The purpose of this Application is to allow the premises to provide a greater flexibility and enhancement to its offering. This includes the provision of late-night refreshment and the option of able to provide regulated entertainment (the management of which is set out in more detail in the revised operating schedule accompanying this application).

The premises shall be renamed ‘Zozo’s’

The Application seeks to make the following amendments to the existing licence:

Layout / licensing plan

To vary the layout in accordance with the plan lodged with this application. The changes to layout are very small and confirm where licensable activities may take place:

  • Ground floor: introduction of fixed bench seating; repositioning of bar within its current location.
  • Basement: reallocation of fixed seating (including recessing into space previously occupied by part of store room); reduction of bar length, and reconfiguration of WCs and small store room to provide a small entrance area into basement at bottom of the stairs.

Opening and closing times

  • To permit earlier opening at 08:00am daily so the premises may open for breakfast / food and drink provision. Please note that no licensable activities (alcohol sales or regulated entertainment) will take place at 08:00 (before 09:00am)
  • To permit an additional 30 minutes at the end of each evening to support dispersal. Please note that during this time, no licensable activities will be taking place.

Licensable activities (standard times)

  • To authorise the following regulated entertainment (indoors) from 09:00 until 00:00 (midnight) Sunday to Thursday, and from 09:00 until 01:00 Friday – Saturday:
    • Live and recorded music, the performance of dance (and anything similar) 
    • The performance of plays.
    • The display of films.
    • Indoor sporting events.
  • To authorise late night refreshment (LNR) from 23:00 until 00:00 Sunday – Thursday, and from 23:00 until 01:00 Friday – Saturday.

The existing non-standard times (for alcohol sales and closing times) to be applied to the additional licensable activities sought in this application. That condition is “One additional hour on Christmas Eve, Boxing Day, New Year’s Day, Good Friday and Easter Sunday”.

General comment

Please also note the following:

  • The standard permitted hours for the sale of alcohol are not changed by this Application. They are to remain as currently stated on the premises licence (and as a result, Section J is not completed on this application form).
  • The application seeks to authorise various types of regulated entertainment and late-night refreshment within the current permitted hours for alcohol sales.
  • The operational flexibility sought in this application is supported by a new operating schedule (to replace, in their entirety, the existing ’non-mandatory’ conditions on the current premises licence). The new operating schedule reflects the following:
    • Existing conditions: the significant majority are retained or adapted / modernised.
    • New conditions offered by the Applicant (including amendments to existing conditions)
    • Conditions agreed with the EHO during the course of a previous application that was not pursued due to procedural reasons only.
    • The existing permissions for alcohol delivery services to include third party online services (such as Deliveroo; Uber Eats etc).
    • The removal of conditions that are, for example, no longer necessary, or restrict the operational flexibility sought in this application, including “General – all four licensing objectives - 2. Alcohol - 2.1 (food – led / vertical bar condition)”.

The full set of existing conditions, found under the section of the premises licence entitled “Conditions consistent with the operating schedule”, are to be removed and replaced in their entirety by the operating schedule and policies that accompany this application.

General - all four licensing objectives
  1. Alcoholic drinks shall only be permitted to be ordered for delivery from the premises as part of a food order.
  2. Deliveries from the premises containing alcohol shall only be made to bona fide residential or business addresses.
  3. All delivery orders for alcohol will be taken over the phone, or on the Internet, or via third party delivery services (for example, Deliveroo; Uber Eats) and full payment made prior to delivery.
  4. All customers when ordering food with alcohol for delivery from the premises (as opposed to a third party delivery service) will be informed of the following at the time of the sale:
    1. The business operates Challenge 25
    2. It is unlawful to purchase alcohol for persons under the age of 18 years.
    3. At the time of delivery, the driver must be instructed that should they believe that any alcohol ordered will be consumed by a person under the age of 18 years, delivery will be refused
    4. All customers will be informed at the point of sale that all delivery drivers are unable to deliver any alcoholic items if they believe a customer is drunk or appears to be drunk or the alcohol could be intended for persons who appear to be underage and a full refund for the items will be made.
    5. The Driver will always carry with him / her the following Compliance log books:
      1. Incident log book
      2. ID Signature delivery log
      3. Customer refusal log
  5. The premises licence holder shall take reasonably practicable steps to verify that all employees of any third party engaged in the delivery of alcohol, i.e., couriers, have also been trained by their employers regarding the Challenge 25 policy, including refusals, and that the third party delivery service documents such training.
  6. A record shall be kept detailing all refused sales of alcohol upon delivery. The record should include the date and time of the refused sale and the name of the delivery company whose employee refused the sale. The refusals log shall be made available for inspection upon request by the Licensing Team, Police or Trading Standards.
  7. The premises licence holder will ensure that a sticker is applied to all consignments of alcohol stating “Note to delivery service: this package contains age restricted products. Ensure recipient is over 18” (or similar wording to the same effect).
The prevention of crime and disorder
  1. The premises shall operate a CCTV system that complies with the minimum requirements of the GMP Licensing Team.
  2. The premises licence holder must ensure that:
    1. Cameras are located within the premises to cover all public areas (not including the toilets) and all entrances and exits;
    2. The system records clear images enabling the clear facial identification of individuals and clear head a shoulders image of every person entering or leaving the premises at each exist and entrance point.
    3. All recorded footage is securely retained for a minimum period of twenty-eight days;
    4. The CCTV system shall operate and be continually recording at all times the premises are open for licensable activities;
    5. All equipment must have constant and accurate time and date generation;
    6. The CCTV system is fitted with security functions to prevent recordings being tampered with;
    7. There is at least one member of trained staff at the premises during opening hours able to ensure rapid data retrieval and downloads of footage, and to provide viewable copies on request to police or authorised local authority officers as soon as is reasonably practicable in accordance with all relevant data protection legislation.
    8. A CCTV log will be completed on a weekly basis to record all elements of the CCTV systems is maintained in good working order.
    9. In the event of a failure of the CCTV system for any reason, a record of the failure will be recorded in the premises log and immediate steps will be made to rectify the problem.
  3. SIA registered door supervisors shall be employed at the premises in accordance with a risk assessment, to be carried out by the DPS.
  4. When employed, all door supervisors on duty at the premises must correctly display their current SIA accreditation and be briefed on their responsibilities and relevant company operating procedures before they commence duty.
  5. When employed, all door supervisors shall wear high visibility armbands.
  6. When employed, a register of door supervisors shall be maintained at the premises and shall include:
    1. The SIA registration number of door staff on duty;
    2. The identity of each member of door staff;
    3. The dates and times the door staff are on duty.
  7. 7. When the premises operates past 23:00, the DPS or other appropriate manager, shall risk assess the requirement for a last entry condition. The risk assessment shall take into account the day of the week, the premises’ style of operating and any other local events they might be aware of.
  8. The use of the side door of Highfield Drive for the ingress and egress of customers shall be subject to a risk assessment conducted by either the premises licence holder, the DPS or an appropriate manager. The risk assessment will take into account how the premises is operating, the times during which the side door may be used, and how the door and customers can best managed.
  9. A contact number for the DPS shall be available at all times when they are not on duty.
  10. Open containers of alcohol shall not be removed from the premises, save for consumption in any delineated external area. Signage advising customers of this shall be placed at appropriate locations including the exits to the premises and within any delineated external area that the premises is permitted to use.
  11. All staff authorised to sell and serve alcohol shall be trained in:
    1. Relevant age restrictions in respect of products
    2. Prevention of underage sales
    3. Prevention of proxy sales
    4. The law relating to the sale of alcohol to persons under 18 years of age (this will include staff who are not able to sell / serve alcohol)
    5. Maintenance of the refusals log
    6. Recognising signs of drunkenness and vulnerability
    7. Identifying suspicious or vulnerable persons
    8. How overservice of alcohol impacts on the four objectives of the Licensing Act 2003
    9. How to refuse service
    10. Conflict management
    11. Understanding and dealing with situations involving vulnerable people, and incidents of harassment; and how to report issues of modern slavery and trafficking
    12. Action to be taken in the event of an emergency, including the preservation of a crime scene and reporting an incident to the emergency services
    13. The conditions in force under this licence.
      This training shall be documented (including a written record of its content) and reviewed at 6 monthly intervals to reinforce standards and promote best practice. Training and review records shall be made available for inspection upon request by Trading Standards and Licensing Authority Officers of Salford City Council, and the Police.
  12. A refusals record must be kept at the premises which details all refusals to sell alcohol for any reason (or any other age restricted product sold at the premises, any refusals to underage persons or those who appear to be underage). This record must include:
    1. The date and time of the incident;
    2. The item refused;
    3. Description of the customer (and name and address, if provided)
    4. Details of any ID offered (if shown)
    5. The name of the staff member who refused the sale;
    6. The reason the sale was refused.

All entries must be made within 24 hours of the refusal. The record must be made available for inspection and copying within a reasonable time of a request by an officer of a Responsible Authority.

Public safety
  1. The premises licence holder shall ensure an adequate and appropriate supply of first aid equipment and materials is available on the premises, and that adequate records are maintained in relation to the supply of any first aid treatment.
  2. Regular safety checks shall be carried out by staff.
  3. Management shall liaise with the Fire Authority as necessary to ensure compliance with all necessary fire regulations.
  4. The premises shall operate a policy to prevent violence, threatening behaviour, harassment, the possession, use or supply of controlled drugs, and anti-social behaviour. Any person reasonably believed to be engaging in such behaviour shall be refused entry or removed from the premises where it is safe and lawful to do so. All incidents shall be recorded in an incident log and reported to the police where it is deemed appropriate and as soon as reasonably practicable.
  5. In incident log shall be kept at the premises. Any and all of the following incidents must be noted including pertinent details and, as appropriate, reported promptly so that investigations can be made and action taken:
    1. Alleged crimes reported to the venue or by the venue to the police
    2. Ejections of patrons
    3. Complaints received
    4. Incidents of disorder
    5. Seizures of drugs, offensive weapons, fraudulent ID or other items
    6. Faults in the CCTV system
    7. Visit by a responsible authority or emergency service
  6. Incident logs (which may be kept electronically) must be kept at the premises for at least 12 months from the date the incident occurred, and must be made available on request to an ‘authorised person’ (as defined by section 13 of the Licensing Act 2003), an authorised trading standards officer, or the police.
  7. The premises shall maintain public liability insurance.
  8. A log of all individuals who are authorised to sell alcohol will be maintained in the staff training manual.
  9. Alcohol to be stored on the premises behind the counter and in the storeroom.
The prevention of public nuisance
  1. All necessary steps shall be taken to ensure that any noise from the premises shall not be at a level which could cause nuisance at the boundary of the nearest residential premises.
  2. No noise shall emanate from the premises nor vibration be transmitted through the structure of the premises which gives rise to a nuisance.
  3. When the ground floor is to be used for regulated entertainment, only single singers and / or musicians are permitted. No live bands or DJ sets can provide regulated entertainment on the ground floor.
  4. There shall be no noise or odours caused by the kitchen extraction equipment that gives rise to a nuisance.
  5. The exterior of the building shall be cleared of litter at regular intervals. The exterior of the premises shall be checked periodically throughout the opening times and at the end of the each night.
  6. Notices will be positioned at the exits to the building requesting customers to leave quickly and in a quiet manner our of respect for local residents. With due regard to staff safety, this will include those customers who appear to be loitering immediately outside the restaurant.
  7. All external doors and windows must be kept closed after 21:00, save for normal access and egress.
  8. A Dispersal Policy and an Al Fresco, Smoking and Litter Policy will be implemented and adhered to (supplied).
  9. The emptying of bins into skips, and refuse collections will not take place between 19:00 and 07:00am on any day.
  10. Deliveries to the premises will not take place between 19:00 and 07:00 on any day.
  11. A list of local licensed taxi and private hire operators shall be maintained at the premises and made available to customers on request.
The protection of children from harm
  1. The Challenge 25 scheme must be operated at all times (including home deliveries) to ensure that any person who appears to be under the age of 25 shall provide documented proof that he/she is over 18 years of age. Proof of age shall only comprise a passport, photo card driving licence, an EU/EEA national ID card or similar document, an HM Forces warrant card, a card bearing the PASS hologram, or any reliable photo ID, electronic or biometric age verification technology approved by the police or other the licensing authority.
  2. The premises shall display prominent, clear and legible signage indicating that the Challenge 25 scheme is in operation. Such signage shall be placed at the entrances to the premises, as well as at the point of sale and behind any counter.
  3. The premises shall display prominent signage indicating that it is an offence to buy or attempt to buy alcohol for a person who is under 18 and for a person under the age of 18 to buy or attempt to buy alcohol.
  4. Staff training will include the Challenge 25 Policy and its operation. In particular, staff shall be trained to take such action as is necessary to prevent the sale of alcohol to persons over the age of 18 where those customers are engaged in the distribution of alcohol to persons under the age of 18. The training must be given to a new member of staff before they commence employment and all staff must receive refresher training every 6 months.
  5. All children under the age of 18 will be accompanied by a responsible adult.
Al Fresco Dining, Smoking and Litter Policy
  1. The outside areas used by customers shall be monitored by staff or door staff regularly when it is in use and at the end of each evening.
  2. The external area of the premise will be cleaned regularly. The Premises Licence Holder and DPS will ensure that litter arising from people using the premises is cleared away and checked periodically through the opening times at the end of each night.
  3. Suitable receptacles shall be provided for smokers to dispose of cigarette butts in those areas where smoking is not prohibited.
  4. Signs will be displayed in the area requesting customers keep noise to a minimum.
  5. Patrons who disregard signage and verbal instructions regarding noise will be asked to move inside and/or leave the premises.
  6. Open containers of alcohol shall not be permitted to be taken beyond the boundary of any delineated external area used by the premises. Ensure signage is displayed in the appropriate places so customers are aware of this.
Dispersal policy

The purpose of this Dispersal Policy is to ensure, so far as it is possible, that minimum disturbance or nuisance is caused to our neighbours and to ensure that the operation of the premises makes the minimum impact upon the neighbourhood in relation to potential nuisance and anti-social behaviour.

This will be achieved by exercising pro-active measures towards and at the end of the evening.

By ensuring that this Dispersal Policy document is brought to the attention of Management and Staff we will seek to encourage the efficient, controlled and safe dispersal of our patrons during our closing period.

  1. At the end of the evening management and staff will assist with the orderly and gradual dispersal of patrons including those who appear to be loitering in the immediate vicinity of the premises.
  2. Staff Members (including door personnel when employed) will advise patrons to leave the premises quickly and quietly out of respect for our neighbours.
  3. Notices will be displayed requesting our customers to leave quietly and in an orderly manner out of consideration to neighbours and their attention will be drawn to these notices by members of staff.
  4. We will ensure the removal of all open drinking receptacles of alcohol from any patron before exiting the premises (this does not apply in the case of consumption in any delineated external drinking area and those taking home sealed off-sales).
  5. We will actively discourage our customers from assembling outside the premises at the end of the evening.
  6. Wherever possible, customers will be able to sit inside the premises and wait for their transport home.
  7. Customers shall be made aware of the numbers for local taxi services at the end of their evening and their numbers shall be available to customers.
  8. The use of the side door on Highfield Drive shall only be used for ingress / egress as a result of and in accordance with a risk assessment.
