Salford Forest Park Planning Appeal

Description: Creation of forest park comprising a Forest Centre including Eco Village, Timber Initiative and Woodland Wildlife Centres, timber workshop, children’s woodland adventure play area and treetop walkway; equestrian eventing area; cross country eventing course; grandstand and associated buildings; refurbishment of Malkins Wood farmhouse to residential accommodation for equestrian centre manager; refurbishment of Moss House Farmhouse and conversion and extension of two barns to form a hotel (80 guests); golf course and clubhouse and change of use of agricultural building for golf course maintenance; footpath and riding trails and cycle paths; roads and connection to J13 of M60, replacement canal bridge, new canal bridge over Shaw Brook; car parking; landscaping including ground remodelling creation of water bodies and woodland planting; site infrastructure including fencing, lighting, services and sub stations; and site accommodation works including culverts and watercourse diversions.
Location: Site at land west of Worsley, bounded by M60, east of Astley Green and landfill site, south of Boothstown, bounded partly by Bridgewater Canal and Leigh Road, Worsley, M28 1LF.
Peel Developments submitted an appeal against the non-determination of the planning application to the Planning Inspectorate on 12 November 2008. It has been decided that the application is of more than local significance and therefore the Secretary of State will make the decision.
Because the appeal is against non-determination of the planning application, it means that the city council is no longer able to make a formal decision on the application. Salford still has to take a view on the application and therefore proposes to take a report to the Planning and Transportation Regulatory Panel at its meeting on 18 December 2008.
The timetable for appeals is very proscriptive and any deadlines missed means that evidence may well not be forwarded to the Inspector.
The starting date for the appeal was 12 November 2008 and all deadlines are based on that date. The deadlines were:
- 26 November: all statutory parties, third parties and interested persons are notified of the appeal. The Local Planning Authority must also submit the appeal questionnaire and a list of all relevant policies to the Planning Inspectorate.
- 24 December: all parties have submitted a Rule 6 statement. This is a statement detailing the appeal proposal, the history of the application, consultation and third party responses and an outline of the case that will be presented at the Inquiry. Any third parties wanting to make representations on the application must have their comments with the Planning Inspectorate at this stage.
- 14 January: the Planning Inspectorate must receive any comments on the Rule 6 or third party statements. It is not possible to introduce any new issues at this stage, purely to comment on the submitted documents.
- 4 weeks before the Inquiry the Planning Inspectorate must receive Proofs of Evidence from any individual or body wishing to be heard at the Inquiry.
The Inquiry will open on 21 April 2009 and is anticipated to last up to 6 weeks.
