Sandwich Street and Holyoake Road area

Notice is hereby given that Salford City Council proposes to make the City of Salford (Sandwich Street and Holyoake Road, Walkden) (Prohibition of Waiting, Restriction of Waiting and Revocation) Order 2022 under the Road Traffic Regulation Act 1984. The effect of the Order will be as follows:

Proposed No Waiting At Any Time on:

Sandwich Street

  • west side (i) from 25.5m south of Manchester Road southerly for 13m; and (ii) from 91m south of Manchester Road southerly for 26m.

Sandwich Street

  • east side, from, 91m south of Manchester Road southerly for 31m.
  • both sides (i) from 137m south of Manchester Road southerly for 20m; and (ii) from Holyoake Road northerly for 10m.

Atkin Street

  • both sides, from Sandwich Street north westerly for 10m.

Holyoake Road

  • north side (i) from 5m west of Sandwich Street, to 5m east of Sandwich Street; (ii) from 50.5m east of Sandwich Street easterly for 17.7m; and (iii) from 5m east of Chilham Road, in a westerly and northerly direction round the radius for 9.3m.
  • south side, from 9.7m east of Chilham Road, in a westerly and northerly direction round the radius for 16m.

Proposed No Waiting, Monday to Friday, 9am to 4pm

Sandwich Street

  • east side (i) from 15m south of Manchester Road, southerly for 76m; and (ii) from 122m south of Manchester Road, southerly for 15m.

City of Salford (Sandwich Street and Holyoake Road, Walkden) (Prohibition of Waiting, Restriction of Waiting and Amendment) Order 2022

Salford City Council in exercise of its powers under Sections 1(1), 2(1) to (3), 4(2), of the Road Traffic Regulations Act 1984 (“the Act”) and Part IV of Schedule 9 to the Act and of all other enabling powers and after consultation with the Chief Officer of Police for the County of Greater Manchester in accordance with Part III of Schedule 9 to the Act, hereby makes the following Order: 

Interpretation

  1. In this Order:
    1. “Disabled Person’s Badge” has the same meaning as in The Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000; “Disabled Person’s Vehicle” means a vehicle lawfully displaying a disabled person’s badge being a vehicle which, immediately before or after any period of waiting allowed by virtue of a provision of a kind required by the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000 to be included in an order under the Act, has been or is to be used for carrying disabled persons as passengers; “Delivering” and “Collecting” in relation to postal packets includes checking the goods for the purposes of their delivery or collection.
    2. For the purpose of this Order a vehicle shall be regarded as displaying:
      1. a Disabled Person’s Badge in the relevant position if:
        1. the badge is exhibited on the dashboard or facia of the vehicle, or
        2. where the vehicle is not fitted with a dashboard or facia, the badge is exhibited in a conspicuous position on the vehicle, so that the front of the badge is clearly legible from the outside of the vehicle;
      2. a Parking Disc in the relevant position if:
        1. the disc is exhibited on the dashboard or facia of the vehicle; or
        2. where the vehicle does not have a dashboard or facia, the disc is exhibited in a conspicuous position on the vehicle, so that, when marked to show the quarter-hour period during which a period of waiting began, that period is clearly legible from the outside of the vehicle.
    3. The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

Revocation of Existing Orders

  1. The Orders specified in Column 1 of Schedule 1 to this Order are amended or revoked to the extent specified in Column 2 of Schedule 1 to this Order.

No Waiting at Any Time

  1. Save as provided in Articles 5 and 6 of this Order no person shall, except upon the direction or with the permission of a constable in uniform or a civil enforcement officer, cause or permit any vehicle to wait at any time on the lengths of road specified in Schedule 2 to this Order.

No Waiting Monday to Friday 9am to 4pm

  1. Save as provided in Articles 5 and 6 of this Order no person shall, except upon the direction or with the permission of a constable in uniform or a civil enforcement officer cause or permit any vehicle to wait on any Monday to Friday inclusive between the hours of 9am and 4pm on the lengths of road specified in Schedule 3 to this Order.

Exemption from prohibition - general exemptions

  1. (1) Nothing in Articles 3 or 4 of this Order shall prevent any person to cause or permit any vehicle to wait on the lengths of road referred to in those Articles for so long as may be necessary to enable:
    1. a person to board or alight from the vehicle;
    2. the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in connection with any of the following operations, namely:
      1. building, industrial or demolition operations
      2. the removal of any obstruction to traffic;
      3. the maintenance, improvement or reconstruction of the said length of road; or
      4. the laying, erection, alteration or repair, in or on land adjacent to the said length of road, of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus defined in the Telecommunications Act 1984;
    3. the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in the service of a local authority or a water authority in pursuance of statutory powers or duties;
    4. the vehicle to be used for the purpose of delivering or collecting postal packets as defined in the Postal Services Act 2000;
    5. the vehicle to take in petrol, oil, water or air from any garage situated on or adjacent to the said length of road;
    6. the vehicle to wait at or near to any premises situated on or adjacent to the said length of road for so long as such waiting by that vehicle is reasonably necessary in connection with any funeral;
    7. the vehicle to be used for fire brigade, ambulance or police purposes.
    8. goods to be loaded onto or from the vehicle.

Exemption for disabled persons' vehicles

  1. Nothing in Articles 3 or 4 of this Order shall prevent any person to cause or permit a Disabled Person's Vehicle which displays in the relevant position a Disabled Person's Badge, and a Parking Disc (on which the driver or other person in charge of the vehicle, has marked the time at which the period of waiting began) to wait on the length of road referred to in the said Articles for a period not exceeding 3 hours (not being a period separated by an interval of less than 1 hour from a previous period of waiting by the same vehicle on the same length of road on the same day) vehicle.

Statement of reasons

City of Salford (Sandwich Street and Holyoake Road, Walkden) (Prohibition of Waiting, Restriction of Waiting and Amendment) Order 2022

Vehicles are parking too close to the junction with Sandwich Street and Holyoake Road, near to access for the new development Fenman Mews Apartment Building, and on the bend at the junction with Chilham Road. Vehicles are also ignoring the road closure on Holyoake Road, at the junction with Chilham Road and driving between the bollards / over-running the footway.  

Therefore, it is proposed to implement waiting restrictions on the bend to maintain safe passage for vehicles negotiating the corner, and to ensure that pedestrian access crossing points are not blocked.  It is also proposed to install additional bollards to prevent further abuse of the road closure.  These measures will allow pedestrians to cross the road safely

Additionally, there have been difficulties gaining access for bin collections at Coniston House. Refuse wagons are having to reverse down the street to whilst undertaking collections. They also have difficulty collecting the bins between parked cars. This has the effect that the refuse wagon may be double parked whilst collections are carried out, blocking vehicles from access and exiting Fenman Mews Apartment Building.

Therefore, it is proposed:

  • To revoke various existing restrictions on Sandwich Street and Holyoake Road and implement new revised waiting restrictions to support the current access requirements.
  • To implement waiting restrictions at the junction of Holyoake Road and Chilham Road, to prevent inconsiderate and obstructive parking on the bend, creating a hazard to other road users.
  • To provide additional restrictions on the north side of Holyoake Road outside Coniston House, to the end of the existing parking bay. This will ensure access to the Fenman Mews apartment building is maintained and will assist in refuse collections from Coniston House.
