Schofield Road and Hallsworth Road area

Salford City Council proposes to make the following Orders under the Road Traffic Regulation Act 1984. The titles and effect of the Orders will be as follows:

City of Salford (Hallsworth Road Area, Salford) (20 Mph Speed Limit) Order 2023

The proposed Order shall prohibit any person driving any motor vehicle at a speed exceeding 20mph on Schofield Road, Moat Hall Avenue, Hallsworth Road, Adopted Hallsworth Road Passage S/O Moat House Sports Centre, Barton Hall Avenue, Evans Road, Gorton Street, Ampney Close and Redmans Close for their entire length. An Existing Order is to be revoked so as to be consistent with the proposals.

No Waiting at Any Time on:

Hallsworth Road

  • Both sides from the extended kerbline of Hallsworth Road 5m easterly
  • East side, from the extended southern kerbline of Hallsworth Road for 36.6m southerly
  • West side, from the adoption boundary at Hallsworth Road Passage to a point 7m south from the southern entry to Hallsworth Road cul-de-sac end.
  • Cul De Sac End – both sides from the extended western kerbline of Hallsworth Road for 10m Westerly
  • Adopted Hallsworth Road Passage S/O Moat House Sports Centre - both sides from the adoption boundary at Hallsworth Rd Passage for a distance of 22.6m westerly

City of Salford (Hallsworth Road Area Salford) (20 Mph Speed Limit Zone) Order 2023

Salford City Council in exercise of its powers under Sections 82 and 84 of the Road Traffic Regulation Act 1984 (hereinafter called "the Act") and of all other enabling powers and of all other enabling powers and after consultation with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act, hereby makes the following Order:

Interpretation

In this Order:

  • "Special Forces" means those units of the armed forces of the Crown the maintenance of whose capabilities is the responsibility of the Director of Special Forces or which are for the time being subject to the operational command of that Director.

The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

20mph speed limit zone

  • The roads specified in the Schedule to this Order shall cease to be restricted roads for the purposes of section 81 of this Act.
  • No person shall drive any motor vehicle at a speed exceeding 20 miles per hour on the lengths of road specified in the Schedule to this Order.
  • No speed limit imposed by this Order applies to the vehicles falling within Regulation 3(4) of the Road Traffic Exemptions (Special Forces) (Variation and Amendment) Regulations 2011 when used in accordance with Regulation 3(5) of those Regulations.

City of Salford (Hallsworth Road Area, Barton and Winton) (Prohibition of Waiting and Revocation) Order 2023

Salford City Council in exercise of its powers under Sections 1(1), 2(1) to (3) and 4(2), 32 (1) and 35(1) of the Road Traffic Regulation Act 1984 ("the Act"), and Part IV of Schedule 9 to the Act and of all other enabling powers and after consultation with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act, hereby makes the following Order:

Interpretation

In this Order:

  • “Disabled Person’s Badge” has the same meaning as in The Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000;
  • “Disabled Person’s Vehicle” means a vehicle lawfully displaying a disabled person’s badge being a vehicle which, immediately before or after any period of waiting allowed by virtue of a provision of a kind required by the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000 to be included in an order under the Act, has been or is to be used for carrying disabled persons as passengers;
  • “Parking Disc” means a disc, issued by a local authority, 125 millimetres square, coloured blue and capable of showing the quarter hour period during which a period of waiting begins, which has not ceased to be valid.

For the purpose of this Order a vehicle shall be regarded as displaying:

  • a Disabled Person’s Badge in the relevant position if:
    • the badge is exhibited on the dashboard or facia of the vehicle, or
    • where the vehicle is not fitted with a dashboard or facia, the badge is exhibited in a conspicuous position on the vehicle,
    • so that the front of the badge is clearly legible from the outside of the vehicle;
  • a Parking Disc in the relevant position if:
    • the disc is exhibited on the dashboard or facia of the vehicle; or
    • where the vehicle does not have a dashboard or facia, the disc is exhibited in a conspicuous position on the vehicle,
    • so that, when marked to show the quarter-hour period during which a period of waiting began, that period is clearly legible from the outside of the vehicle.
  • The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

Amendment to the existing order

  • The Order specified in Schedule 1 to this Order is revoked in its entirety.

No waiting at any time

  • Save as provided in Article 4 of this Order no person shall, except upon the direction or with the permission of a constable in uniform or a civil enforcement officer cause or permit any vehicle to wait at any time on the lengths of road specified in Schedule 2 to this Order.

Exemption from prohibition – general exemptions

Nothing in Article 3 of this Order shall prevent any person to cause or permit any vehicle to wait on the lengths of road referred to in that Article for so long as may be necessary to enable:

  • a person to board or alight from the vehicle;
  • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in connection with any of the following operations, namely:
    • building, industrial or demolition operations;
    • the removal of any obstruction to traffic;
    • the maintenance, improvement or reconstruction of the said length of road;  or
    • the laying, erection, alteration or repair, in or on land adjacent to the said length of road, of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus defined in the Telecommunications Act 1984;
  • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in the service of a local authority or a water authority in pursuance of statutory powers or duties;
  • the vehicle to be used for the purpose of delivering or collecting postal packets as defined in the Postal Services Act 2000;
  • the vehicle to take in petrol, oil, water or air from any garage situated on or adjacent to the said side of length of road;
  • the vehicle to wait at or near to any premises situated on or adjacent to the said length of road for so long as such waiting by that vehicle is reasonably necessary in connection with any funeral;
  • the vehicle to be used for fire brigade, ambulance or police purposes; or
  • goods to be loaded on to or unloaded from the vehicle.

Exemption for disabled persons’ vehicles

  • Nothing in Article 3 of this Order shall prevent any person to cause or permit a Disabled Person's Vehicle which displays in the relevant position a Disabled Person's Badge, and a Parking Disc (on which the driver or other person in charge of the vehicle, has marked the time at which the period of waiting began) to wait on the lengths of road referred to in that Article for a period not exceeding 3 hours (not being a period separated by an interval of less than 1 hour from a previous period of waiting by the same vehicle on the same length of road on the same day).

Hallsworth Road

  • both sides, from the extended eastern kerbline of Hallsworth Road for a distance of 5 metres in an easterly direction.
  • east side, from the extended southern kerbline of Hallsworth Road for a distance of 36.6m in a southerly direction.
  • west side, from the adoption boundary at Hallsworth Road Passage to a point 7m south from the southern entry to Hallsworth Road cul-de-sac end.

Hallsworth cul-de-sac end

  • both sides, from the extended western kerbline of Hallsworth Road for a distance of 10 metres in a westerly direction

Adopted Hallsworth Road Passage S/O Moat House Sports Centre                                                       

  • both sides, from the adoption boundary at Hallsworth Road Passage for a distance of 22.6 metres in a westerly direction

Statement of Reasons

A new housing development off Hallsworth Road (old Moat Hall Sport Centre) requires introduction of new Traffic Regulation Orders.

It has been proposed to introduce double yellow lines at the entry to the development.

It is therefore proposed to introduce new double yellow lines at the entry to the development. It is also proposed to extend the double yellow lines on the Adopted Hallsworth Road Passage, covering the Salford City Roosters’ car park entrance. This is to make sure that the car park entrance and the new footway is kept clear at all times.

It is necessary to introduce waiting restrictions at the entrance to the new development to keep the junction clear of parked vehicles. The existing restrictions will be maintained to help bin wagons service the area at the cul-de-sac end. In addition to maintain a consistent approach waiting restrictions should be introduced at the bend and entry to the car park, to keep safe movement of vehicles. This package of restrictions will create a safer environment for all road users.

In line with Salford City Council’s policy of introducing 20mph speed limit on all residential roads, it is also proposed to implement a 20mph speed limit in the area.

The proposed 20mph speed limits will reduce vehicle speeds and thus improve Road Safety.
