Hilton Lane area

Salford City Council proposes to make the City Of Salford (Hilton Lane Area – Walkden South) (Prohibition Of Waiting) Order 2023 under the Road Traffic Regulation Act 1984. The effect of the proposed order will be to introduce the following provisions:

No Waiting at Any Time

Hilton Lane

  • both sides 10m north west of Jasper Avenue to 10m south east of Burgess Way.

Jasper Avenue

  • both sides south east of Hilton south west for 10m.

Burgess Way

  • both sides south west of Hilton Lane south west for 10m.
  • east side from the south cul-de-sac end north for 22m, including all the turning head.

Avoncliffe Road

  • both sides from its Cul-de-sac end south east for 4m.

Cosgrove Close

  • both sides south west of Avoncliffe Road south west for 11.3m.

City of Salford (Hilton Lane Area – Walkden South) (Prohibition of Waiting) Order 2023

Salford City Council in exercise of its powers under Sections 1(1), 2(1) to (3) and 4(2) of the Road Traffic Regulation Act 1984 ("the Act"), and of all other enabling powers and after consultation with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act, hereby makes the following Order:

Interpretation

In this Order:

  • “disabled person’s badge” has the same meaning as in The Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000;
  • “disabled person’s vehicle” means a vehicle lawfully displaying a disabled person’s badge being a vehicle which, immediately before or after any period of waiting allowed by virtue of a provision of a kind required by the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000 to be included in an order under the Act, has been or is to be used for carrying disabled persons as passengers;
  • “delivering” and “collecting” in relation to postal packets includes checking the goods for the purposes of their delivery or collection;
  • “parking disc” means a disc, issued by a local authority, 125 millimetres square, coloured blue and capable of showing the quarter hour period during which a period of waiting begins, which has not ceased to be valid.
  • “owner” in relation to a vehicle means the person by whom such a vehicle is kept and used

For the purpose of this Order a vehicle shall be regarded as displaying:

  • a disabled person’s badge in the relevant position if:
    • the badge is exhibited on the dashboard or facia of the vehicle, or
    • where the vehicle is not fitted with a dashboard or facia, the badge is exhibited in a conspicuous position on the vehicle,
    • so that the front of the badge is clearly legible from the outside of the vehicle;
  • a parking disc in the relevant position if:
    • the disc is exhibited on the dashboard or facia of the vehicle; or
    • where the vehicle does not have a dashboard or facia, the disc is exhibited in a conspicuous position on the vehicle,
    • so that, when marked to show the quarter-hour period during which a period of waiting began, that period is clearly legible from the outside of the vehicle.

The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

No Waiting At Any Time

Save as provided in Article 3 of this Order no person shall, except upon the direction

or with the permission of a constable in uniform or a civil enforcement officer cause or permit any vehicle to wait at any time on the lengths of road specified the Schedule to this Order.

Exemptions from prohibitions and restrictions - general exemptions

Nothing in Article 2 of this Order shall prevent any person from causing or permitting any vehicle to wait on the lengths of road referred to in that Article for so long as may be necessary to enable:

  • a person to board or alight from the vehicle;
  • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in connection with any of the following operations, namely:
    • building, industrial or demolition operations;
    • the removal of any obstruction to traffic;
    • the maintenance, improvement or reconstruction of the said side of length of road; or
    • the laying, erection, alteration or repair, in or on land adjacent to the said lengths of road, of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus defined in the Communication Act 2003;
  • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in the service of a local authority or a water authority in pursuance of statutory powers or duties;
  • the vehicle to be used for the purpose of delivering or collecting postal packets as defined in the Postal Services Act 2000;
  • the vehicle to take in petrol, oil, water or air from any garage situated on or adjacent to the said side of length of road;
  • the vehicle to wait at or near to any premises situated on or adjacent to the said lengths of road for so long as such waiting by that vehicle is reasonably necessary in connection with any funeral;
  • the vehicle to be used for fire brigade, ambulance or police purposes; or
  • goods to be loaded on to or unloaded from the vehicle

Exemption for disabled persons’ vehicles

Nothing in Article 2 of this Order shall prevent any person to cause or permit a disabled person's vehicle which displays in the relevant position a disabled person's badge, and a parking disc (on which the driver or other person in charge of the vehicle, has marked the time at which the period of waiting began) to wait on the length of road referred to in that Article for a period not exceeding three hours (not being a period separated by an interval of less than one hour from a previous period of waiting by the same vehicle on the same length of road on the same day).

Schedule - No Waiting at any Time

Hilton Lane

  • Both sides from a point 10 metres northwest of the north western extended kerb line of Jasper Avenue, to a point 10 metres southeast of the south eastern extended kerbline of Burgess Way.

Jasper Avenue

  • Both sides from the south western extended kerbline of Hilton Lane in a south westerly direction for 10 metres

Burgess Way

  • Both sides from the south western extended kerbline of Hilton Lane in a south westerly direction for 10 metres
  • East side from the southern cul-de-sac end in a northerly direction for 22 metres, including all the turning head.

Avoncliffe Road

  • Both sides from its Cul-de-sac end in a south easterly direction for 4 metres

Cosgrove Close

  • Both sides from the south western extended kerb line of Avoncliffe Road in a south westerly direction for 11.3 metres

City of Salford (Hilton Lane Area, Walkden South) (20 Mph Speed Limit) (Amendment No.1) Order 2023

Salford City Council in exercise of its powers under sections 82 and 84 of the Road Traffic Regulation Act 1984 (“the Act”) and Part IV of Schedule 9 to the Act, and of all other enabling powers and having regard to section 122 of the Act and having given notice in accordance with subsection (2) of section 84 of the Act and having consulted with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act, hereby makes the following Order: 

Interpretation

The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

The roads specified in the Schedule to this Order that are restricted roads shall cease to be restricted roads for purpose of section 81 of the Act.

Amendment to Existing Order 20mph Speed Limit Order

No person shall drive any motor vehicle at a speed exceeding 20 miles per hour on the roads specified in the Schedule to this Order.

No speed limit imposed by this Order applies to the vehicles falling within Regulation 3(4) of the Road Traffic Exemptions (Special Forces) (Variation and Amendment) Regulations 2011 when used in accordance with Regulation 3(5) of those Regulations.

Statement of Reasons

Revised proposals have been drawn up covering three developments; Highpoint, Burgess Farm and Burgess Way development to implement a ‘No Waiting at Any Time’ (NWAAT) restriction on all the development access points from Hilton Lane. This is to ensure there is safe access to each development by preventing parking close to the junctions which would impede larger vehicles or block visibility sight lines.

The proposal intends to protect access to all three developments, for all vehicles, cycles and pedestrians, allowing a safe amount of manoeuvrability for larger vehicles and also maintain clear visibility for all road users. The restriction will also ensure that the emergency link will be able to be used should it be required.

Additionally, the area is all residential in nature, so an appropriate 20mph speed limit is also proposed to be introduced, in line with government recommendations.

The above proposals will provide a safe and accessible road for all road users.
