Building Safety Levy

The Building Safety Levy is a statutory charge established by the Building Safety Levy (England) Regulations 2025 and applies to certain residential developments and purpose-built student accommodation (PBSA) in England. Applicable building control applications and notices submitted on or after 1 October 2026 will be subject to the Building Safety Levy regime.

Developments meeting the statutory Previously Developed Land (PDL) condition will be charged at the reduced PDL levy rate.

When is Building Safety Levy information required?

Building Safety Levy information is required where a building control submission relates to:

  • One or more dwellings; or

  • One or more purpose-built student accommodation (PBSA) bedspaces.

This includes developments involving new build construction, conversion or change of use.

The information is required at both the building control application stage and the commencement stage. This applies regardless of the building control route used, including Local Authority Building Control (LABC) applications, Initial Notices submitted through a Registered Building Control Approver (RBCA), Building Safety Regulator (BSR) applications and Section 91ZB applications.

Submission of Building Safety Levy information does not automatically mean that a levy charge will be payable.

Important: Where Building Safety Levy information is required, it must accompany the relevant building control submission. Failure to provide the required information may result in rejection of the submission or delays in determining levy liability.

What do I need to submit?

Building Regulations Application Stage

Where Building Safety Levy information is required, applicants must submit the following form with the relevant building control application:

This form provides information relating to:

  • Planning status;

  • Major residential development status;

  • Number of dwellings and/or PBSA bedspaces and;

  • Previous levy determinations.

Building Regulations Commencement Stage

The Building Safety Levy Charging Information (Commencement Stage) form must be submitted with the first Building Regulations Commencement Notice (or equivalent commencement submission under the applicable building control route), together with any supporting evidence.

This form provides information relating to:

  • Levy charging conditions

  • Exemptions

  • Floorspace information

  • Supporting evidence

Levy determination

Following receipt and assessment of the Building Safety Levy Charging Information (Commencement Stage) form and supporting information, the council will use the information submitted to determine whether a levy charge is payable and, where applicable, calculate the levy amount using the relevant levy rate and chargeable floorspace. The council will then issue either:

  • Levy Liability Notice (LLN), where a levy charge is payable; or

  • Notice of No Charge (NNC), where no levy is payable.

Payment and completion

Where a Levy Liability Notice (LLN) has been issued, the Building Safety Levy must be paid in full. Upon receipt of payment, the council will issue a Levy Payment Certificate.

Important: The Building Safety Levy must be paid in full before completion of the first dwelling or purpose-built student accommodation (PBSA) bedspace within the development. Failure to satisfy the Building Safety Levy requirements, and failure to pay any levy will prevent completion certification being issued under the applicable building control route.

Changes during construction

Changes to a development may require updated Building Safety Levy information to be submitted. Depending on the nature of the change, the council may be required to reassess the levy position and issue a new or revised levy determination notice.

Reviews and appeals

The named client may request a review of a Levy Liability Notice, a revised levy liability amount, or certain refund decisions. Review requests must normally be submitted within 28 days beginning with the day on which the relevant notice was issued.

Following determination of a review, a right of appeal may arise to the First-tier Tribunal (Property Chamber).
