Salford City Council intends to make the following order under the Road Traffic Regulation Act 1984 and the Road Traffic Exemptions (Special Forces) (Variation and Amendment) Regulations 2011.

City of Salford (Newhaven Business Park, Salford) (20mph speed limit) Order 2022

The order shall be to prohibit any person from driving any motor vehicle at a speed exceeding 20 miles per hour (mph) on the following roads for their entire length unless otherwise stated:

  • Blyth Avenue
  • Aqueduct Way
  • Montgomery Street
  • Falkirk Drive
  • Anderton Lane
  • Grantham Crescent

City of Salford (Newhaven Business Park, Salford) (Prohibition of Waiting) Order 2022

The effect of the Order will be to introduce Proposed No Waiting At Any Time on:

Barton Lane

  • South - From a point 24 metres west of the western extended kerb line of Blythe Avenue to a point 24 metres east of the eastern extended kerbline of Blythe Avenue.

Blythe Avenue

  • Both sides - From the extended southern kerbline of Barton Lane in a southerly direction for 31.5 metres.
  • West and south side - From a point 39 metres south of the extended southern kerbline of Grantham Crescent in a south easterly then easterly then northerly easterly direction around the turning head on the south side, a total distance of 41m.
  • East and north side - From a point 39 metres south of the extended southern kerbline of Grantham Crescent in a south easterly direction for 10m, then for 10m in a north easterly direction.
  • Both sides - From its cul-de-sac end in a south westerly direction for a distance of 27m, including turning head on south side of the road.

Falkirk Drive

  • Both sides - From a point 36 metres south of the extended southern kerbline of Grantham Crescent in a southerly direction to the cul-de-sac end, a distance of 26m, including turning head on the east side.  

Aqueduct Way 

  • East and south side - From a point 47 metres south of the extended southern kerbline of Montgomery Street in a southerly then westerly direction around the turning head, a total distance of 40m.
  • West and north side - From a point 47 metres southeast of the extended southern kerb line of Montgomery Street in a south easterly direction for 10m, then in a south westerly direction for 10m.
  • Both sides - From its cul-de-sac end in a north easterly direction for a distance of 27m, including turning head on south side of the road

City of Salford (Newhaven Business Park, Salford) (Prohibition of Waiting) Order 2022

The Council of the City of Salford in exercise of its powers under Sections 1(1), 2(1) to (3) and 4(2) of the Road Traffic Regulation Act 1984 ("the Act"), and Part lV of Schedule 9 to the Act, and of all other enabling powers and after consultation with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act, hereby makes the following Order:

Interpretation

In this Order:

  • “disabled person’s badge” has the same meaning as in The Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000;
  • “disabled person’s vehicle” means a vehicle lawfully displaying a disabled person’s badge being a vehicle which, immediately before or after any period of waiting allowed by virtue of a provision of a kind required by the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000 to be included in an order under the Act, has been or is to be used for carrying disabled persons as passengers;
  • “parking disc” means a disc, issued by a local authority, 125 millimetres square, coloured blue and capable of showing the quarter hour period during which a period of waiting begins, which has not ceased to be valid.

For the purpose of this Order a vehicle shall be regarded as displaying:

  • a disabled person’s badge in the relevant position if:
    • the badge is exhibited on the dashboard or facia of the vehicle, or
    • where the vehicle is not fitted with a dashboard or facia, the badge is exhibited in a conspicuous position on the vehicle, so that the front of the badge is clearly legible from the outside of the vehicle;
  • a parking disc in the relevant position if:
    • the disc is exhibited on the dashboard or facia of the vehicle; or
    • where the vehicle does not have a dashboard or facia, the disc is exhibited in a conspicuous position on the vehicle, so that, when marked to show the quarter-hour period during which a period of waiting began, that period is clearly legible from the outside of the vehicle.

The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

No waiting at any time

  • Save as provided in Article 3 of this Order no person shall, except upon the direction or with the permission of a constable in uniform, a civil enforcement officer or a traffic warden, cause or permit any vehicle to wait at any time on the side of length of road specified in the Schedule to this Order.

Exemption from prohibition - general exemptions

Nothing in Article 3 of this Order shall prevent any person to cause or permit any vehicle to wait on the length of road referred to in that Article for so long as may be necessary to enable:

  • a person to board or alight from the vehicle;
  • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in connection with any of the following operations, namely:
    • building, industrial or demolition operations;
    • the removal of any obstruction to traffic;
    • the maintenance, improvement or reconstruction of the said length of road;  or
    • the laying, erection, alteration or repair, in or on land adjacent to the said length of road, of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus defined in the Telecommunications Act 1984;
  • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in the service of a local authority or a water authority in pursuance of statutory powers or duties;
  • the vehicle to be used for the purpose of delivering or collecting postal packets as defined in the Postal Services Act 2000;
  • the vehicle to take in petrol, oil, water or air from any garage situated on or adjacent to the said side of length of road;
  • the vehicle to wait at or near to any premises situated on or adjacent to the said length of road for so long as such waiting by that vehicle is reasonably necessary in connection with any funeral;
  • the vehicle to be used for fire brigade, ambulance or police purposes; or
  • goods to be loaded on to or unloaded from the vehicle.

Exemption for disabled persons' vehicles

Nothing in Article 3 of this Order shall prevent any person to cause or permit a disabled person's vehicle which displays in the relevant position a disabled person's badge, and a parking disc (on which the driver or other person in charge of the vehicle, has marked the time at which the period of waiting began) to wait on the length of road referred to in that Article for a period not exceeding three hours (not being a period separated by an interval of less than one hour from a previous period of waiting by the same vehicle on the same length of road on the same day).

No Waiting At Any Time

Barton Lane

  • South - From a point 24 metres west of the western extended kerb line of Blythe Avenue to a point 24 metres east of the eastern extended kerbline of Blythe Avenue

Blyth Avenue 

  • Both sides - From the extended southern kerbline of Barton Lane in a southerly direction for 31.5 metres.

  • West and north side - From a point 47 metres southeast of the extended southern kerb line of Montgomery Street in a south easterly direction for 10m, then in a south westerly direction for 10m.
  • Both sides - From its cul-de-sac end in a north easterly direction for a distance of 27m, including turning head on south side of the road.

Falkirk Drive

  • Both sides - From a point 36 metres south of the extended southern kerbline of Grantham Crescent in a southerly direction to the cul-de-sac end, a distance of 26m, including turning head on the east side.

City of Salford (Newhaven Business Park, Salford) (20mph Speed Limit) Order 2022

The Council of the City of Salford in exercise of its powers under Sections 82 and 84 of the Road Traffic Regulation Act 1984 (hereinafter called "the Act") and having consulted with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act hereby makes the following Order.

Interpretation

In this Order:

  • "Special Forces" means those units of the armed forces of the Crown the maintenance of whose capabilities is the responsibility of the Director of Special Forces or which are for the time being subject to the operational command of that Director.
  • The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

20mph speed limit

  • The road specified in the Schedule to this Order shall cease to be a restricted road for the purposes of section 81 of this Act
  • No person shall drive any motor vehicle at a speed exceeding 20 miles per hour on the length of road specified in the Schedule to this Order
  • No speed limit imposed by this Order applies to the vehicles falling within Regulation 3(4) of the Road Traffic Exemptions (Special Forces) (Variation and Amendment) Regulations 2011 when used in accordance with Regulation 3(5) of those Regulations.

Any reference in this Order to any enactment shall be construed as a reference to that enactment as amended by any subsequent enactment. 

Any reference in this order to any road, street and or other location shall be construed to the name herein and any subsequent name thereafter

Schedule

For the full length of the road on:

  • Blyth Avenue
  • Aqueduct Way
  • Montgomery Street
  • Falkirk Drive
  • Anderton Lane
  • Grantham Crescent

Statement of reasons

The proposed No Waiting At Any Time restrictions will ensure safe access and egress, in to and out of the new development off Barton Lane. The restrictions in the cul-da sacs ends will also allow turning maneuverers for larger service and emergency vehicles to turn round and exit in a forward gear negating the need to reverse long distance.

It is necessary to introduce these restrictions to deter vehicles from parking along the assess road compromising access, and visibility, for both vehicles and pedestrians, they will also ensure service vehicles can safely access the area and maneuverer in and out of the development.

The area is all residential in nature, so an appropriate 20mph speed limit is also proposed to be introduced, in line with government recommendations.
