Residents parking scheme and prohibition of waiting amendment: Hope Hospital Phase 3 Order 2009
Notice is hereby given that the council of the city of Salford propose to make an order under Sections 1, 2 and 4 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 and by virtue of The Road Traffic (Permitted Parking Area and Special Parking Area) (City of Salford) Order 2001 (Statutory Instrument 2001 No. 894) made by the Secretary of State for Environment, Transport and the Regions and all other enabling powers and after consultation with the Chief Officer of Police for the County of Greater Manchester and in accordance with Part III of Schedule 9 of the said Act of 1984.
When the order comes into effect part I (‘definitions’) of the existing resident’s parking scheme and prohibition of waiting order will be amended as specified in schedule 1 below.
When the order comes into effect part II (‘prohibition of waiting and limited waiting’) of the existing resident’s parking scheme and prohibition of waiting order will be amended as specified in schedule 2 below.
When the order comes into effect part III (‘parking place for vehicles, authorisation of use of parking places’) of the existing resident’s parking scheme and prohibition of waiting order will be amended as specified in schedule 3 below.
When the order comes into effect schedule 3 (introduction of permit holders and limited waiting 2 hours no return in 1 hour’) of the existing resident’s parking scheme and prohibition of waiting order will be amended as specified in schedule 4 below.
A copy of the proposed order together with a plan of the area and a statement of the council's reasons for proposing to make the order may be examined at the Legal Section, Salford Civic Centre, Chorley Road, Swinton, Sallford, M27 5DA, between 8.30am and 5.00pm Monday to Friday inclusive.

Schedule 1
Part 1 (definitions)
Amendment of definition of disabled persons vehicle to read:
- “disabled person’s vehicle” has the same meaning as in the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England and Wales) (Amendment) Regulations 1986 as amended by the Local Authorities’ Traffic Orders (Exemption for Disabled Persons) (England and Wales) (Amendment) Regulations 1991’.
Amendment of definition of owner to read:
- ‘means the person named in the vehicle registration documents or the person by whom such vehicle is kept and used’.
Amendment of definition of postal packets to read:
- ‘means the same as in the Postal Services Act 2000’.
Amend definition of traffic sign to read:
- “traffic sign” means a sign of any size, colour and type prescribed or authorised under, or having effect as though prescribed or authorised under, section 64 of the Road Traffic Regulation Act 1984.
Amend definition of relevant position to read:
- ‘relevant position has the same meaning as in the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England and Wales) (Amendment) Regulations 1986 as amended by the Local Authorities’ Traffic Orders (Exemption for Disabled Persons) (England and Wales) (Amendment) Regulations 1991’.
Schedule 2
Part II (prohibition of waiting and limited waiting)
Amend article 2(b) to read:
- ‘Save as provided in article 3 & 5 of this order, no person shall, except upon the direction of a police constable in uniform or a civil enforcement officer, cause or permit any vehicle to wait between the hours of 9.00 a.m. to 5.00 p.m. Monday to Friday on the lengths of road specified in schedule 2 below.
Renumber existing article 2(c) to read 2(d)
Insert new article 2(c) to read:
- ‘Save as provided in article 3, 4 & 5 of this order, no person shall except upon the direction of a police constable in uniform or a civil enforcement officer cause or permit any vehicle to wait on the lengths of road specified in schedule 3 except a vehicle displaying a valid parking permit Monday to Friday 9.00 a.m. to 5.00 p.m.’.
Renumber existing article 2(d) to read 2(e)
Amend article 3 to read:
Nothing in article 2 of this order shall prohibit any person from causing or permitting any vehicle to wait in the lengths of road specified in schedules 1, 2, and 3 to this order for so long as may be necessary:
- a) - to enable a person to board or alight from the vehicle;
- b) - to enable the vehicle, if it cannot be conveniently used for such purpose in any other road, to be used in connection with any wedding or funeral, building operation or demolition, the removal of any obstruction to traffic, the maintenance, improvement or reconstruction of the length of road so specified or the laying, erection, alteration or repair in or near the said length of road of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus;
- c) - to enable the vehicle, if it is in the service of the Royal Mail or other universal service provider to be used for the purpose of delivering or collecting postal packets;
- d) - to enable the vehicle to be used in the length of road so specified for police, ambulance, fire brigade, local authority or water authority purposes when used in pursuance of statutory powers or duties;
- e) - if the vehicle is waiting owing to the driver being prevented from proceeding by circumstances beyond the control of the driver, or to such waiting as is necessary to prevent an accident;
- f) - for the purposes of loading or unloading the vehicle whilst it is in actual use in connection with the removal or delivery of furniture to or from any premises fronting, adjoining or abutting the said lengths of road provided that notice is given twenty four hours in advance to the Council and its consent obtained.
Amend article 4 to read:
- Nothing in article 2(c) of this order shall prohibit any vehicle to wait on the lengths of road specified in schedule 3 for a period not exceeding 2 hours (not being a period separated by an interval of less than 1 hour from a previous period of waiting by the same vehicle in the same road or part of the road on the same day) Monday to Friday 9.00 a.m. to 5.00 p.m.
Amend article 5 to read:
- Nothing in article 2 and 4 shall prohibit a disabled person’s vehicle which displays in the relevant position a blue disabled person’s badge or an orange disabled person’s badge with a parking disc (on which the driver or other person in charge of the vehicle, has marked the time at which the period of waiting began) to wait on the lengths of road referred to in schedules 1, 2, 3 and 4 for a period not exceeding 3 hours, not being separated by an interval of less than 1 hour from a previous period of waiting by the same vehicle in the same road or part of road on the same.
Schedule 3
Part III (parking places for vehicles authorisation of use of parking places)
Amend article 8 to read:
- Save as provided in articles 3, 4 & 5 of this order, no person shall except upon the direction of a police constable in uniform or a civil enforcement officer cause or permit any vehicle to wait on the lengths of road specified in schedule 3 except a vehicle displaying a valid parking permit Monday to Friday 9.00 a.m. to 5.00 p.m. Save as provided in articles 5, 13 &14 of this order, no person shall except upon the direction of a police constable in uniform or a civil enforcement officer cause or permit any vehicle to wait on the lengths of road specified in schedule 4 except a vehicle displaying a valid parking permit Monday to Friday 9.00 a.m. to 5.00 p.m.
Amend article 13 to read:
Nothing in articles 7, 8 and 12 (c) of this order shall prohibit any person from causing or permitting any vehicle to wait in the parking place in the lengths of roads specified in schedule 4 so long as it may be necessary:-
- a) - to enable a person to board or alight from the vehicle;
- b) - to enable the vehicle, if it cannot be conveniently used for such purpose in any other road, to be used in connection with any wedding or funeral, building operation or demolition, the removal of any obstruction to traffic, the maintenance, improvement or reconstruction of the length of road so specified or the laying, erection, alteration or repair in or near the said length of road of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus;
- c) - to enable the vehicle, if it is in the service of the Royal Mail or other universal service provider to be used for the purpose of delivering or collecting postal packets;
- d) - to enable the vehicle to be used for police, ambulance, fire brigade, local authority or water authority purposes when used in pursuance of statutory powers or duties;
- e) - if the vehicle is waiting owing to the driver being prevented from proceeding by circumstances beyond the control of the driver, or to prevent an accident.
- f) - to deliver to or collect from or load or unload goods at any premises fronting onto the parking place provided that no vehicle so engaged shall wait for longer than 30 minutes outside the same premises without the permission of a police constable in uniform or a civil enforcement officer.
- g) - for the purposes of loading or unloading the vehicle whilst it is in actual use in connection with the removal or delivery of furniture to or from any premises fronting, adjoining or abutting the said lengths of road provided that notice is given twenty four hours in advance to the council and its consent obtained.
Amend article 14 to read:
- Nothing in articles 7, 8 and 12(c) of this order shall apply to the lengths of road specified in schedule 4 if the vehicle is being used by a legally qualified general medical practitioner, district nurse, midwife or similar people when visiting a patient so long as the vehicle concerned is clearly marked doctor, midwife etc., and the visit is expected to be less than 1 hour duration.
