Highways Act 1980, Section 129A
Algernon Road, Vicarage Road, Mountain Grove, and Mountain Street Walkden Gating Order 2008
This order is made by the Council of the City of Salford ("the Council") under section 129A of the Highways Act 1980 ("the 1980 Act") because the relevan highway described in article1 below ("the Highway") satisfies the conditions set out in section 129A of the 1980 Act in that:
(a) Premises adjoining or adjacent to the highway are affected by crime or anti-social behaviour;
(b) The existence of the highway is facilitating the persistent commission of criminal offences or anti-social behaviour; and
(c) It is in all circumstances expedient to make the order for the purposes of reducing crime or anti-social behaviour
By the order
1. The public right of way over the land specified in the schedule below and shown by a continuous bold line on the map contained in this order shall be restricted at all times with effect from 14 March 2008
2. Gates will be erected at each end of the highway so as to restrict the public right of way. The gates will be locked at all times. The right of way will not be restricted for use by the occupiers of premises adjoining or adjacent to the said highway. Occupiers of premises adjoining or adjacent to the said highway. Occupiers will retain their right of way by access to keys to the lockable gates
3. The following provisions shall apply for the protection of any statutory undertakers, namely that access will be available to the lockable gates for the purposes of carrying on their undertaking via a keyholding/provision service.
4. The alternative route for members of the public from Algernon Road to Mountain Street, or the reverse, would be to use Vicarage Road, a safe, diversion of approximately 200m.
