Swinton Hall Road area

Salford City Council proposes to make the City of Salford (Swinton Hall Road Area, Swinton Park) (Prohibition of Waiting) Order 2023 under the Road Traffic Regulation Act 1984. The effect of the proposed order will be to introduce the following provisions:

No Waiting at Any Time:

Swinton Hall Road

  • South and east from a point 78m south east from the extended south east kerbline of Dawson Street in a south east direction for 16m and north east direction for 20m.
  • North and west from a point 78m south east from the extended south east kerbline of Dawson Street in a south east and north east direction for a distance of 18m.
  • North from 10m north west from the extended north west kerbline of Dawson Street to a point 10m south east from the extended south east kerbline of Dawson Street.
  • Both sides from the south west extended kerbline of Albion Street in a south east direction for 10m.
  • Both sides from the north east extended kerbline of Albion Street in a north east direction for 10m.

Dawson street

  • West from its junction with the Swinton Hall Road in a north east direction for a 10m.
  • East from its junction with the Swinton Hall Road in a north east direction for 30m.
  • Both sides from its junction with Albion Street in a south west direction for a distance of 10m.

Hope Street

  • Both sides from its junction with Bridge Street in a north west direction for 10m.

Bridge Street

  • West from the south extended kerbline of Lottie Street in a south west direction for 10m.
  • East from a point 16m south west from the extended south west kerbline of Albion Street to a point 10m north east from the extended north east kerbline of Albion Street.
  • West from 10m south west from the extended south west kerbline of Hope Street to 18m north east from the extended north east kerbline of Hope Street.

Lottie Street

  • South from its junction with Bridge Street in a north west direction to the end of the Lottie Street.

Albion Street

  • Both sides from its junction with Bridge Street in a south east direction for 10m.
  • South from a point 10m north west from the extended north west kerbline of Dawson Street to a point 10m south east from the extended south east kerbline of Dawson Street.
  • Both sides from its junction with Swinton Hall Road in a north west direction for 10m.

Old Mill Close

  • Both sides from its junction with Swinton Hall Road in a south east direction for 10 metres.

City of Salford (Swinton Hall Road Area, Swinton Park) (Prohibition of Waiting) Order 2023

Salford City Council in exercise of its powers under Sections 1(1), 2(1) to (3) and 4(2) of the Road Traffic Regulation Act 1984 ("the Act") and Part lV of Schedule 9 to the Act, and of all other enabling powers and after consultation with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act, hereby makes the following Order: 

Interpretation

In this Order:

  • “disabled person’s badge” has the same meaning as in The Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000;
  • “disabled person’s vehicle” means a vehicle lawfully displaying a disabled person’s badge being a vehicle which, immediately before or after any period of waiting allowed by virtue of a provision of a kind required by the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000 to be included in an order under the Act, has been or is to be used for carrying disabled persons as passengers;
  • “delivering” and “collecting” in relation to postal packets includes checking the goods for the purposes of their delivery or collection:
  • “parking disc” means a disc, issued by a local authority, 125 millimetres square, coloured blue and capable of showing the quarter hour period during which a period of waiting begins, which has not ceased to be valid.

For the purpose of this Order a vehicle shall be regarded as displaying:

  • a disabled person’s badge in the relevant position if:
    • the badge is exhibited on the dashboard or facia of the vehicle, or
    • where the vehicle is not fitted with a dashboard or facia, the badge is exhibited in a conspicuous position on the vehicle, so that the front of the badge is clearly legible from the outside of the vehicle;
  • a parking disc in the relevant position if:
    • the disc is exhibited on the dashboard or facia of the vehicle; or
    • where the vehicle does not have a dashboard or facia, the disc is exhibited in a conspicuous position on the vehicle, so that, when marked to show the quarter-hour period during which a period of waiting began, that period is clearly legible from the outside of the vehicle.
  • The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

No Waiting At Any Time

  • Save as provided in Article 3 of this Order no person shall, except upon the direction or with the permission of a constable in uniform, a civil enforcement officer cause or permit any vehicle to wait at any time on the lengths of road specified the Schedule to this Order.

Exemptions From Prohibitions And Restrictions - General Exemptions

Nothing in Article 2 of this Order shall prevent any person from causing or permitting any vehicle to wait on the lengths of road referred to in that Article for so long as may be necessary to enable:

  • a person to board or alight from the vehicle;
  • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in connection with any of the following operations, namely:
    • building, industrial or demolition operations;
    • the removal of any obstruction to traffic;
    • the maintenance, improvement or reconstruction of the said side of length of road; or
    • the laying, erection, alteration or repair, in or on land adjacent to the said lengths of road, of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus defined in the Communication Act 2003;
  • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in the service of a local authority or a water authority in pursuance of statutory powers or duties;
  • the vehicle to be used for the purpose of delivering or collecting postal packets as defined in the Postal Services Act 2000;
  • the vehicle to take in petrol, oil, water or air from any garage situated on or adjacent to the said side of length of road;
  • the vehicle to wait at or near to any premises situated on or adjacent to the said lengths of road for so long as such waiting by that vehicle is reasonably necessary in connection with any funeral;
  • the vehicle to be used for fire brigade, ambulance or police purposes.

Exemption For Disabled Persons’ Vehicles

  • Nothing in Article 2 of this Order shall prevent any person to cause or permit a Disabled Person's Vehicle which displays in the relevant position a Disabled Person's Badge, and a Parking Disc (on which the driver or other person in charge of the vehicle, has marked the time at which the period of waiting began) to wait on the length of road referred to in that Article for a period not exceeding three hours (not being a period separated by an interval of less than 1 hour from a previous period of waiting by the same vehicle on the same length of road on the same day).

Swinton Hall Road

  • South and east from a point 78 metres south east from the extended south eastern kerbline of Dawson Street in a south easterly direction for a distance of 16 metres and then north easterly direction for a distance of 20 metres.
  • North and west from a point 78 metres south east from the extended south eastern kerbline of Dawson Street in a south easterly and then north easterly direction for a distance of 18 metres.
  • North from a point 10 metres north west from the extended north western kerbline of Dawson Street to a point 10 metres south east from the extended south eastern kerbline of Dawson Street.
  • Both sides from the south western extended kerbline of Albion Street in a south easterly direction for a distance of 10 metres.
  • Both sides from the north eastern extended kerbline of Albion Street in a north easterly direction for a distance of 10 metres.

Dawson Street

  • West from its junction with the Swinton Hall Road in a north easterly direction for a distance of 10 metres.
  • East from its junction with the Swinton Hall Road in a north easterly direction for a distance of 30 metres.
  • Both sides from its junction with Albion Street in a south westerly direction for a distance of 10 metres.

Bridge Street

  • West from the southern extended kerbline of Lottie Street in a south westerly direction for a distance of 10 metres.
  • West from a point 10 metres south west from the extended south western kerbline of Hope Street to a point 18 metres north east from the extended north eastern kerbline of Hope Street.
  • East from a point 16 metres south west from the extended south western kerbline of Albion Street to a point 10 metres north east from the extended north eastern kerbline of Albion Street.

Hope Street

  • Both sides from its junction with Bridge Street in a north westerly direction for a distance of 10 metres.

Lottie Street

  • South from its junction with Bridge Street in a north westerly direction to the end of the Lottie Street.

Albion Street

  • Both sides from its junction with Bridge Street in a south easterly direction for a distance of 10 metres.
  • South from a point 10 metres north west from the extended north western kerbline of Dawson Street to a point 10 metres south east from the extended south eastern kerbline of Dawson Street.
  • Both sides from its junction with Swinton Hall Road in a north westerly direction for a distance of 10 metres.

Old Mill Close

  • Both sides from its junction with Swinton Hall Road in a south easterly direction for a distance of 10 metres.

Statement of Reason

Salford City Council (Swinton Hall Road Area, Swinton Park) (Prohibition of Waiting) Order 2022 under the Road Traffic Regulation Act 1984

It is proposed to introduce a permanent Traffic Regulation Order for a series of ‘No Waiting At Any Time’(NWAAT) parking restrictions on Swinton Hall Road, Dawson Street, Bridge Street, Hope Street, Lottie Street, Albion Street and Old Mill Close in the Swinton Park ward. Several junctions are proposed with 10m extents of NWAAT restrictions in accordance with rule 243 of the Highway Code.

This area consists of predominantly commercial businesses which tend to require larger vehicles turning into and exiting from these streets. There are garages in the area which take advantage of the unrestricted on-street parking resulting in vehicles being parked close to junctions. This creates a road safety concern for both pedestrians and motorists negotiating the area.

The proposals are required in the interests of road safety in the Swinton Hall Road area, as it will ensure adequate visibility and room for larger vehicles to manoeuvre in safety, thus allowing safer access and egress. The restriction will prevent inconsiderate and obstructive parking that blocks sight lines and allow service and emergency vehicles to access safely.

The above proposals will provide a safe and accessible road for all road users.
