Notice is hereby given that Salford City Council proposes to make the following Orders under the Road Traffic Regulation Act 1984. The titles and effects of the Orders will be as follows: 

The City of Salford (Lower Broughton Road, Riverside and Sussex Street, Broughton) (Prohibition of Waiting, Restriction of Waiting and Amendment) Order 2022

Proposed No Waiting At Any Time on: 

Lower Broughton Road

  • south side, from Great Clowes Street, north westerly to Riverside, a distance of 172 metres
  • north side, from Great Clowes Street, north westerly for 199 metres

Riverside

  • east side, from Lower Broughton Road southerly for 10 metres

Sussex Street

  • west side, from Lower Broughton Road northerly for 55 metres
  • north side, from Great Clowes Street westerly for 67 metres
  • east and south side, from Great Clowes Street in a westerly then southerly direction to Lower Broughton Road.

Proposed No Waiting, Monday to Saturday, 8am to 6pm on: 

Lower Broughton Road

  • south side (i) from Riverside north westerly to 3.5 metres south east Heath Avenue; and (ii) from 199 metres west Great Clowes Street north westerly to 3.5 metres south east of Heath Avenue

Riverside

  • west side, from Lower Broughton Road southerly for 10 metres

Proposed One-Way Traffic on: 

Lower Broughton Road

  • from Great Clowes Street to the western side of access to Lidl Store car park, a distance of 98 metres; Permitted Direction of Travel – in a north westerly direction (towards Frederick Road / Camp Street)

Sussex Street

  • from Lower Broughton Road to Great Clowes Street, a distance of 253 metres; Permitted Direction of Travel – in a northerly, then easterly direction (towards the Sussex Street / Great Clowes Street junction).

Existing orders will be amended to be consistent with the proposals. Copies of the proposed orders together with plans showing the proposals, a statement of the council's reasons for proposing to make the orders and copies of the Orders proposed to be amended may be inspected at Swinton Gateway, 100 Chorley Road, Swinton, M27 6BP Monday to Friday 9am to 6pm. City of Salford (Lower Broughton Road and Sussex Street, Broughton) (One-Way Traffic and Revocation) Order 2022

Salford City Council in exercise of their powers under Sections 1(1) and (2), 2(1) to (3) and 4(2) of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 ("the Act") and of all enabling powers and after consultation with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act hereby makes the following Order:

Interpretation

  1. The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

Revocation of existing order

  1. The Order specified in Column 1 of Schedule 1 to this Order is revoked as specified in Column 2 of Schedule 1 to this Order.

One-Way traffic

  1. Save as provided in Article 4 of this Order no person shall except upon the direction or with the permission of a constable in uniform or of a traffic warden cause or permit any vehicle to proceed in the lengths of road specified in Column 1 of Schedule 2 to this Order in a direction other than that specified in relation to that length of road in Column 2 of the said Schedule.

Exemption

  1. Nothing in Article 3 of this Order shall apply to the driving of any mechanical road cleansing vehicle being used in pursuance of statutory powers.

Commencement

  1. This Order shall come into operation on XX 2022 and may be cited as the City of Salford (Lower Broughton Road and Sussex Street, Broughton)(One-Way Traffic and Revocation) Order 2022.

  • From its junction with Lower Broughton Road to its junction with Great Clowes Street, a distance of 253 metres

Waiting restrictions draft order

Salford City Council in exercise of its powers under Sections 1(1), 2(1) to (3), 4(2), of the Road Traffic Regulations Act 1984 (“the Act”) and Part IV of Schedule 9 to the Act and of all other enabling powers and after consultation with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act, hereby makes the following Order: 

Interpretation

In this Order:

  1. “Disabled Person’s Badge” has the same meaning as in The Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000; “Disabled Person’s Vehicle” means a vehicle lawfully displaying a disabled person’s badge being a vehicle which, immediately before or after any period of waiting allowed by virtue of a provision of a kind required by the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000 to be included in an order under the Act, has been or is to be used for carrying disabled persons as passengers; “Delivering” and “Collecting” in relation to postal packets includes checking the goods for the purposes of their delivery or collection
  2. For the purpose of this Order a vehicle shall be regarded as displaying:
    1. a Disabled Person’s Badge in the relevant position if:
      1. the badge is exhibited on the dashboard or facia of the vehicle, or
      2. where the vehicle is not fitted with a dashboard or facia, the badge is exhibited in a conspicuous position on the vehicle, so that the front of the badge is clearly legible from the outside of the vehicle;
    2. a Parking Disc in the relevant position if:
      1. the disc is exhibited on the dashboard or facia of the vehicle; or
      2. where the vehicle does not have a dashboard or facia, the disc is exhibited in a conspicuous position on the vehicle, so that, when marked to show the quarter-hour period during which a period of waiting began, that period is clearly legible from the outside of the vehicle.
  3. The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

Amendment/Revocation of Existing Orders

The Orders specified in Column 1 of Schedule 1 to this Order are amended or revoked to the extent specified in Column 2 of Schedule 1 to this Order.

No Waiting at Any Time

Save as provided in Articles 5 and 6 of this Order no person shall, except upon the direction or with the permission of a constable in uniform or a civil enforcement officer, cause or permit any vehicle to wait at any time on the lengths of road specified in Schedule 2 to this Order.

No Waiting Monday to Saturday 8am to 6pm

Save as provided in Articles 5 and 6 of this Order no person shall, except upon the direction or with the permission of a constable in uniform or a civil enforcement officer cause or permit any vehicle to wait on any Monday to Saturday inclusive between the hours of 8am and 6pm on the lengths of road specified in Schedule 3 to this Order.

Exemption from prohibition - general exemptions

(1) Nothing in Articles 3 or 4 of this Order shall prevent any person to cause or permit any vehicle to wait on the lengths of road referred to in those Articles for so long as may be necessary to enable:

  1. a person to board or alight from the vehicle;
  2. the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in connection with any of the following operations, namely:
    1. building, industrial or demolition operations
    2. the removal of any obstruction to traffic;
    3. the maintenance, improvement or reconstruction of the said length of road; or
    4. the laying, erection, alteration or repair, in or on land adjacent to the said length of road, of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus defined in the Telecommunications Act 1984;
  3. the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in the service of a local authority or a water authority in pursuance of statutory powers or duties;
  4. the vehicle to be used for the purpose of delivering or collecting postal packets as defined in the Postal Services Act 2000;
  5. the vehicle to take in petrol, oil, water or air from any garage situated on or adjacent to the said length of road;
  6. the vehicle to wait at or near to any premises situated on or adjacent to the said length of road for so long as such waiting by that vehicle is reasonably necessary in connection with any funeral;
  7. the vehicle to be used for fire brigade, ambulance or police purposes.
  8. goods to be loaded onto or from the vehicle.

Exemption for disabled persons' vehicles

Nothing in Articles 3 or 4 of this Order shall prevent any person to cause or permit a Disabled Person's Vehicle which displays in the relevant position a Disabled Person's Badge, and a Parking Disc (on which the driver or other person in charge of the vehicle, has marked the time at which the period of waiting began) to wait on the length of road referred to in the said Articles for a period not exceeding 3 hours (not being a period separated by an interval of less than 1 hour from a previous period of waiting by the same vehicle on the same length of road on the same day) vehicle.

Statement of reasons 

City of Salford (Lower Broughton Road, Riverside and Sussex Street, Broughton) (Prohibition of Waiting, Restriction of Waiting and Amendment) Order 2022; and City of Salford (Lower Broughton Road and Sussex Street, Broughton) (One-Way Traffic and Revocation) Order 2022

In connection with the development of a new Lidl retail store on Sussex Street, off Lower Broughton Road, the existing Waiting and One-way traffic restrictions have been reviewed.           

The proposed new traffic regulations will facilitate an amended road layout; discourage inappropriate parking; and facilitate safe access and egress to the new development, thereby maintaining highway safety.

The One-way traffic system on Lower Broughton Road is being shortened to provide better access to the development.

Various lengths of waiting restrictions that are currently in force Monday to Saturday 8am to 6pm will be replaced with ‘No Waiting At Any Time’.
