Notice of Confirmation of Special Extinguishment Order

Special Extinguishment Order 2005

On 28th October 2005 the Council of the City of Salford confirmed without modifications the above order, made under Section 118B of the Highways Act 1980.

The effect of the Order as confirmed is to extinguish the public right of way over the land situated at Bristol Street, Heaton Street, Symons Street, Gainsborough Street, Norton Street, Kimberley Street Salford, as specified in the schedule below and shown on the plan annexed to the Order.

A copy of the Order as confirmed and the map contained in it may be inspected free of charge at the Legal Section, Salford Civic Centre, Chorley Road, Swinton between the hours of 8.30 a.m. to 4.30 p.m. Mondays to Fridays. Copies of the Order may be obtained at a reasonable charge.

Any person who wishes to claim compensation under Section 28 of the Highways Act 1980, as applied by Section 121(2) of that Act, for depreciation of the value of an interest in land or for disturbance in the enjoyment of land in consequence of the coming into force of the order must make his or her claim in writing addressed to, The Assistant Director (Legal) (quoting reference H/JLW/SM/HS/SEO/6464) at the abovementioned address, and serve it by delivering at, or sending it by prepaid post to, the above address not later than 3rd May 2006.

The public right of way extinguished by the order is extinguished after 4th November 2005.

If any person aggrieved by the order wishes to question the validity of it, or of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, or on the ground that any requirement of that Act or any regulations made under it has not been complied with in relation to the order, he or she may under paragraph 2 of schedule 2 to that Act, within six weeks from 3rd November 2005 make an application to the High Court.

1.Alleyway to the rear of 72 to 82 Leicester Road, 13 to 51 Bristol Street and 14 to 52 Heaton Street, Salford, marked ‘A’ on the plan attached to the Order, a total area of 501 square metres.

2.Alleyway to the rear of 60 to 70 Leicester Road, 2 to 54 Symons Street, 1 to 53 Heaton Street, and 361 to 371 Great Cheetham Street, Salford, marked ‘B’ on the plan attached to the Order, a total area of 637 square metres.

3.Alleyway to the rear of 46 to 58 Leicester Road, 2 to 52 Gainsborough Street, 1 to 51 Symons Street, and 349 to 359 Great Cheetham Street, Salford, marked ‘C’ on the plan attached to the Order, a total area of 579 square metres.

4.Alleyway to the rear of 32 to 44 Leicester Road, 2 to 46 Norton, 1 to 47 Gainsborough Street, and 335 to 347 Great Cheetham Street, Salford, marked ‘D’ on the plan attached to the Order, a total area of 622 square metres.

5.Alleyway to the rear of St. George’s Nursing Home, 89 Devonshire Street, and 1 to 25 Kimberley Street, Salford, marked ‘E’ on the plan attached to the Order, a total area of 221 square metres.

6.Alleyway to the rear of 91 to 99 Devonshire Street, 329 to 333 Great Cheetham Street East, 1 to 3 Norton Street, and 2 to 18 Kimberley Street, Salford, marked ‘F’ on the plan attached to the Order, a total area of 237 square metres.
