City of Salford (Ellesmere Park, Walkden) (20mph Speed Limit Zone) Order 2022

Salford City Council in exercise of its powers under Sections 82 and 84 of the Road Traffic Regulation Act 1984 (hereinafter called "the Act") and of all other enabling powers and having consulted with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act hereby makes the following order.

Interpretation

In this order:

  • "Special Forces" means those units of the armed forces of the Crown the maintenance of whose capabilities is the responsibility of the Director of Special Forces or which are for the time being subject to the operational command of that Director.
  • The Interpretation Act 1978 shall apply for the interpretation of this order as it applies for the interpretation of an Act of Parliament.

20mph Speed Limit Zone

  • The roads specified in the Schedule to this order shall cease to be restricted roads for the purposes of section 81 of the Act.
  • No person shall drive any motor vehicle at a speed exceeding 20 miles per hour on the roads and lengths of road specified in the Schedule to this order.
  • No speed limit imposed by this Order applies to the vehicles falling within Regulation 3(4) of the Road Traffic Exemptions (Special Forces) (Variation and Amendment) Regulations 2011 when used in accordance with Regulation 3(5) of those Regulations.

The Schedule

20mph Speed Limit Zone 

Moss Lane

  • From its junction with Manchester Road (A6) to the northern boundary line of 63 Moss Lane.

All of the following roads are for their full length:

  • Yarn Close
  • Threadneedle Drive
  • Old Mill Lane
  • Coral Road
  • Thorne Crescent
  • Feather Stitch Road
  • Herringbone Road
  • Ermine Close
  • Cotton Fields
  • Spinners Drive

City of Salford (Ellesmere Park, Walkden) (Prohibition of Waiting and Revocation) Order 2022

Salford City Council in exercise of its powers under Sections 1(1), 2(1) to (3) and 4(2) of the Road Traffic Regulation Act 1984 ("the Act") and Part IV of Schedule 9 to the Act and of all other enabling powers and after consultation with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act, hereby makes the following order:

Interpretation

In this order:

  • “disabled person’s badge” has the same meaning as in The Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000;
  • “disabled person’s vehicle” means a vehicle lawfully displaying a disabled person’s badge being a vehicle which, immediately before or after any period of waiting allowed by virtue of a provision of a kind required by the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000 to be included in an order under the Act, has been or is to be used for carrying disabled persons as passengers;
  • “parking disc” means a disc, issued by a local authority, 125 millimetres square, coloured blue and capable of showing the quarter hour period during which a period of waiting begins, which has not ceased to be valid.

For the purpose of this order a vehicle shall be regarded as displaying:

  • a disabled person’s badge in the relevant position if:
    • the badge is exhibited on the dashboard or facia of the vehicle, or
    • where the vehicle is not fitted with a dashboard or facia, the badge is exhibited in a conspicuous position on the vehicle, so that the front of the badge is clearly legible from the outside of the vehicle;
  • a parking disc in the relevant position if:
    • the disc is exhibited on the dashboard or facia of the vehicle; or
    • where the vehicle does not have a dashboard or facia, the disc is exhibited in a conspicuous position on the vehicle, so that, when marked to show the quarter-hour period during which a period of waiting began, that period is clearly legible from the outside of the vehicle.

The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

Revocation of orders

  • The orders specified in Schedule 1 to this Order are revoked in full.

No waiting at any time

  • Save as provided in Article 4 of this order no person shall, except upon the direction or with the permission of a constable in uniform, a civil enforcement officer or a traffic warden, cause or permit any vehicle to wait at any time on the sides of the lengths of road specified in Schedule 2 to this order.

Exemption from prohibition - general exemptions

Nothing in Article 3 of this order shall prevent any person to cause or permit any vehicle to wait on the lengths of road referred to in that Article for so long as may be necessary to enable:

  • a person to board or alight from the vehicle;
  • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in connection with any of the following operations, namely:
    • building, industrial or demolition operations;
    • the removal of any obstruction to traffic;
    • the maintenance, improvement or reconstruction of the said length of road; or
    • the laying, erection, alteration or repair, in or on land adjacent to the said length of road, of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus defined in the Telecommunications Act 1984;
  • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in the service of a local authority or a water authority in pursuance of statutory powers or duties;
  • the vehicle to be used for the purpose of delivering or collecting postal packets as defined in the Postal Services Act 2000;
  • the vehicle to take in petrol, oil, water or air from any garage situated on or adjacent to the said side of length of road;
  • the vehicle to wait at or near to any premises situated on or adjacent to the said length of road for so long as such waiting by that vehicle is reasonably necessary in connection with any funeral;
  • the vehicle to be used for fire brigade, ambulance or police purposes; or
  • goods to be loaded on to or unloaded from the vehicle.

Exemption for disabled persons' vehicles

Nothing in Article 3 of this Order shall prevent any person to cause or permit a disabled person's vehicle which displays in the relevant position a disabled person's badge, and a parking disc (on which the driver or other person in charge of the vehicle, has marked the time at which the period of waiting began) to wait on the lengths of road referred to in that Article for a period not exceeding three hours (not being a period separated by an interval of less than one hour from a previous period of waiting by the same vehicle on the same length of road on the same day).

Moss Lane

  • both sides, from the north extended kerbline of Manchester Road, in a northerly direction for 30 metres.
  • west side, from a point 10 metres south of the southern extended kerbline of Ermine Close, to a point 10 metres north of the northern extended kerbline of Ermine Close.
  • east side, from a point 10 meters south of the southern extended kerbline of Cotton Fields, to a point 10 metres north of the northern extended kerbline of Cotton Fields (Southern Access).
  • both sides, from a point 10 metres south of the southern extended kerbline of Coral Road, to a point 10 metres north of the northern extended kerbline of Coral Road, a distance of 26.7 metres.
  • east side, from a point 10 metres south of the southern extended kerbline of Cotton Fields, to a point 10 metres north of the northern extended kerbline of Cotton Fields (Northern Access).

  • both sides, from the Eastern extended kerbline of Moss Lane, in an easterly direction for 10 metres.

Coral Road

  • both sides, From the western extended kerbline of Moss Lane, in a westerly direction for 10 metres.

Threadneedle Drive

  • both sides, from the western extended kerbline of Moss Lane, in a westerly direction for 10 metres
  • both sides, from its Cul-de-sac end in a easterly direction for 17 metres, taking in all the turning head.

Notice is hereby given that Salford City Council proposes to make orders under the Road Traffic Regulation Act 1984. The titles and effects of the Orders will be as follows:

City of Salford (Ellesmere Park, Walkden) (20 mph Speed Limit Zone) Order 2022 to introduce a 20 MPH Speed Limit on:

  • Moss Lane, from its junction with Manchester Road (A6) to the northern boundary line of 63 Moss Lane; and
  • for the full lengths of Yarn Close, Threadneedle Drive, Old Mill Lane, Coral Road, Thorne Crescent, Feather Stitch Road, Herringbone Road, Ermine Close, Cotton Fields and Spinners Drive.

Existing orders will be revoked to be consistent with the above proposals. Copies of proposed Orders together with the scheme plans, a statement of the council's reasons for proposing to make the Orders and copies of the Orders it is proposed to revoke may be inspected at Swinton Gateway, 100 Chorley Road, Swinton, M27 6BP Monday to Friday 9am to 6pm.

Statement of reasons 

For proposing to make the City of Salford (Ellesmere Park, Walkden) (Prohibition of Waiting and Revocation) Order 2022 and the City of Salford (Ellesmere Park, Walkden) (20mph Speed Limit Zone) Order 2022

In connection with the Ellesmere Park development, it is proposed to:

  • introduce No Waiting at Any Time restrictions on Moss Lane at its junction with Manchester Road, to ensure that this busy junction is kept clear of any parking restricting access or egress, especially at peak periods;
  • introduce No Waiting at Any Time restrictions on various lengths of the estate roads; and
  • introduce a 20mph Zone on a length of Moss Lane and the adjacent estate roads.

The proposed No Waiting at Any Time and 20mph Zone will ensure safe access and egress in to and out of the new development which is located off the A6 Manchester Road, Walkden. It is necessary to introduce these restrictions to deter vehicles from parking close to junctions and in turning heads, which would otherwise impede the safe movement of traffic, including service and emergency vehicles. Additionally, the restrictions in the turning heads will ensure that service vehicles are not forced to reverse long distances and are able to turn round and exit in a forward gear.

The measures will also ensure safe access and forward visibility for road users within the development and introduce an appropriate speed limit for these residential roads, facilitating the free flow of traffic and improving road safety.
