Provision of electric vehicle charge points: Church Street, John William Street and Hankinson Way car parks

City of Salford (Off Street Parking Places) (Consolidation and Revocation) Order 2013) Electric Taxi and Electric Private Hire Vehicle Recharging Parking Bays (Amendment) Order 2023

The council of the City of Salford in exercise of its powers under Sections 32(1) and 35(1) of the Road Traffic Regulation Act 1984 (“the Act”) and Part IV of Schedule 9 to the Act and of all other enabling powers and after consultation with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act hereby makes the following order:

Citation and commencement

This order may be cited as the City of Salford (Off Street Parking Places) (Consolidation and Revocation) Order 2013) Electric Taxi and Electric Private Hire Vehicle Recharging Parking Bays (Amendment) Order 2023.

Interpretation

In this order:

  • “the Off Street Car Parks Order” means the City of Salford (Off Street Parking Places)(Consolidation and Revocation) Order 2013 (as amended);
  • Any reference in this Order to any enactment shall be construed as a reference to that enactment as amended, applied, consolidated, re-enacted or as having effect by virtue of any subsequent enactment;
  • Unless the context otherwise requires any expression used in this Order which is used in the Off Street Car Parks Order shall have the same meaning as in the Off Street Car Parks Order.

Amendment to the off street car parks order

The Off Street Car Parks Order is amended by:

  • The inclusion of the definitions set out in Schedule 1 to this order;
  • The amendment of the Off Street Car Parks Order to provide for dedicated electric Taxi / Private Hire Vehicle recharging parking bays as set out in Schedule 2 to this order.

Schedule 1

Definitions to be included in the Off Street Car Parks Order.

‘Electric taxi / private hire vehicle’ in the context of the means of propulsion of the vehicle means such vehicle where electrical motive power is derived from an internal electrical storage battery that can be plugged into mains electricity for the purpose of recharging the said battery and shall include any vehicle that is so powered in part by such a battery, including plug-in hybrid and extended-range electric vehicles;

‘Electric vehicle recharging point’ means equipment situated adjacent to an electric vehicle recharging parking bay that supplies electric energy for recharging the battery of electric vehicles via connection to an electric cable;

‘Electric taxi / private hire vehicle recharging parking bay’ means a parking bay that is provided by this Order and subject to the provisions of this Order for the sole use of an electric taxi or electric private hire vehicle whilst recharging;

‘Recharging’ in relation to an electric taxi / private hire vehicle means such electric vehicle which is connected by electric cable to the electric vehicle recharging point situated adjacent to an electric taxi / private hire vehicle recharging parking bay for the purpose of recharging the battery of such electric vehicle;

'Private hire vehicle’ has the same meaning as in the Local Government (Miscellaneous Provisions) Act 1976;

'Taxi’ has the same meaning as in the Town Police Clauses Act 1847 and the Local Government (Miscellaneous Provisions) Act 1976.

Schedule 2

Amendments to the Off Street Car Parks Order.

Amend the City of Salford (Off Street Parking Places)(Consolidation and Revocation) Order 2013 as follows:

  • Amend Article 3.(1) so as to include the following additional proviso

Designation of parking places

3.(1) Subject to Articles 16C, 16D and 22(4) of this order

  • Include the following Articles 16C, 16D and 22(4) in the order:

Electric taxi / private hire vehicle recharging parking bays

16C. Where within a parking place specified in Schedule 2B to this Order there is a sign or surface marking which indicates that a parking bay is available only for the recharging of electric taxis / electric private hire vehicles the driver of a vehicle shall not permit the vehicle to wait in the electric taxi / private hire vehicle recharging parking bay unless it is an electric taxi or electric private hire vehicle and the said electric vehicle is recharging from an electric vehicle recharging point whilst in occupation of the electric taxi / private hire vehicle recharging parking bay. 

16D. No electric taxi / private hire vehicle shall remain in an electric taxi / private hire vehicle recharging parking bay within a parking place specified in Schedule 2B to this order for a period in excess of 1 hour and such electric taxi / private hire vehicle shall not be left again in an electric vehicle recharging parking bay in that parking place until 2 hours have elapsed from the time at which the said electric taxi / private hire vehicle was taken away from that parking place.

22(4). An electric taxi / private hire vehicle which is in occupation of an electric taxi / private hire vehicle recharging parking bay in accordance with the provisions of Articles 16C and 16D above is exempt from payment of the parking charge.

Insert the following Schedule 2B in the Off Street Car Parks Order:

The council of the City of Salford proposes to make the City of Salford (Off Street Parking Places)(Consolidation and Revocation) Order 2013) Electric Taxi and Electric Private Hire Vehicle Recharging Parking Bays (Amendment) Order 2023 the under the Road Traffic Regulation Act 1984. 

The effect will be to introduce:

Dedicated Electric Taxi and Electric Private Hire Vehicle Recharging Parking Bays – operational at all times on all days, recharging limited to 1 hour, no return within 2 hours – in the following off-street car parks:

  • Church Steet Car Park, Swinton and Wardley (3 bays)
  • John William Street Car Park, Eccles (3 bays)
  • Hankinson Way Car Park, Pendleton and Charlestown (4 bays)

The bays are for the sole use of electric taxis and electric private hire vehicles whilst recharging. The parking tariff charge will not apply to the dedicated taxi / private hire vehicle recharging bays, but taxis / private hire vehicles will be subject to the other standard conditions of use of the car parks.

An existing order will be amended to give effect to the provisions. A copy of the proposed order together with plans showing the proposals, a statement of the council's reasons for proposing to make the order and a copy of the order it is proposed to amend may be inspected at Swinton Gateway, 100 Chorley Road, Swinton, M27 6BP, Monday to Friday, 9am to 6pm.

Electric Taxi and Electric Private Hire Vehicle Recharging Parking Bays

Many of Salford’s residents rely on the use of taxis and private hire vehicles for essential journeys that local bus routes do not cover. As such, it is essential, that the council supports the taxi and private hire vehicles’ trade in providing adequate facilities to maintain this essential service. 

It is also important to support the change of vehicles from petrol and diesel to electric, which will help reduce pollution and improve air quality, reducing the risk of respiratory diseases. The proposed recharging infrastructure will facilitate and encourage the changing of taxis and private hire vehicles from petrol and diesel to electric power.

Whilst existing council car parks and highway infrastructure do have some limited provision for electric charging places, most of these recharging bays are available to all electric vehicles, as such there is limited availability for taxis and private hire vehicles especially during the day time. 

It is therefore proposed to introduce additional dedicated electric taxi and private hire electric vehicle recharging points in three council car parks:

  • Church Street Car Park, Swinton and Wardley (3 spaces)
  • John William Street Car Park, Eccles (3 spaces)
  • Hankinson Way Car Park, Pendleton and Charlestown (4 spaces)

The dedicated recharging bays will be operational at all times on all days, with recharging limited to 1 hour, no return within 2 hours. Taxis and private hire vehicles must be recharging the vehicle whilst in occupation of a dedicated EV bay. The parking tariff charge will not apply to the taxi / private hire vehicle EV recharging bays.

The locations of the taxi / private hire vehicle EV recharging bays are shown on the scheme plans.
