjacent to the said parking place in which the vehicle is waiting or having been so collected are being loaded thereon;
  • in connection with any building operation or demolition in or adjacent to the said parking place, the maintenance, cleansing, improvement or reconstruction of the roads authorised to be used as Limited Waiting Parking Place or the laying, erection, alteration or repair in or adjacent to any of the said Limited Waiting Parking Place of any sewer or of any main pipe or apparatus for the supply of gas, water, electricity or of any telecommunications apparatus as defined in the Communications Act 2003.

Exemption for disabled persons vehicles

  • Nothing in Article 35 shall apply to a Disabled Person’s Vehicle displaying in the relevant position a valid Disabled Person’s Badge.

Suspensions 

Any person authorised by the council, or a constable in uniform may suspend, subject to such conditions or exceptions as he considers appropriate, the use of a Limited Waiting Parking Place or any part thereof, whenever he considers such suspension reasonably necessary:

  • for the purpose of facilitating the movement of traffic or promoting its safety.
  • for the convenience of the occupiers of premises adjacent to the said parking place on the occasion of:
    • the removal of furniture from one building to another; or
    • at times of weddings or funerals;
  • for any special occasion, except for weddings and funerals, or on any occasion on which it is likely by reason of some special attraction that any street would be thronged or obstructed;
  • for any of the purposes specified in Article 45(f) of this Order.
  • Any person suspending the use of a Limited Waiting Parking Place or any part thereof in accordance with the provisions of Article 47 of this Order, shall thereupon place or cause to be placed in or adjacent to said parking place or any part thereof, use of which is suspended, a traffic sign indicating that waiting by vehicles is not permitted.
  • No person shall cause or permit a vehicle to be left in a Limited Waiting Parking Place or any part thereof, as the case may be during such period as there is in or adjacent to the said parking place a traffic sign placed in pursuance of Article 48 of this Order.

No stopping outside school entrance

  • Save as provided in Article 51 to this Order no person shall cause or permit any vehicle to stop between the hours of 8am and 5pm on Monday to Friday on the school entrance specified in Schedule 10 to this Order outside the school specified in Schedule 10 to this Order.

General exemptions – no stopping outside school entrances

Nothing in Article 50 of this Order shall prevent any person from causing or permitting any vehicle to stop on the school entrance specified in that Article so far as such stopping is reasonably necessary for the vehicle to be used for the following purposes:

  • the removal of any obstruction to traffic
  • police, fire brigade or ambulance purposes
  • in pursuance of statutory powers or duties
  • the maintenance, improvement or reconstruction of the length of road comprised of the school entrance or the laying, erection, alteration or repair in or adjacent to the said school entrance or of any sewer, main, pipe or apparatus for the supply of gas, water, electricity or any telecommunication apparatus as defined in Communication Act 2003

Designation of electric vehicle recharging parking places

  • Each area of road specified in Schedule 11 to this Order is authorised to be used as an Electric Vehicle Recharging Parking Place for use by such classes of vehicles, in such positions on such days and during such hours and within such time limits as is specified in Schedule 11 to this Order.

Number and situation of electric vehicle recharging parking places

  • The number of electric vehicle recharging parking bays in each electric vehicle recharging parking place referred to in Schedule 11 to this Order shall not exceed the number specified in Schedule in relation to the electric vehicle recharging parking place.

Manner of standing in electric vehicle recharging parking places

  • Every electric vehicle left in an electric vehicle recharging parking place specified in Schedule 11 to this Order in accordance with the foregoing provisions of this Order shall so stand in accordance with the provision set out in Schedule 11 to this order.

Removal of vehicles and electric vehicles from electric vehicle recharging ticket parking places

  • Where a police constable in uniform, a civil enforcement officer or a person authorised on that behalf by the Council is of the opinion that any of the provisions contained in this Order have been contravened or not complied with in respect of an electric vehicle left in an electric vehicle recharging parking place specified in Schedule 11 to this Order he may remove or cause to be removed an electric vehicle from such electric vehicle recharging parking place and where it is so removed shall provide for the safe custody of the electric vehicle.

Movement of electric vehicle from electric vehicle recharging parking places in an emergency

  • A police constable in uniform, a civil enforcement officer or a person authorised by the council in that behalf may move or cause to be moved in the case of an emergency to any place he thinks fit any vehicle or an electric vehicle left in an electric vehicle recharging parking place specified in Schedule 11 to this Order.

Power to suspend use of electric vehicle recharging parking places

(1) Any person duly authorised by the council may subject to such conditions or exceptions as he considers appropriate suspend the use of an electric vehicle recharging parking place specified in Schedule 11 this Order or any part thereof whenever he considers such suspension reasonably necessary:

  • for the purpose of the maintenance improvement or reconstruction of the road or the cleansing of gullies in or adjacent to the electric vehicle recharging parking place, the laying, erection, alteration, removal or repair in or adjacent to the parking place of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus or the placing, maintenance or removal of any traffic sign or other street furniture
  • for the convenience of occupiers of premises adjacent to the electric vehicle recharging parking place at times of weddings or funerals
  • for the convenience of occupiers of premises adjacent to the electric vehicle recharging parking place on any occasion of the removal of furniture to or from one office or dwelling house adjacent to the electric vehicle recharging parking place from or to a depository another office or dwelling house
  • for any special occasion, except for weddings or funerals, or on any occasion on which it is likely by reason of some special attraction that any street would be thronged or obstructed
  • for the loading and unloading of vehicles at premises adjacent or near to the electric vehicle recharging parking place providing access to premises is maintained
  • for the purpose of facilitating the movement of traffic or promoting its safety
  • for the parking of statutory undertakers' vehicles during periods when they are not actively required for street works
  • for the purpose of any building operation, demolition or excavation adjacent to the electric vehicle recharging parking
  • to enable a temporary licensed street traders’ area to be established
  • for television and filming purposes.

A police constable in uniform may suspend the use of an electric vehicle recharging parking place specified in Schedule 11 to this Order or any part thereof for the same categories of suspension as are available to the council provided that once this period has elapsed no further suspension may be made so as to affect any electric vehicle recharging ticket parking place affected by the previous suspension unless the council so agrees.

Any person suspending the use of an electric vehicle recharging parking place or any part thereof in accordance with this Article shall thereupon:

  • place or cause to be placed in or adjacent to any part of the electric vehicle recharging parking place which is not a parking bay and the use of which is suspended a traffic sign indicating that waiting by electric vehicles is prohibited.
  • No person shall cause or permit an electric vehicle to wait:
    • in an electric vehicle recharging ticket parking bay during such period during such a period as there is in or adjacent to that bay an appropriate traffic sign placed in pursuance of paragraph (3) of this Article
  • in any part of an electric vehicle recharging ticket parking place not being a parking bay during such a period as there is in or adjacent to that part of such parking place a traffic sign placed in pursuance of paragraph (3)(a) of this Article

Restriction of use of electric vehicle recharging parking places

(1) The driver of an electric vehicle shall not use an electric vehicle recharging ticket parking place specified in Schedule 11 to this Order so as to prevent access to any premises adjoining a road or the use of a road by other persons or so as to be a nuisance

(2) No person shall carry out upon any electric vehicle while it is in an electric vehicle recharging ticket parking place specified in Schedule 11 to this Order any work of construction cleaning maintenance or repair except such as may be necessary to enable the electric vehicle to be moved from an electric vehicle recharging parking place.

Schedule 1 - Amendment to the Existing orders
