Kennedy Road and Willows Road area

City of Salford (Kennedy Road and Willows Road area, Weaste and Seedley) (Prohibition and Restriction of Waiting, Waiting And Loading Amendment) Order 2022

Salford City Council Salford in exercise of its powers under Sections 1(1), 2(1) to (3) and 4(2) of the Road Traffic Regulation Act 1984 ("the Act") and Part lV of Schedule 9 to the Act, and of all other enabling powers and after consultation with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act, hereby makes the following Order:

Interpretation

In this Order:

  • “disabled person’s badge” has the same meaning as in The Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000;
  • “disabled person’s vehicle” means a vehicle lawfully displaying a disabled person’s badge being a vehicle which, immediately before or after any period of waiting allowed by virtue of a provision of a kind required by the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000 to be included in an order under the Act, has been or is to be used for carrying disabled persons as passengers;
  • “delivering” and “collecting” in relation to postal packets includes checking the goods for the purposes of their delivery or collection:
  • “parking disc” means a disc, issued by a local authority, 125 millimetres square, coloured blue and capable of showing the quarter hour period during which a period of waiting begins, which has not ceased to be valid.
  • “owner” in relation to a vehicle means the person by whom such a vehicle is kept and used;
  • “trailer” means any vehicle other than a motor vehicle;

For the purpose of this Order a vehicle shall be regarded as displaying:

  • a disabled person’s badge in the relevant position if:
    • the badge is exhibited on the dashboard or facia of the vehicle, or
    • where the vehicle is not fitted with a dashboard or facia, the badge is exhibited in a conspicuous position on the vehicle, so that the front of the badge is clearly legible from the outside of the vehicle;
  • a parking disc in the relevant position if:
    • the disc is exhibited on the dashboard or facia of the vehicle; or where the vehicle does not have a dashboard or facia, the disc is exhibited in a conspicuous position on the vehicle, so that, when marked to show the quarter-hour period during which a period of waiting began, that period is clearly legible from the outside of the vehicle.

The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

Amendment of existing orders

  • The Orders specified in Schedule 1 to this Order are amended to the extent as specified.

Restriction of waiting

Monday to Saturday between 8am to 6pm

  • Save as provided in Article 6 of this Order no person shall, except upon the direction or with the permission of a constable in uniform, a civil enforcement officer cause or permit any vehicle wait Monday to Saturday between the hours of 8am to 6pm on the lengths of road specified in Schedule 2 to this Order.

No waiting at any time

  • Save as provided in Article 6 of this Order no person shall, except upon the direction or with the permission of a constable in uniform, a civil enforcement officer cause or permit any vehicle to wait at any time on the lengths of road specified in Schedule 3 to this Order.

Restriction of loading/unloading Monday to Saturday between 8am to 9.30am and 4.30am to 6.30pm

  • Nothing in Article 6 of this Order shall permit any person to cause or permit a vehicle to wait to enable goods to be loaded on to or from the vehicle between the hours of 8am to 9.30am and 4.30pm to 6.30pm Monday to Sunday in the lengths of road specified in Schedule 4 to this Order.

Exemptions from prohibitions and restrictions - general exemptions

Nothing in Articles 3, 4 and 5 of this Order shall prevent any person from causing or permitting any vehicle to wait on the lengths of road referred to in that Article for so long as may be necessary to enable:

  • a person to board or alight from the vehicle;
  • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in connection with any of the following operations, namely:
    • building, industrial or demolition operations;
    • the removal of any obstruction to traffic;
    • the maintenance, improvement or reconstruction of the said side of length of road; or
    • the laying, erection, alteration or repair, in or on land adjacent to the said lengths of road, of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus defined in the Telecommunications Act 1984;
  • the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in the service of a local authority or a water authority in pursuance of statutory powers or duties;
  • the vehicle to be used for the purpose of delivering or collecting postal packets as defined in the Postal Services Act 2000;
  • the vehicle to take in petrol, oil, water or air from any garage situated on or adjacent to the said side of length of road;
  • the vehicle to wait at or near to any premises situated on or adjacent to the said lengths of road for so long as such waiting by that vehicle is reasonably necessary in connection with any funeral;
  • the vehicle to be used for fire brigade, ambulance or police purposes.

Exemption for loading and unloading

Nothing in Articles 3 and 4 of this Order shall prevent any person from causing or permitting any vehicle to wait in any length of road specified in Schedules 2 and 3 to this Order for so long as may be necessary to enable goods to be loaded on to or unloaded from the vehicle provided always that no such vehicle may wait for the purpose of loading and unloading as follows:

  • between the hours of 8am to 9.30am and 4.30pm to 6.30pm on Monday to Sunday in the lengths of road specified in Schedule 4 to this Order.

Exemption for disabled persons’ vehicles

Nothing in Articles 3 and 4 of this Order shall prevent any person to cause or permit a disabled person's vehicle which displays in the relevant position a disabled person's badge, and a parking disc (on which the driver or other person in charge of the vehicle, has marked the time at which the period of waiting began) to wait on the length of road referred to in that Article for a period not exceeding 3 hours (not being a period separated by an interval of less than 1 hour from a previous period of waiting by the same vehicle on the same length of road on the same day) provided always that no such vehicle may wait:

  • between the hours of 8am to 9.30am and 4.30pm to 6.30pm on Monday to Sunday in the lengths of road specified in Schedule 4 to this Order.

City of Salford (Kennedy Road And Willows Road area, Weaste And Seedley) (20 Mph Speed Limit) Order 2022

Salford City Council in exercise of its powers under Sections 82 and 84 of the Road Traffic Regulation Act 1984 (hereinafter called "the Act") and having consulted with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act hereby makes the following Order.

Interpretation

In this Order:

  • "Special Forces" means those units of the armed forces of the Crown the maintenance of whose capabilities is the responsibility of the Director of Special Forces or which are for the time being subject to the operational command of that Director.

The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

20mph speed limit

  • The road specified in the Schedule to this Order shall cease to be a restricted road for the purposes of section 81 of this Act
  • No person shall drive any motor vehicle at a speed exceeding 20 miles per hour on the length of road specified in the Schedule to this Order
  • No speed limit imposed by this Order applies to the vehicles falling within Regulation 3(4) of the Road Traffic Exemptions (Special Forces) (Variation and Amendment) Regulations 2011 when used in accordance with Regulation 3(5) of those Regulations.

Any reference in this Order to any enactment shall be construed as a reference to that enactment as amended by any subsequent enactment.

Any reference in this order to any road, street and or other location shall be construed to the name herein and any subsequent name thereafter

Kennedy Road Traffic Regulation Orders

Statement of reasons

Following a residential development on the site of Salford Reds Rugby League ground where residential properties have been created in the Kennedy Road Area, it has become necessary to change the layout of the area to reflect the changing needs and uses of Kennedy Road. Hence, a review into existing waiting and loading restrictions was necessary.

The review concluded that the introduction of a 20mph zone will encourage a safer road environment for pedestrians and cyclists in addition to reducing the likelihood and severity of a potential collision between vehicles.

To ensure accessibility is maintained at all times waiting restrictions will be introduced to regulate parking with particular attention placed on junctions to prevent obstruction of traffic and ensure a clear line of sight. The restrictions include the removal of a number of existing TRO’s that relate to the Rugby Ground which no longer reflect the current situation.

The above proposals will provide a safe and accessible road for all road users.
