Notice is hereby given that Salford City Council proposes to make the following order under the Road Traffic Regulation Act 1984.

City of Salford (Belgrave Crescent and Clarendon Road, Eccles) (Prohibition of Waiting, No Stopping on School Entrance Markings and Amendment) Order 2022 

The effect of the Order will be to introduce:

No Stopping on School Entrance Markings, Monday to Friday, 8am to 5pm on:

Belgrave Crescent (Clarendon Road Community Primary)

  • north side, from a point 10 metres west from the extended western kerbline of Clarendon Road for a distance of 25.56 metres in a westerly direction

No Waiting At Any Time on:

Belgrave Crescent

  • north side, from its junction with Clarendon Road for a distance of 10 metres in a westerly direction (length shortened to accommodate the above No Stopping); and
  • south side, from its junction with Clarendon Road for a distance of 15 metres in a westerly direction (currently on-street – to be incorporated in the above Order)

Clarendon Road

  • west side, from the southern extended kerbline of Belgrave Crescent for a distance of 18.4 metres in a southerly direction (the current 15 metres length to be extended by 3.4 metres).

An existing order will be amended to be consistent with the proposals.

Draft order 

City of Salford (Belgrave Crescent and Clarendon Road, Eccles) (Prohibition of Waiting, No Stopping on School Entrance Markings and Amendment) Order 2022 

Salford City Council in exercise of its powers under Sections 1(1), 2(1) to (3) and 4(2) of the Road Traffic Regulation Act 1984 ("the Act") and Part IV of Schedule 9 to the Act and of all other enabling powers and after consultation with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act, hereby makes the following order:

Interpretation

In this order:           

  • (1) “disabled person’s badge” has the same meaning as in The Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000;
    “disabled person’s vehicle” means a vehicle lawfully displaying a disabled person’s badge being a vehicle which, immediately before or after any period of waiting allowed by virtue of a provision of a kind required by the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000 to be included in an order under the Act, has been or is to be used for carrying disabled persons as passengers;
    “goods” means goods of any kind whether animate or inanimate and includes postal packets of any description and “delivering and collecting” in relation to any goods includes checking the goods for the purpose of their delivery or collection;
    “parking disc” means a disc, issued by a local authority, 125 millimetres square, coloured blue and capable of showing the quarter hour period during which a period of waiting begins, which has not ceased to be valid;
    “postal packet” shall have the same meaning as in the Postal Services Act 2000;
    “School Entrance” means the length of road in the City of Salford specified in Column 1 of the Schedule 3 to this Order which is marked with the road marking complying with Diagram 1027.1 of Schedule to the Traffic Signs Regulations and General Directions 2016;
    “trailer” means a vehicle other than a motor vehicle;
    “traffic sign” means any sign of any size, colour and type prescribed or authorised under or having effect as though prescribed or authorised under Section 64 of the Act.
  • (1) For the purpose of this Order a vehicle shall be regarded as displaying:
    • a disabled person’s badge in the relevant position if:
      • the badge is exhibited on the dashboard or facia of the vehicle; or
      • where the vehicle is not fitted with a dashboard or facia, the badge is exhibited in a conspicuous position on the vehicle;
      • so that the front of the badge is clearly legible from the outside of the vehicle;
    • a parking disc in the relevant position if:
      • the disc is exhibited on the dashboard or facia of the vehicle; or
      • where the vehicle does not have a dashboard or facia, the disc is exhibited in a conspicuous position on the vehicle
      • so that, when marked to show the quarter-hour period during which a period of waiting began, that period is clearly legible from the outside of the vehicle.
  • (2) The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

Amendment to existing order

  • The Order specified in Column 1 of Schedule 1 to this Order is amended to the extent specified in Column 2 of the said Schedule.

No stopping on school entrance markings

  • Save as provided in Article 4 of this Order no person shall cause or permit any vehicle to stop between the hours of 8am and 5pm on Monday to Friday on the school entrance specified in Column 1 of Schedule 2 to this Order outside the school specified in Column 2 of the said Schedule.

Exemptions to stopping on school entrance markings

  • Nothing in Article 3 of this Order shall render it unlawful to cause or permit any vehicle to stop on the school entrance specified in that Article so far as such stopping is reasonably necessary for the vehicle to be used for the following purposes:
    • the removal of any obstruction to traffic;
    • police, fire brigade or ambulance purposes;
    • in pursuance of statutory powers or duties;
    • the maintenance, improvement or reconstruction of the length of road comprised of the school entrance or the laying, erection, alteration or repair in or adjacent to the said school entrance of any sewer, main, pipe or apparatus for the supply of gas, water, electricity or any telecommunications as defined in the Telecommunications Act 1984.

No waiting at any time

  • Save as provided in Articles 6 and 7 of this Order no person shall, except upon the direction or with the permission of a constable in uniform or a civil enforcement officer, cause or permit any vehicle to wait at any time on the lengths of road specified in Schedule 3 to this Order.

Exemptions - general

  • Nothing in Articles 5 of this Order shall prevent any person to cause or permit any vehicle to wait on the lengths of road referred to in that Articlesfor so long as may be necessary to enable:
    • a person to board or alight from the vehicle;
    • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in connection with any of the following operations, namely:
      • building, industrial or demolition operations;
      • the removal of any obstruction to traffic;
      • the maintenance, improvement or reconstruction of the said lengths of road; or
      • the laying, erection, alteration or repair, in or on land adjacent to the said lengths of road, of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus defined in the Telecommunications Act 1984;
    • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in the service of a local authority or a water authority in pursuance of statutory powers or duties;
    • the vehicle to be used for the purpose of delivering or collecting postal packets;
    • the vehicle to take in petrol, oil, water or air from any garage situated on or adjacent to the said lengths of road;
    • the vehicle to wait at or near to any premises situated on or adjacent to the said lengths of road for so long as such waiting by that vehicle is reasonably necessary in connection with any funeral;
    • the vehicle to be used for fire brigade, ambulance or police purposes; or
    • goods to be loaded on to or unloaded from the vehicle.

Exemption for disabled persons' vehicles

  • Nothing in Article 5 of this Order shall prevent any person to cause or permit a disabled person’s vehicle, which displays in the relevant position a disabled person’s badge and a parking disc (on which the driver or the person in charge of the vehicle, has marked the time at which the period of waiting began) to wait on any of the length of road referred to in that Article for a period not exceeding 3 hours (not being a period separated by an interval of less than 1 hour from a previous period of waiting by the same vehicle on the same length of road on the same day).

Statement of reasons 

Eccles Highways Task Group requested to undertake a review of the parking situation around Clarendon Road Community Primary School.

Currently, Clarendon Road is subject to ‘No Waiting at Any Time’ and ‘No Stopping’ Monday – Friday 8am to 5pm, which assist with pedestrian safety. Belgrave Crescent is subject to ‘No Waiting at Any Time’ restrictions at the junction with Clarendon Road. However, it was identified that the school pedestrian gate west of the junction is not covered by any restrictions, allowing injudicious parking to take place.

A site visit showed that the parking situation at the junction of Belgrave Crescent / Clarendon Road can be improved. The area is subject to 20mph speed limit and has vertical traffic calming measures (speed cushions). Clarendon Road also benefits from School Keep Clear road markings and double yellow lines, to manage parking during school times.

To improve safety, particularly outside the school pedestrian gate, it is therefore proposed to introduce ‘No Stopping’ Monday – Friday 8am – 5pm on school entrance markings. This will:

  • allow vulnerable road users to see and be seen by approaching traffic;
  • increase visibility between all highway users at the junction with Clarendon Road;
  • deter parents and other inconsiderate drivers from obstructing the pedestrian and vehicle accesses to the Clarendon Road Community Primary School;
  • improve safety of vulnerable road users as they travel to and from the school; and
  • maintain safe traffic flow.
