Waste management compliance for short-term lets

If you use your property for business purposes, such as letting it out as a holiday home, self-catering accommodation, running a guesthouse or Airbnb, you are required by law to arrange for a commercial waste collection service.

The Controlled Waste (England and Wales) Regulations 2012 classify waste from such properties as commercial waste, prohibiting the use of the council’s household collection services. 

This applies regardless of the number of days the property is available to guests or whether it is registered for business rates. Improper disposal of commercial waste via domestic collection services is an offence and can lead to legal consequences.

Therefore, it is essential to have a commercial waste contract in place or ensure that waste is transported and disposed of at a registered waste disposal site. If you choose to transport the waste yourself, you must comply with the Duty of Care Regulations, ensuring that you have the relevant waste carrier’s licence, and the waste is taken to a licensed waste disposal facility. Keeping waste transfer notes as proof of proper disposal is also a legal requirement. Failure to follow these regulations could result in fines and enforcement action from the council
