Notice is hereby given that Salford City Council proposes to make the City of Salford (Nightingale Gardens, Salford) (Prohibition of Waiting) Order 2022 under the Road Traffic Regulation Act 1984. The effect of the order will introduce the following:

No Waiting At Any Time on:

Wrigley Avenue

  • both sides, from A6 Manchester Road in a north easterly direction for 10m;

Stancliffe Drive

  • both sides, from its cul-de-sac end in a north easterly direction for 12m;

Borchardt Drive

  • west side and east side, from a point 18m south of the cul-de-sac end (west side) in a northerly then westerly, northerly, easterly, northerly, easterly and southerly directions, to a point 6m south of the cul-de-sac end (east side), a total distance of 36m;

Borchardt Drive

  • north and south sides, from Hospital Road in a westerly direction for 10m; 

Liebert Drive

  • both sides, from Hospital Road in a westerly direction for 10m
  • both sides, from its cul-de-sac end in a north easterly direction for a distance of 10m

Holden Drive

  • southern access, both sides, from Hospital Road, in an easterly direction for a distance of 12m
  • orthern access, both sides, from Hospital Road in an easterly direction for 10m

Hospital Road

  • west side, from 10m south of Borchardt Drive in a northerly direction to 15m north of Borchardt Drive
  • west side, from Liebert Drive in a northerly direction for 10m.

City of Salford (Nightingale Gardens, Salford) (Prohibition of Waiting) Order 2022

Salford City Council in exercise of its powers under Sections 1(1), 2(1) to (3) and 4(2) of the Road Traffic Regulation Act 1984 ("the Act") and of all other enabling powers and after consultation with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act, hereby makes the following Order:

Interpretation

“disabled person’s badge” has the same meaning as in The Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000; “disabled person’s vehicle” means a vehicle lawfully displaying a disabled person’s badge being a vehicle which, immediately before or after any period of waiting allowed by virtue of a provision of a kind required by the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000 to be included in an order under the Act, has been or is to be used for carrying disabled persons as passengers; “parking disc” means a disc, issued by a local authority, 125 millimetres square, coloured blue and capable of showing the quarter hour period during which a period of waiting begins, which has not ceased to be valid.

For the purpose of this Order a vehicle shall be regarded as displaying:

  1. a disabled person’s badge in the relevant position if:
    1. the badge is exhibited on the dashboard or facia of the vehicle, or
    2. where the vehicle is not fitted with a dashboard or facia, the badge is exhibited in a conspicuous position on the vehicle, so that the front of the badge is clearly legible from the outside of the vehicle
  2. a parking disc in the relevant position if:
    1. the disc is exhibited on the dashboard or facia of the vehicle; or 
    2. where the vehicle does not have a dashboard or facia, the disc is exhibited in a conspicuous position on the vehicle, so that, when marked to show the quarter-hour period during which a period of waiting began, that period is clearly legible from the outside of the vehicle.

The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

No waiting at any time

Save as provided in Article 3 of this Order no person shall, except upon the direction or with the permission of a constable in uniform, a civil enforcement officer or a traffic warden, cause or permit any vehicle to wait at any time on the sides of the lengths of road specified in the Schedule to this Order.

Exemption from prohibition - general exemptions

(1) Nothing in Article 2 of this Order shall prevent any person to cause or permit any vehicle to wait on the lengths of road referred to in that Article for so long as may be necessary to enable:

  1. a person to board or alight from the vehicle
  2. the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in connection with any of the following operations, namely:
    1. building, industrial or demolition operations;
    2. the removal of any obstruction to traffic;
    3. the maintenance, improvement or reconstruction of the said length of road; or
    4. the laying, erection, alteration or repair, in or on land adjacent to the said length of road, of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus defined in the Telecommunications Act 1984
  3. the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in the service of a local authority or a water authority in pursuance of statutory powers or duties;
  4. the vehicle to be used for the purpose of delivering or collecting postal packets as defined in the Postal Services Act 2000;
  5. the vehicle to take in petrol, oil, water or air from any garage situated on or adjacent to the said side of length of road;
  6. the vehicle to wait at or near to any premises situated on or adjacent to the said length of road for so long as such waiting by that vehicle is reasonably necessary in connection with any funeral;
  7. the vehicle to be used for fire brigade, ambulance or police purposes; or
  8. goods to be loaded on to or unloaded from the vehicle.

Exemption for disabled person' vehicles

(2) Nothing in Article 2 of this Order shall prevent any person to cause or permit a disabled person's vehicle which displays in the relevant position a disabled person's badge, and a parking disc (on which the driver or other person in charge of the vehicle, has marked the time at which the period of waiting began) to wait on the lengths of road referred to in that Article for a period not exceeding three hours (not being a period separated by an interval of less than one hour from a previous period of waiting by the same vehicle on the same length of road on the same day).

Notice is hereby given that Salford City Council proposes make the City of Salford (Nightingale Gardens, Salford) (20mph Speed Limit) Order 2022 under the Road Traffic Regulation Act 1984.

The effect of the Order will be to make the full lengths of following roads subject to a 20mph speed limit: Wrigley Avenue; Stancliffe Drive; Holden Drive; Sillavan Close; Borchardt Drive; Liebert Drive.

City of Salford (Nightingale Gardens, Salford) (20mph Speed Limit) Order 2022

Salford City Council in exercise of its powers under Sections 82 and 84 of the Road Traffic Regulation Act 1984 (hereinafter called "the Act") and of all other enabling powers and having consulted with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act hereby makes the following Order.

Interpretation

  1. In this Order: "Special Forces" means those units of the armed forces of the Crown the maintenance of whose capabilities is the responsibility of the Director of Special Forces or which are for the time being subject to the operational command of that Director.
  2. The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

20mph speed limit

  • The roads specified in the Schedule to this Order shall cease to be restricted roads for the purposes of section 81 of the Act. 
  • No person shall drive any motor vehicle at a speed exceeding 20 miles per hour on the roads specified in the Schedule to this Order.
  • No speed limit imposed by this Order applies to the vehicles falling within Regulation 3(4) of the Road Traffic Exemptions (Special Forces) (Variation and Amendment) Regulations 2011 when used in accordance with Regulation 3(5) of those Regulations.

Statement of reasons

For proposing to make the City of Salford (Nightingale Gardens, Salford) (Prohibition of Waiting) Order 2022 and the City of Salford (Nightingale Gardens, Salford) (20mph Speed Limit) Order 2022

As part of the new residential housing development located off Hospital Road and Manchester Road A6, it has been identified that there is a need to introduce new traffic restrictions to maintain access and improve highway safety.

‘No Waiting at Any Time’ restrictions are proposed for junctions and other locations to:

  • ensure safe access and egress in to and out of the new development including for service and emergency services’ vehicles, so they can turn round and exit in a forward gear instead of having to reverse creating a hazard to other road users
  • improve visibility and deter parking on the footway
  • maintain the flow of pedestrians and vehicular traffic in the streets affected by the development
  • ensure pedestrian crossing points are kept clear and visibility is maintained.

It is also proposed to make the new development area a 20mph zone. These are residential streets and 20mph restriction is in line with government proposals to make residential estate roads 20mph, where appropriate.
