City of Salford (Manchester Road West, Little Hulton) (Prohibition of Waiting and Restriction of Loading/Unloading) Order 2022

Salford City Council in exercise of its powers under Sections 1(1), 2(1) to (3) and 4(2), of the Road Traffic Regulation Act 1984 ("the Act"), and of all other enabling powers and after consultation with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act, hereby makes the following Order:

Interpretation

In this Order:

  • “disabled person’s badge” has the same meaning as in The Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000
  • “disabled person’s vehicle” means a vehicle lawfully displaying a disabled person’s badge being a vehicle which, immediately before or after any period of waiting allowed by virtue of a provision of a kind required by the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000 to be included in an order under the Act, has been or is to be used for carrying disabled persons as passengers
  • “delivering” and “collecting” in relation to postal packets includes checking the goods for the purposes of their delivery or collection
  • “parking disc” means a disc, issued by a local authority, 125 millimetres square, coloured blue and capable of showing the quarter hour period during which a period of waiting begins, which has not ceased to be valid.

For the purpose of this Order a vehicle shall be regarded as displaying:

  • a disabled person’s badge in the relevant position if:
    • the badge is exhibited on the dashboard or facia of the vehicle, or
    • where the vehicle is not fitted with a dashboard or facia, the badge is exhibited in a conspicuous position on the vehicle, so that the front of the badge is clearly legible from the outside of the vehicle;
  • a parking disc in the relevant position if:
    • the disc is exhibited on the dashboard or facia of the vehicle; or
    • where the vehicle does not have a dashboard or facia, the disc is exhibited in a conspicuous position on the vehicle, so that, when marked to show the quarter-hour period during which a period of waiting began, that period is clearly legible from the outside of the vehicle.

The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

No waiting at any time

  • Save as provided in Articles 5 and 6 of this Order no person shall, except upon the direction or with the permission of a constable in uniform or a civil enforcement officer, cause or permit any vehicle to wait at any time on the lengths of road specified in Schedule 1 to this Order.

No loading/unloading 7.30am to 9.30am and 4pm to 6pm

  • Save as provided in Articles 5 of this Order no person shall, except upon the direction or with the permission of a constable in uniform or a civil enforcement officer, cause or permit any vehicle to wait or to load/unload between the hours of 7.30am to 9.30am and 4pm to 6pm on the lengths of road specified in Schedule 2 to this Order.

Exemptions from prohibitions and restrictions - general exemptions

Nothing in Articles 3 and 4 of this Order shall prevent any person from causing or permitting any vehicle to wait on the side of lengths of road referred to in those Articles for so long as may be necessary to enable:

  • a person to board or alight from the vehicle;
  • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in connection with any of the following operations, namely:
    • building, industrial or demolition operations;
    • the removal of any obstruction to traffic;
    • the maintenance, improvement or reconstruction of the said side of length of road;  or
    • the laying, erection, alteration or repair, in or on land adjacent to the said side of length of road, of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus defined in the Telecommunications Act 1984;
  • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in the service of a local authority or a water authority in pursuance of statutory powers or duties;
  • the vehicle to be used for the purpose of delivering or collecting postal packets as defined in the Postal Services Act 2000;
  • the vehicle to take in petrol, oil, water or air from any garage situated on or adjacent to the said side of length of road;
  • the vehicle to wait at or near to any premises situated on or adjacent to the said side of length of road for so long as such waiting by that vehicle is reasonably necessary in connection with any funeral;
  • the vehicle to be used for fire brigade, ambulance or police purposes.

Exemption for loading and unloading

Nothing in Article 3 of this Order shall prevent any person from causing or permitting any vehicle to wait in any lengths of road specified in Schedule 1 to this Order for so long as may be necessary to enable goods to be loaded on to or unloaded from the vehicle provided always that no such vehicle may wait for the purpose of loading and unloading at any time in the lengths of road specified in Schedule 2 to this Order. 

Exemption for disabled persons’ vehicles   

Nothing in Article 3 of this Order shall prevent any person causing or permitting a disabled person's vehicle which displays in the relevant position a disabled person's badge, and a parking disc (on which the driver or other person in charge of the vehicle, has marked the time at which the period of waiting began) to wait on the length of road referred to in that Article for a period not exceeding 3 hours (not being a period separated by an interval of less than 1 hour from a previous period of waiting by the same vehicle on the same side of length of road on the same day) provided always that no such vehicle shall so wait there as follows:

  • at any time in the lengths of road specified in Schedule 2 to this Order

Schedule 1 - No waiting at any time

Manchester Road West

  • South west side, from the western extended kerbline of Ram Street, in a north westerly direction for 90m

Manchester Road West             

  • North east side, from the north western extended kerbline of Stocksfield Drive in a north westerly direction for 64.4m

Stocksfield Drive         

  • Both sides from the northern extended kerbline of Manchester Road West in a northerly direction for 10m.

Schedule 2 - No loading/unloading between 7.30am to 9.30am and 4pm to 6pm

Manchester Road West             

  • South west side, from the western extended kerbline of Ram Street, in a north westerly direction for 90m

Manchester Road West

  • North east side, from the north western extended kerbline of Stocksfield Drive in a north westerly direction for 64.4m

Stocksfield Drive  

  • Both sides from the northern extended kerbline of Manchester Road West in a northerly direction for 10m.

Salford City Council proposes to make the City of Salford (Manchester Road West, Little Hulton) (Prohibition of Waiting and Restriction of Loading/Unloading) Order 2022 under the Road Traffic Regulation Act 1984

The effect of the proposed Order will be to introduce the following provisions:

No Waiting at any Time and No Loading/Unloading between 7.30am to 9.30am and 4pm to 6pm on: 

Manchester Road West

  • South west side from the western extended kerbline of Ram Street north westerly for 90m
  • North east side from the north western extended kerbline of Stocksfield Drive north westerly for 64.4m

Stocksfield Drive

  • From the northern extended kerbline of Manchester Rd West northerly for 10m.

Salford City Council, Section 23 Road Traffic Regulation Act 1984, Zebra, Pelican and Puffin Pedestrian Crossings Regulations and General Direction 1997 Proposed Toucan Crossing in Little Hulton.

Notice is hereby given that Salford City Council, in exercise of its powers under section 23 of the Road Traffic Regulation Act 1984 and all other enabling powers, proposes to construct signal-controlled crossings at the following location.

To create a new Toucan crossing on A6 Manchester Road West - The midpoint of the Toucan crossing will be located a point 20m NW of the extended NW kerbline of Stocksfield Drive.

A copy of the proposed Orders, a plan of the area and statement of the council's reasons for proposing to make the above Order may be examined at Swinton Gateway, 100 Chorley Road, Swinton, M27 6BP, Monday to Friday 9am to 6pm. The City of Salford (Manchester Road West, Little Hulton) (Prohibition of Waiting and Restriction of Loading/Unloading) Order 2022 and Proposed Toucan and Zebra Crossing in Little Hulton 

Statement of reasons 

There have been calls for an appropriate controlled crossing facility to be provided due to the amount of traffic on Manchester Road West in Little Hulton. The traffic on this road is still increasing and this causing difficulties for pedestrians and cyclist when trying to cross between the residential area to the north and Peel Park to the south. Crossing this busy main road is especially problematic during peak periods and makes crossing particularly hazardous for the more vulnerable road users, young, old and those with mobility difficulties.

It has therefore been proposed to implement the proposed crossing, along with some small additions to the existing No Waiting At Any Time restrictions and the Peak hour Loading restrictions, in the interest of maintaining a high level of safety in the vicinity of the new controlled crossing.

The proposed pedestrian crossing and associated amendments to the waiting and loading restrictions in close proximity to the crossing will provide a much needed safe and accessible pedestrian and cycle crossing point, greatly improving connectivity between the two residential estates on the north and south of Manchester Road West, benefiting the local community, especially the most vulnerable road users.
