Streets in Ordsall and Irwell Riverside

Notice is hereby given that on 11 January 2022 Salford City Council made the above named Order under sections 9 and 10 of the Road Traffic Regulation Act 1984. The effect of the Order, which is in effect on an experimental basis for a period of up to 18 months, is to introduce the following provisions:

Prohibition of vehicles (except pedal cycles) - at all times

  1. Stevenson Street, from its junction with East Ordsall Lane in a north westerly and northerly direction for a distance of 45 metres;
  2. North George Street, from its junction with Cannon Street in a southerly direction for a distance of 40 metres;
  3. Frederick Street, from its junction with Nathan Drive in a south westerly direction to its junction with Lamb Lane;
  4. St Stephens Street, from its junction with Chapel Street in a northerly direction for a distance of five metres; and
  5. Lambs Lane, from its junction with Trinity Way to a point ten metres east of the eastern extended kerbline of Salisbury House (Bevill Square)

The Order will come into operation on 28 January 2022. A copy of the Order together with a plan and statement of the council's reasons for making the order may be inspected at Swinton Gateway, 100 Chorley Road, Swinton, M27 6BP Monday to Friday 9am to 6pm. The council will be considering in due course whether the provisions of the Order should be continued in force indefinitely. Within a period of six months beginning with the day on which the Experimental Order came into force, or if the Order is varied, or amended by another order, or modified pursuant to section 10(2) of the 1984 Act, beginning with the day on which the variation or modification or the latest variation or modification came into force, any person may object to the indefinite continuation of the provisions of the Order.  Any person wishing to object to such indefinite continuation should submit their grounds of objection in writing to phlegal@manchester.gov.uk  or the address below, stating the grounds on which they are made, no later than 28 July 2022. Please quote reference L/PSH/OUT1093/828.

Any person who wishes to question the validity of the Order or of any provision contained in it on the grounds that it is not within the powers conferred by the Road Traffic Regulation Act 1984 or on the grounds that any requirement of that Act or of any instrument made under it has not been complied with in relation to the Order may within six weeks from 11 January 2022 apply to the High Court for such purpose.

City of Salford (streets in Ordsall and Irwell Riverside) (Prohibition of vehicles except pedal cycles) (Experimental) Order 2022

The Council of the City of Salford in exercise of their powers under sections 2, 9(1)(3)(4), 10(1) to (3) and 92 of the Road Traffic Regulation Act 1984 ("the Act") and of all enabling powers and after consultation with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act hereby makes the following Order:

Interpretation

  1. The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

Experimental prohibition of vehicles except pedal cycles

  1. Save as provided in Article 3 of this Order no person shall, except upon the direction or with the permission of a constable in uniform or a traffic warden, cause or permit any vehicle other than a pedal cycle to proceed at any time in the lengths of road specified in the Schedule to this Order.

Exemptions - general

  1. (1) Subject to Article 6 below, nothing in Article 2 of this Order shall prevent any motor vehicle from proceeding in the lengths of road specified in the Schedule to this Order for as long as necessary to enable the vehicle to be used for any of the purposes specified in paragraph (2) of this Article.(2)  The purposes referred to in paragraph (1) of this Article are:
    1. police, fire brigade or ambulance purposes or any vehicle being used in pursuance of statutory powers or duties
    2. in the service of any local authority or water undertaking in pursuance of statutory powers or duties, the maintenance, cleansing, improvement or reconstruction of the length of road or the laying, erection, alteration or repair in or adjacent to the said length of road of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus as defined in the Telecommunications Act 1984
    3. any demolition or building operation
    4. the avoidance of an accident
    5. allowing a person to get or give help in consequence of an accident or emergency or otherwise take action for public safety.

Exemptions in other orders

  1. Insofar as there are any inconsistencies between the provisions of this Order and the exemptions contained in any other Order made or having effect as if made under the Act, the provisions of this Order shall prevail.

Modification/suspension of order

  1. In accordance with the provision of section 10(2) of the Act the Strategic Director  Place is empowered after consultation with Chief Officer of Police and after giving public notice to modify or suspend the operation of this Order or any provision contained in it if it appears to him essential:
  • in the interests of the expeditious, convenient and safe management of traffic;
  • in the interests of providing suitable and adequate on-street parking facilities; or
  • for preserving or improving the amenities of the area through which any road affected by the Order runs.

Authorisation of the placement of bollards

  1. This Order authorises the placing of bollards or other obstructions across the lengths of road specified in the Schedule to this Order so as to prevent  unauthorised access to the said lengths of road.

Duration

  1. Subject to any statutory provision this Order shall come into effect for a period of no longer than 18 months from the date specified in Article 8 of this Order.

Commencement

  1. This Order shall come into operation on 28 January 2022 and may be cited as the City of Salford (Streets in Ordsall and Irwell Riverside) (Prohibition of Vehicles Except Pedal Cycles) (Experimental) Order 2022.

Statements of reason

Salford City Council is developing proposals for the 'Bee Network' within Salford City Centre. This project forms part of the Greater Manchester-wide programme to make journeys on foot or by bike easier and more attractive.

The council is therefore working towards the creation of a low traffic, active neighbourhood within the Trinity and Ordsall areas of Salford, where the movement of people is prioritised over the movement of motor traffic. This project seeks to reduce car dependency and prevent rat-running, as well as improving the experience of travelling to public transport hubs.

An element of the scheme is the implementation of ‘Modal Filters’ (road closures), by way of the above-mentioned Experimental Traffic Regulation Order.  This Order will introduce physical measure such as concrete blocks and/or planters on neighbourhood residential streets so that motorised vehicles are prevented from traveling through, but access for pedestrians and cyclists will be maintained.

An Experimental Traffic Regulation Order (ETRO) for such Modal Filters was made on 19 June 2020. The ERTO introduced closures on Stevenson Street, North George Street, Frederick Street and St Stephens Street. (Following the receipt of objections, the experimental closure on St Stephen Street was removed.) The operation of the closures was reviewed against the objectives of the scheme during the 18 months that the ERTO was in place. Evidence and monitoring from that period supported filters on St Stevenson Street (though at a different location to that first trialled), North George Street and Frederick Street, and at a new experimental closure location on Lamb Lane.

To assess the operation of these various closure locations both individually and for their combined effect, the council has on 11 January 2022 made a new Experimental Order.

The objectives of the 2022 Experimental Order are to:

  • Reduce through traffic on neighbourhood roads
  • Gain an understanding of whether the ‘Modal Filters’ help to reduce vehicle speeds
  • Monitor the effect on traffic movement on the neighbourhood roads and the surrounding routes where traffic is likely to be displaced
  • Develop further ideas working with the community to assess what other measures the filters could include (Green infrastructure, seating, cycle parking and so on) should the measures be made permanent.

During the period of the experimental restriction (maximum 18 months) the measures are will be reviewed and monitored against the scheme objectives. If necessary the measures may be modified whilst the ERTO is in place.

The council will be considering in due course whether to make an order that is not an Experimental Order which will continue in force indefinitely the provisions of the 2022 Experimental Order.
