Planning Obligations Infrastructure Funding Statement

Section 106 of the Town and Country Planning Act 1990 allows a local planning authority to enter into a legally binding agreement or planning obligation with a developer in association with the granting of planning permission.

The Community Infrastructure Levy (CIL) regulations require all local planning authorities that enter into section 106 planning obligations during a reporting year to publish an infrastructure funding statement (IFS) at least annually from 2019/2020. This statement provides details for the 2019/20 financial year (1 April 2019 to 31 March 2020), the 2020/21 financial year (1 April 2020 to 31 March 2021), the 2021/22 financial year (1 April 2021 to 31 March 2022) and the 2022/23 financial year (1 April 2022 to 31 March 2023) of:

  • Developer agreements signed
  • Developer agreement contributions – details of the individual obligations agreed (financial and non-financial towards uses including affordable housing, education, open space, public realm and transport)
  • Developer agreement transactions – details of every part of the process (obligation trigger points reached and then every time that funds are: received; allocated to a project; transferred to a third party; spent; or returned to the developer)

The above details are available to download below as both comma separated value files (CSV) and Excel worksheets along with copies of the developer agreements signed during the 2019/20, 2020/21, 2021/22 and 2022/23 financial years.
