Your legal responsibilities

The Environmental Protection Act (EPA) 1990 places a duty of care on all businesses regarding the waste they produce.

This means you, as owner or operator, are responsible for ensuring the waste your company generates is disposed of correctly, regardless of your waste contractor or your current commercial waste arrangements.

Under the EPA 1990, you are obliged to hold a current Waste Transfer Note (WTN) from your current contractor. You have a legal responsibility to keep these records for two years.

If asked to do so by the Environment Agency or a waste collection authority you must be able to produce a current WTN within 14 days.

Failure will result in the issue of a fixed penalty notice of £300.

It is illegal to dispose of trade or business waste at any household waste recycling centres. Household waste recycling centres are for residents only, to dispose of their household waste.
