Alcohol PSPO - Proposed Extension Order

Salford City Council has reviewed the consultation response in regarded to the extending of the Public Spaces Protection Order. 

The Council now proposes to extend the Salford City Council (Alcohol) Public  Spaces Protection Order 1 Of 2020 (“Order”) under sections 59 and 60 of the Anti-Social Behaviour, Crime and Policing Act 2014 (“the Act”) to prohibit the occurrence and recurrence of the specified criminal and anti-social activities (‘the Activities’) in the Restricted Area while the Order is in force.

The Restricted Area:

Whole of the City of Salford excluding:

  1. premises (other than council-operated licensed premises) authorised by a premises licence to be used for the supply of alcohol;
  2. premises authorised by a club premises certificate to be used by the club for the supply of alcohol;
  3. a place within the curtilage of premises within paragraph (a) or (b);
  4. premises which by virtue of Part 5 of the Licensing Act 2003 may at the relevant time be used for the supply of alcohol or which, by virtue of that Part, could have been so used within the 30 minutes before that time;
  5. a place where facilities or activities relating to the sale or consumption of alcohol are at the relevant time permitted by virtue of a permission granted under section 115E of the Highways Act 1980 (highway-related uses).

Council-operated licensed premises:

  1. when the premises are being used for the supply of alcohol, or
  2. within 30 minutes after the end of a period during which the premises have been used for the supply of alcohol.

Prohibited Activities:

  • The consumption of alcohol or anything an authorised officer reasonably believes to be alcohol in breach of an officers request to cease its consumption.
  • Having an unsealed container of alcohol or anything an authorised officer reasonably believes to be alcohol in breach of an authorised officers request to surrender it.

Contravention:

If the Order is made, failure to comply with the Order may result in the issuing of a Fixed Penalty Notice of up to £100 or criminal prosecution, and on conviction a fine of up to £500.

Proposed Order:

Anti-Social Behaviour, Crime And Policing Act 2014, Section 59

Salford City Council (Alcohol) Public Spaces Protection Order 1 Of 2020 (“Order”)

  1. Salford City Council (“the Council”) in exercise of its powers under Section 60 of the Anti-Social Behaviour, Crime and Policing Act 2014 (“the Act “) is extending the above Public Spaces Protection Order for a further three years from ******.
  2. The Order relates to the whole of the City of Salford (“the Restricted Area”).
  3. The effect of the Order is to give a constable or an authorised person the power to:
    • require a person to not consume alcohol or anything which they reasonably believe to be alcohol 
    • require a person surrender anything in their possession which is, or which they reasonably believe to be, alcohol or a container for alcohol
  4. The Council is satisfied that the conditions set out in Sections 59 of the Act have been satisfied and that it is in all the circumstances expedient to extend this Order for the purposes of reducing anti –social behaviour in the Restricted Area. The Council is extending this Order because anti-social behaviour as outlined within the Schedule to this Order has had a detrimental effect on the quality of life of those in the locality. The effect or likely effect of this is of a persistent or continuing nature such as to make this unreasonable, and justifies the restrictions imposed by this Order.
  5. The Order is available for inspection on the Council’s website and also at the offices of the Place Directorate, Civic Campus, Chorley Road, Swinton M27 5FJ (salford.gov.uk)
  6. It is an offence under Section 67 of the Act, for a person, without reasonable excuse, to fail to comply with this Order. A person guilty of an offence under this section is liable on summary conviction to a fine not exceeding level 2 on the standard scale.    

Interpretation

In this Order, except where the context otherwise requires:

  • “the Council" “means the Council of the City of Salford"
  • “Interested Person" “means an individual who lives in the restricted area or who regularly works in or visits that area"

Schedule 

Whole of the City of Salford excluding: 

  1. premises (other than council-operated licensed premises) authorised by a premises licence to be used for the supply of alcohol;
  2. premises authorised by a club premises certificate to be used by the club for the supply of alcohol;

Any person who, without reasonable excuse, fails to comply with this Order shall be liable on summary conviction to a fine not exceeding level 2 (£500) on the standard scale.
